ing, Damodar Agarwal
emphasised, “First In-

try is the backbone of

During the
event, Pawan
Arora said,

systemic support is driv-
ing people to consider
migration. We are com-
mitted to address these
social concerns and ful-
filling our responsibili-

Adalat at 2 pm on Mon-
day for an amicable reso-
lution of disputes, with
media cameras being al-
lowed inside courtrooms.
The week-long special
Lok Adalat, celebrating
75 years of the Supreme
Court, began with the
aim to “facilitate amica-
ble settlements of suita-
ble pending cases”, in
matters that have “ele-
ments of settlement”.
“From today till Friday,
we will have the Su-
preme Court Lok Adalat
and the first seven bench-
es will sit for it. If law-
yers have cases which
can go before the Lok
Adalat, please bring
them,” CJI said at outset
of day’s proceedings. CJI
had said judges dedicated
to the institution of jus-
tice are concerned about
large backlog of cases.

Four boys drowned while
taking a bath in a pond in
Rajasthan’s Didwana
district, police said on
Monday. According to
the police, the incident
took place on Sunday in
Kerap village when the
victims -- Bhupesh,
Shivraj, Vishal and Sahil
-- had gone to play near
the pond.
When the children,
aged between 12 to 15
years, did not return till
late, their parents started
a search for them and
spotted their slippers
near the pond, they said.
Suspecting that the
boysmighthavedrowned
in the pond, some of the
parents jumped into the
pond and took out two
bodies at around 9 pm on
Sunday, the police said.
The other two bodies
were taken out by a team
of SDRF from Nagaur
and local divers at around
2 am, they said.

turned to work after a

an indefinite hunger
strike starting Monday.
Under the banner of the
Mazdoor Congress (IN-
TUC), the workers are
protesting to demand the
removal of conductors
who have been inappro-
priately assigned for over
a decade, the provision of
night rest allowances,
and the payment of over-
due arrears. The ongoing
protest threatens to affect
daily commutes as nego-
tiations between the
workers and manage-
ment are yet to reach a
resolution.

A woman along with her
two children allegedly
committed suicide by
jumping into a well in
Bhilwara district of Ra-
jasthan on Monday, po-
lice said. The bodies
were recovered from the
well and sent for post-
mortem, they said.

Teli said that Raju Devi
Gadri (30) left her home
and jumped into a well
with her six-month-old
son and her daughter in
an agriculture farm near
her house.
As per the primary in-
vestigation, the woman

husband in the morning,
after which she left home,
Teli said.
When she did not re-
turn, the family members
started looking for her
and came to know about
the incident.

Mungana Tanda, Dhari-
yawad, Pratapgarh, a
couple was brutally mur-
dered for defying a Khap
Panchayat order. Despite
a HC directive issued a
year ago for police pro-
tection, local authorities
failed to safeguard Sura-
jmal Labana, Lachhibai,
and their three-year-old
daughter. The couple was
killed by their own three
sons, among other attack-
ers, and their bodies were
disposed of in an anicut.
Two suspects have been
detained, while one re-
mains at large. The bod-
ies were discovered late
Monday afternoon fol-
lowing a district-wide
search led by SP Laxman
Das. The village is in
shock as police investi-
gate the threats faced by
the family and continue

major crackdown in
Udaipur, the Anti-
Corruption Bureau (ACB)
has arrested Ganpat, the
Executive Engineer of the
Water Resources Depart-
ment, and Gajendra, the Additional Administrative
Officer. The officials were apprehended while accepting
a bribe of Rs 40,000, intended to expedite the issuance
of a work order for a tender. The operation, led by ACB
DIG Rajendra Goyal, was conducted under the direction
of ACB DG Raviprakash Mehrada.
Bharatpur: In a significant crackdown against
anti-social elements and wanted criminals,
the Bharatpur Range Police launched a major
operation on Monday. As part of the Area Domina-
tion Campaign, 1,377 police officers and personnel
conducted raids across various districts. A total of
328 teams targeted 1,380 locations, resulting in the
arrest of 797 criminals. Two cases were registered
against the illegal mining mafia and one accused was
arrested. Also, 4 tractors and 3 LNT machines being
used for illegal mining have been seized. 60 people
were arrested for disturbing the peace. Along with this,
23 people have been arrested in different cases.

