Section 6.1The Extent of Medical Mistakes
Introduction
In this chapter we will analyze how ethical health care organizations address the serious
problem of medical mistakes. We will also take an in-depth look at some legal, regulatory,
political, and administrative solutions that may lessen the risk to patients while also protect-
ing organizations from legal liability. Throughout this chapter we will also explore the ethical
implications of this issue and how an awareness of the ultimate ends of health care can yield
practical solutions.
6.1 The Extent of Medical Mistakes
Until 1999, most Americans were unaware of the extent of medical errors in health care. That
year, the Institute of Medicine (IOM) released the report “To Err Is Human: Building a Safer
Health System” (IOM, 1999). Based on a series of studies, “To Err Is Human” concluded that up
to 100,000 people die from preventable medical errors every year in the United States (IOM,
1999). The shocking statistic thoroughly shook the collective trust in American health care.
Another IOM report, published in 2001 and titled “Crossing the Quality Chasm,” furthered
the point that health risks to patients from health care providers due to preventable human
errors were much too high. (See Figure 6.1 for a comparison of the percentage of medical
errors made in various countries.)

There are two malpractice cases. Your instructor will assign your either Case Study 1:
Malpractice Action brought by Yolanda Pinnelas or Case Study 2: Wrongful Death by Howard
Carpenter on Behalf of Wilma Carpenter, Deceased. The group will construct a 10–15 page
paper about the legal constructs involved in ONE of the cases.
Directions:
The group will write a 10–15 page APA formatted paper. (Title page and references list do NOT
count towards the 1–15 pages). Support the paper with peer reviewed articles and case law
where applicable. You may have an appendix that has samples of documents that support your
positions or expands on the facts of the case.
You will post a draft of the group paper in the Discussion area of Unit 8. This will give you
an opportunity to get peer feedback and to learn from others.

Section 6.1The Extent of Medical Mistakes
Introduction
In this chapter we will analyze how ethical health care organizations address the serious
problem of medical mistakes. We will also take an in-depth look at some legal, regulatory,
political, and administrative solutions that may lessen the risk to patients while also protect-
ing organizations from legal liability. Throughout this chapter we will also explore the ethical
implications of this issue and how an awareness of the ultimate ends of health care can yield
practical solutions.
6.1 The Extent of Medical Mistakes
Until 1999, most Americans were unaware of the extent of medical errors in health care. That
year, the Institute of Medicine (IOM) released the report “To Err Is Human: Building a Safer
Health System” (IOM, 1999). Based on a series of studies, “To Err Is Human” concluded that up
to 100,000 people die from preventable medical errors every year in the United States (IOM,
1999). The shocking statistic thoroughly shook the collective trust in American health care.
Another IOM report, published in 2001 and titled “Crossing the Quality Chasm,” furthered
the point that health risks to patients from health care providers due to preventable human
errors were much too high. (See Figure 6.1 for a comparison of the percentage of medical
errors made in various countries.)

There are two malpractice cases. Your instructor will assign your either Case Study 1:
Malpractice Action brought by Yolanda Pinnelas or Case Study 2: Wrongful Death by Howard
Carpenter on Behalf of Wilma Carpenter, Deceased. The group will construct a 10–15 page
paper about the legal constructs involved in ONE of the cases.
Directions:
The group will write a 10–15 page APA formatted paper. (Title page and references list do NOT
count towards the 1–15 pages). Support the paper with peer reviewed articles and case law
where applicable. You may have an appendix that has samples of documents that support your
positions or expands on the facts of the case.
You will post a draft of the group paper in the Discussion area of Unit 8. This will give you
an opportunity to get peer feedback and to learn from others.

ith medical malpractice insurance premiums
rising sharply across the nation and at least a
dozen states facing an insurance crisis, physicians
and policymakers are debating vigorously how
best to respond. Tort reforms that would cap awards are
among the proposals and have proven effective at moderat-
ing premiums in several states. [See “Understanding the
Physician Liability Insurance Crisis,” FPM, October 2002,
page 47.] But while physicians await legislative action or an
upturn in the economy to soften the impact of insurance
hikes, there is something doctors can do: better manage risk.
Risk management involves more than just reading a
journal article, listening to a lecture or filling out a work-
book. It is a style of practice that endeavors, first and
foremost, to prevent patient injuries; second, to avoid
malpractice claims; and third, when a claim does occur,
to reduce malpractice claim losses.
First prevent patient injury
A while back, I was involved in the care of a four-year-old
boy who was admitted with status asthmaticus. He was
very ill, requiring intubation and ventilatory support. ➤

other left-side brain tissue before it was
discovered that they were working on
the wrong side.
The left-side wound was closed,

The error in the O.R. was revealed
to the parents shortly after the surgery,
but only as if it was a minor and incon-
sequential gaffe.
The patient recuperated, left the
hospital, returned to his regular activi-
ties and graduated from high school
before his parents could no longer deny
he was not all right. After a thorough
neurological assessment he had to be
placed in an assisted living facility for
brain damaged individuals.
When the full magnitude of the
consequences came to light a lawsuit
was filed which resulted in a $11 mil-
lion judgment which was affirmed by
the Supreme Court of Arkansas.

