incident. Police have certainly been subject to intense public scrutiny
and criticism by those who view the videos of police action that are
being uploaded to the internet daily. However, what does a use of
force incident look like from the eyes of the officer who shows up at
the scene? Chris Lawrence will explore the psychology behind the
use of force as well as the human factors involved in use of force
incidents, and address factors such as cognitive biases, reaction
times, memory gaps, narrowed vision, and other critical elements.

Use of force incidents by police have gained international media
attention in recent years. These incidents have raised a number of
concerns for police legal counsel, professional standards officers,
internal affairs, and command level staff. This session will provide
first-hand accounts from legal counsel in some of the most high
profile and controversial incidents in Canada and the U.S over the
past several years.
•	 The death of Robert Dziekanski at the Vancouver International
Airport (2007), the subsequent commission of inquiry into
his death (Braidwood Commission, 2009 and 2010), and the
perjury trials of four RCMP officers involved in the incident
(2014-2015)

There is no question that we live in an increasingly digital world, and
the explosion of citizen video as well as increased use of body worn
and dashboard cameras means that police actions are captured
on camera regularly. This proliferation of video has raised some
ongoing questions about the propriety of officers under investigation
reviewing video footage prior to providing a statement. This session
will discuss the legal issues surrounding the use of “incident video”
during an investigation and will propose some best practices to think
about when developing such policies for your own department.

The US Justice Department has made substantial investments to
help law enforcement agencies nationwide procure and implement
body worn cameras and make the use of such technology more
widespread. An increasing number of agencies are contemplating
the use of cameras as a means of building public trust in policing,
however, there are many challenges and issues to be considered
before implementing a body-worn camera program. This session will
discuss body worn cameras as tools in building police accountability
and will explore the legal and logistical implications of instituting
body worn and other cameras.

Police services are struggling with a legacy of poor relations with
African American and Hispanic communities. Police services must
address the fact that, historically, they were often perceived to be
the primary state agency challenging and resisting Civil Rights, and
are now faced with acknowledging that history and the ongoing
mistrust that it has created. This roundtable discussion will consider
historical and institutional racism in the US, how police should be
working to address this history, and offer suggestions and best
practices for building increasing legitimacy and moving forward.

Law enforcement, by its very nature, is a high risk business, where
risk can evolve activities ranging from the flow of evidence in a
property room to daily occurrences of patrol operations. In the field,
decisions are being made by relatively young patrol officers in high
stress situations, which are tense, uncertain and rapidly evolving.
This activity alone can expose the agency to various levels of risk,
with diverse consequences, in areas such as vehicle pursuits, uses
of force, arrests and searches. And these events can and do lead
to claims against the agency and, of course, eventual litigation and
payouts.
Unfortunately, law enforcement agencies as a whole do not have
in-house risk managers and generally use long-established and
outdated measures to handle risk and its consequences; they take
a reactive approach to resolve the matter; and then they suffer the
consequences, including financial loss. However, to stay ahead
of the curve, it is necessary for these agencies to move beyond
traditional remedies, by utilizing a comprehensive and coordinated
risk management program. This proactive program includes, at a
minimum, the monitoring of operational trends on a daily basis, the
continual checking of the agency’s vital signs, and the assessing
of work product. The following areas will be discussed regarding
the essential elements of such a successful police-related risk
management system.

Police Services

The traditional scope of police work has been steadily widening
and now encompasses diverse and demanding functions such
as partnering on national security and re-engaging in community
policing. Concurrently, public mistrust of police is at an all-time high
and police have been the target of much backlash. As a result,
police services across the country are facing a collective challenge
in recruiting and retaining good quality candidates. This session
will provide insights on best practices in attracting, training, and
retaining candidates, from undertaking the initial screening phase
to providing ongoing professional development. It will also help
navigate the legalities of the initial screening process.

And these events can and do lead to claims against the agency and, of course, eventual litigation and payouts. Unfortunately, law enforcement agencies as a whole do not have in-house risk managers and generally use long-established and outdated measures to handle risk and its consequences; they take a reactive approach to resolve the matter; and then they suffer the consequences, including financial loss.
