1. Vonlee Titlow was convicted of second-degree murder for participating in his uncle's murder with his aunt Billie Rogers in order to inherit the uncle's estate. Titlow had originally agreed to a plea deal but later withdrew the plea.
2. Titlow filed for habeas corpus relief claiming ineffective assistance of counsel, specifically that his attorney Frederick Toca provided deficient counsel by allowing him to withdraw his plea and maintain his claim of innocence.
3. The Sixth Circuit granted habeas relief, but the state argues it failed to give appropriate deference to the state court ruling under AEDPA. The state argues Titlow failed to meet the Strickland and Lafler tests to prove ineffective assistance of counsel

The plaintiff brought a wrongful death action against the defendants resulting from a car accident at an intersection in Lexington, North Carolina. The defendants claimed the deceased driver was contributorily negligent. The court refused to grant the defendants' motion for nonsuit on that basis. The complaint was also not defective as it referenced damages in the summons filed within one year of the driver's death.
Assignment based on the Michael Hernandez case. Whichever side we argued for in previous homework, now we had to argue for the other side to learn that a law firm the paralegal does not get to pick who should and should not be represented by the law firm.
(1) The joint will of Mr. and Mrs. Boucher contains property they owned jointly and separately. Epperson v. White establishes that a joint will cannot probate the property of one testator at their death if it is meant to dispose of all property at the death of the surviving testator.
(2) Epperson v. White also held that any attempt to dispose of property in a manner not sanctioned by statute defeats the intentions of the will. Applying this to Boucher v. Bufford, the joint will cannot probate Mrs. Boucher's property at her death or wait to probate all property until Mr. Boucher's death.