Hilo Medical Center admitted Arturo Iturralde because the patient complained of frequent falls and bilateral legs weakness. Upon diagnosis, the orthopedic physician, Dr. Ricketson, diagnosed the patient degenerative spondylolisthesis L4–5 with stenosis and booked a spinal fusion surgery. The medical equipment kits meant to conduct the procedure were not available at the hospital, so they were ordered from Medtronic. Upon their arrival, the inventory staff attendant failed to record them. Despite Dr. Ricketson being informed about this mistake, he decided to continue with the operation as scheduled. Failure to locate the appropriate rods needed to stabilize the spine; the doctor became impatient of the 90 minutes it would take for them to be brought and as an alternative used a screwdriver that was in the kit. The patient was not informed and later discharged home with permission to drive and advised to follow up on weakly therapies. While at home, the rod broke and the patient required a fresh operation. The caretaker present took the pieces of the fractured screwdriver to the lawyer because her supervisor would want to disclose why the leading operation was unsuccessful. Later, the patient kicked the bucket after experiencing many complications after the operation had taken place.

Carpenter, Deceased. The group will construct a 10–15-page paper about the legal constructs involved in one
of the cases.
Directions:
The group will write a10–15-page APA formatted paper (title page and references list do not count towards
the 10–15 pages). Support the paper with peer reviewed articles and case law where applicable. You must
have minimum of eight references. You may have an appendix that has samples of documents that support
your positions or expands on the facts of the case.
You will post a draft of the group paper in the Discussion Board of Unit 7. This will give you an opportunity to
get peer feedback and to learn from others.
You may use Goggle Hangouts™, SKYPE®, or other conferencing tools. Additionally, you may want to use a

I have included my comments and recommendations for your consideration. Amy Johnson is a 10 month-old white female. In my opinion, this case is meritorious due to improper installation of the car seat. This resulted in severe brain injury and permanent mental and physical disabilities. A state worker named Susan White arrived at the Johnson’s home on 5/20/2013 to transport Amy for a meeting with her biological mother. The Johnson’s are the child’s foster parents. Amy was 5 weeks old and weighed 4 lbs. 12 oz. at the time. Ms. White installed Amy’s car seat in the vehicle, placed the infant in the car seat, and drove to her biological mother’s house. When they arrived, Ms. White found the infant unconscious and called 911. The Got-You-Covered EMT service arrived within 5 minutes. In their notes they described “the car seat had been improperly installed in an upright position instead of at a proper and safe angle. The infant’s head had flopped forward within the duration of the twelve minute car ride”. They transported Amy to Little Wonders Children’s Center where she was admitted to the PICU.
- 2. 2 Confidential Attorney Work Product Note: This is a fictitious situation and report developed for the sole purpose of demonstrating examples of report format and length. Actual reports will vary in format and length appropriate to case type and complexity as determined by legal nurse consultant and attorney-client. Regarding her initial assessment in the PICU, the doctor’s note described that the incident “resulted in positional asphyxiation including obstruction of the airway, loss of consciousness, and cardiac arrest.” Multiple cranial ultrasounds were performed during her hospital stay. Amy remained in the PICU on mechanical ventilation for a period of 3 weeks. In the history note it was documented that Amy was born prematurely on 4/12/13 at 34 weeks and 6 days at Sunnyside Hospital. Her diagnoses were prematurity and intrauterine growth restriction (IUGR) weighing in at 3 lbs. and 1.5 oz. She stayed in the NICU for just over 3 weeks. During Amy’s 9-month check-up it was noted by her pediatrician, Dr. M. Harper, that Amy had several major developmental delays. Her developmental progress was closer to that of a 3 month old. My recommendations are as follows: Obtain complete medical records from birth to now including: o Labor & Delivery, Neonatal ICU, EMT, Pediatric ICU, Pediatric visits o Cranial ultrasounds, CT scans, and MRIs from NICU stay and PICU stay. These should be compared by a radiologist. Obtain policies and procedures and training requirements from the Division of Youth and Family Services including: o Car seat installation o Transporting a child Discover whether Ms. White was CPR certified o Did she initiate CPR? o If so, after how long? o Was her CPR technique up to date and appropriate for a 5 week old infant? If not, Ms. White as well as the DYFS could be charged with negligence. Discover whether the car seat used in transport has a minimum weight requirement of 4 or 5 lbs. o Many car seats’ minimum weight requirement is 5 lbs. If the DYFS placed Amy in a 5 lbs car seat, then they can be charged with negligence as reports show that she was only 4 lbs. 12 oz. when she was transported. o Was this the car seat Amy was discharged from the NICU in? If the NICU discharged Amy in a 5 lbs car seat when she would have required a 4 lbs car seat, they can be charged with negligence as well. Discover Amy’s family history o Why was she put up for adoption? o Was there any substance abuse by the biological mother that would affect Amy’s development? o Does Amy have any biological siblings? o If so, do any siblings have mental deficiencies and/or developmental delays? A more detailed report with a comprehensive chronological timeline to assist in developing this case. Locate expert witnesses including: o Radiologist