Jaipur: In a recent address at the Organ Donation
and Transplant Awareness Dialogue and Felicitation
Ceremony hosted by the Indian Red Cross Society,
Governor Kalraj Mishra highlighted the critical shortage of
organ donations in India. He revealed that approximately
500,000 lives are lost annually due to the lack of organ
transplants. Mishra emphasized the urgent need for a
robust awareness campaign to bridge the gap between
the high demand for organ transplants and the insufficient
number of available organs. He pointed out that India’s
organ donation rate stands at only 0.16 per million people.

recovered 326 mobile phones that
had been lost, stolen, or snatched
over the past years. The total value
of these phones is approximately
Rs 75 lakh. The recovered devices
were returned to their rightful own-

nally got the possession
of approximately 10.96
acres of land that was ac-
quired for Jaipur Airport
back in 2010.
Two days ago, the Air-
port Authority wrote a
letter to the District Col-
lector Prakash Rajpuro-
hit regarding this matter.
Today, in the presence
of the District Adminis-
tration officials, the Air-
port Administration was
handed over the posses-
sion of the land. Under
the supervision of Tehsil-
dar Sanganer Arvind
Kaviya, the encroach-
ments were removed
from Manoharpura vil-
lage, Ram Singh Nagar,
near Terminal 1 in the
presence of police force.
Upon the removal of en-
croachments, the Airport
Administration promptly
took possession of land.
Authorities cleared the encroachments near airport as per the expansion plan. Police personnel

New fixed charges for
electricity in Rajasthan

The Commission has
not increased the energy
charges in any category
except BPL-small con-
sumers but the previously
decided fixed charge has

time, 21 paise per unit
“extra” will have to be
paid for green energy.

The Rajasthan Assembly was briefly adjourned
on Monday amid a ruckus after the opposition
cornered the government over crimes against
Dalits. During Zero Hour, Bharat Adivasi Party MLA
Thavar Chand raised the murder of a Dalit teacher in
Salumbhar district last week. He alleged the gov-
ernment was biased on providing compensation.
Congress MLA Pitram Singh Kala also raised several
cases of atrocities against Dalits. He referred to the
murder of Laxman Meghwal in Bikaner and asked
what action the government had taken. Leader of Op-
position Tikaram Jully also targeted the government on
the issue. In response, Parliamentary Affairs Minister
Jogaram Patel said the Congress was shedding
crocodile tears. This sparked a ruckus in the House,
following which Speaker Vasudev Devnani adjourned
the proceedings till 2 pm. Earlier, BJP MLA Shrichand
Kriplani also raised the issue of Congress MLA Shanti
Dhariwal using “abusive language” in the House.
Devnani said he would give a ruling on the matter after
Question Hour on Tuesday.

Colonization Minister Hemant Meena said
that fake degrees were issued by the Allot-
ment Officer’s Office Nachana and
Mohangarh A and B in the past years and
on their basis, mutations have also been

Meena informed that an FIR has been registered by
the Anti-Corruption Bureau after investigation.

in state, then the woman is consid-

said. He also referred to a circular of the
state government dated August 28, 2012.

