Using this Guide
________________________________________________
This guide is produced for training purposes only and should not be used as a substitute
for professional or legal advice.
The guide is split into the main areas of the contract eg health & safety, time, payments,
claims, insurances, administration, disputes etc. The user can go directly to the relevant
section of interest. Each flowchart is generally read from top to bottom working from left
to right.
Orange ‘text boxes’ are not extracts from the contract but rather a personal comment by
the author. Bold and/or underlined words and phrases are simply the authors own
emphasis and not that of the contract. On occasion, the order of wording in the contract is
rearranged by the author to make for ease of understanding. The reader should, however,
always check the form of contract wording.
In some instances flowcharts use less phrases, reduced wording or extracts from that
contained in the actual contract. All textboxes, however, refer to the contract clause(s) in
question to enable easy reference to the full contract text where required.
This training document attempts to schedule, assemble and summarise the wording of
many separate yet related clauses in the contract for greater consideration of the bigger
picture. “Interpretation” of the contract and its wording is another matter entirely and can
only truly be understood in tandem with knowledge of common law, contract law and
related matters. This is one reason why professional legal advice is so essential.
It is the intention to update and expanded this guide on a regular basis. User’s comments
and ideas are welcome for consideration in this process.