Harris will be crashing
through many glass ceil-
ings if she makes it to 1600
Pennsylvania Avenue
North West – or, as it is
better known, the White
House. She would be the
first woman president, and
also a woman of colour
with both Indian and Ja-
maican heritage. But she
would also be the first
Democrat to win an elec-
tion from a political pow-
erbase in California.
In the exceptional re-
public that is the US of A,
California is truly excep-
tional – and that grates
with much of the rest of
the country. It, and the
people who hail from it,
are too big, too rich, too
inventive, too liberal – and
altogether just too much, if
you are from anywhere
else, that is.
If California was a na-
tion, it would have the
world’s fifth largest econ-
omy. It contributes around
15% of US GDP, way out
of proportion to other
states, and is home to tech
giants including Apple,
Meta and Google, along-
side major corporations
such as Visa, Chevron and
Wells Fargo.
And just down from
Silicon Valley you’ll find
the Hollywood Hills, home
to the myth and mystery of
the movie business. Hol-
lywood has given us such
California politicians as
former governor Arnold
Schwarzenegger, Clint
Eastwood – mayor of Car-
mel-by-the-Sea – and a
one Ronald Wilson Rea-
gan, who made the politi-
cal journey from Democrat
to conservative Republi-
can. But more on him later.
For the US heartland,
California feels like a sep-
arate country. Somehow,
being far west has turned it
– and particularly its Dem-
ocrat politicians – far left
in the minds of those Mid-
westerners, and there is
almost no history of sig-
nificant runs for the presi-
dency for politicians
who’ve cut their teeth in its
capital, Sacramento.
Barring Harris’own halt-
ing run in 2020, you have
to look back to 1992 for the
last serious Californian tilt
at the presidency. This was
when the then governor,
Jerry Brown, made his final
run, offering a serious chal-
lenge to Bill Clinton before
choosing Rev Jesse Jack-
son as his vice-presidential
pick, something that a
small-c conservative coun-
try was just not ready for.
And before Brown? Pretty
much zilch.
So where should Harris
look to for inspiration and
does the stereotype of Cal-
ifornia failures actually
hold weight? She can look
to Diane Feinstein and
Barbara Boxer, who
smashed the California
glass ceiling when they
were elected in 1992 as the
state’s first women sena-
tors. The liberal Boxer was
actually succeeded in the
Senate by Kamala Harris,
who then served alongside
Feinstein in Congress.
Feinstein, who died last
year, made her name as
mayor of San Francisco
and served in the Senate
for more than 30 years.
Her decline – and refusal
to retire – has more than a
few echoes, not with Har-
ris, but with Joe Biden.
And if Harris needs further
inspiration of a successful
woman in Washington, she
need look no further than
Nancy Pelosi as the first
female speaker of the
House and, until her retire-
ment from the speakership,
one of the key leaders in
legislative government.
Across the aisle
The reality is, of course
that California has pro-
duced a raft of successful
politicians at the highest
level – but to date, they
have been men, and they
have been Republican.
Midwesterners don’t actu-
ally mind Californians – as
long as they’re conserva-
tive Californians.
While John Fremont
came close in 1856, just
six years after California
entered the Union, the first
Republican president from
the state was Herbert Hoo-
ver in 1928. He swept the
country other than the Dix-
ie South and New York,
campaigning to maintain
US prosperity.
The Wall Street crash
and the Depression put
paid to a Hoover second
term and while the Repub-
licans won the presidency
back under Eisenhower in
1952, the most prominent
Californian appointment
of the 1950s was Earl War-
ren as chief justice of the
US Supreme Court. He
presided over a reforming
Court, most especially
around civil rights.
Next up to bat for the
presidency was former
vice-president Richard
Nixon, who benefited from
the chaos among the Dem-
ocrats in 1968 following
LBJ’s decision not to run,
to beat the incumbent
Democratic vice-president
Hubert Humphrey – surely
a lesson for Harris.

ON BAIL AS A RULE
he Supreme Court’s refusal to interfere in
Jharkhand High Court’s order granting bail
to former Chief Minister Hemant Soren in
a money laundering and land scam case must be
counted as a rare setback to the Enforcement Direc-
torate. The arrest took place before the Lok Sabha
elections and was expected to boost the BJP’s
chances of victory in the state. Instead, it became a
rallying point and the party ended up losing all seats
in the tribal belt.
The high court allowed bail as it did not find any
direct involvement of Soren in the case. The Supreme
Court found the order “well reasoned”.
Soren’s case being different from that of Aam
Aadmi Party leaders languishing in jail for the liquor
policy scam and therefore they continue to be denied
bail. With the ED filing a charge-sheet against
Arvind Kejriwal he is unlikely to come out of the
jail any time soon. His deputy Manish Sisodia faces
the same fate.

hief Justice of India DY Chandrachud’s re-
cent remarks on trial courts’ reluctance to
grant bail not only in significant or serious
crimes but also simple cases highlight a critical issue
in the judicial system. The Supreme Court has con-
sistently emphasised that bail should be the norm
and jail the exception. However, this principle is
frequently overlooked by lower courts, resulting in
a high volume of bail pleas reaching the apex court.
The CJI’s concern is rooted in the belief that rou-
tine denial of bail by trial courts and high courts not
only infringes on individual rights but also places
an undue burden on
the Supreme Court.
When lower courts
“play it safe” by de-
nying bail, they con-
tribute to the back-
log of cases pending
before the highest
court.
The judicial reluc-
tance to grant bail is
often driven by the
fear of public back-
lash or the percep-
tion of being lenient
towards serious of-
fenders. However,
this cautious ap-
proach undermines the foundational legal principle
that every individual is presumed innocent until
proven guilty. Denying bail without sufficient cause
can lead to prolonged and unjustified incarceration,
eroding public trust in the judicial process.
To address this issue, there needs to be a con-
certed effort to reinforce the guidelines established
by the Supreme Court regarding bail. Training and
sensitizing judicial officers about the importance of
upholding these principles is essential. Moreover,
there should be a mechanism to review and rectify
instances where bail is unjustly denied. Upholding
the right to bail is crucial not just for individual
liberty but for the overall efficiency and credibility
of the judicial system.

Preparations for relief to income tax payers

he Central govt
is preparing to
give relief to the
income tax payers of the
country. The govt is pre-
paring to accept the black
money caught in income
tax raids and survey ac-
tion with changes in the
income tax law and close
these cases after paying a
lump sum income tax on
it. A proposal has been
giveninthisregard,which
will be effective from 1st
September. It is believed
that the govt’s intention
behind this exercise is to
reduce the number of
casesbetweenthetaxpay-
ers and the department
along with raising maxi-
mum revenue, increasing
complianceofincometax
rules and also giving an
opportunitytothetaxpay-
ers who evade income tax
to correct their mistake.
The current process of
settlement of income tax
raids and surveys is not
only very long and pain-
ful, but the department
also has to wait for years
to recover the revenue.
There has always been a
disputebetweentheoffic-
ers taking action and the
taxpayers regarding the
so-called black money
caught or calculated. For
this dispute, taxpayers
have generally been
pleading for justice from
income tax appeal to ap-
pellate tribunal, high
courtandSupremeCourt,
which takes years to be
resolved. The current sit-
uation is also that even if
taxpayers get relief at any
level,notonlythetaxpay-
ers but even their tax ad-
visors have to work hard
to get it, whereas on the
contrary, if any liability
arises on the taxpayer,
then the officers, barring
exceptions, do not delay
even a day for recovery,
whethertherecoverypro-
cess is legally correct or
not. In such a situation,
the option of paying 60%
income tax on the black
money caught in income
tax raids and surveys can
also encourage taxpayers
to pay the correct income
tax and a significant de-
crease in litigation can
also be expected from
this.Thespecialthingthat
is being told is that if the
taxpayer is ready to pay
incometaxonanyamount
other than the black in-
come mentioned by the
department, then he will
have to pay income tax at
the rate of only 50%.
Chief Income Tax Ad-
visor CA O.P. Agarwal
says that the Union Budg-
et indicates plans to sim-
plify the Income Tax Act
and reduce disputes be-
tween taxpayers and the
department. The govern-
ment aims to amend the
Act to resolve long-pend-
ing cases promptly.Addi-
tionally,thereintroduction
of the Vivaad se Vishwas
scheme aims to settle
pending cases with the In-
come Tax Department.
The decision to close cas-
eswitha60%taxpayment
on black money caught in
tax raids is a positive step,
though further clarifica-
tion is needed.
Income tax consultant
and former general sec-
retary of the Federation
of Rajasthan Trade and
Industries, CA Vijay
Goyal, supports this
move towards simplify-
ing income tax laws and
reducing disputes. If the
department accepts
black money discovered
in raids and allows set-
tlement with a 60% tax
payment, cases that usu-
ally drag on for years
could be resolved swift-
ly. This would expedite
departmental work and
reduce taxpayer harass-
ment. The Vivaad se
Vishwas scheme appears
beneficial, but its details
are awaited. Simplifica-
tions in income tax law
within the next six
months could improve
revenue collection and
streamline processes,
boosting govt revenue.

and a truck in Vaishali
district of Bihar on Mon-
day, the police officials

of the Quad countries
called for upholding the
free and open rules-based
international order and
respecting the principle
of freedom, human rights,

na, the four foreign min-
isters expressed serious
concern over the situation
in the East and South Chi-
na Seas and reiterated the
Quad’s strong opposition
to any “unilateral actions

and prosperity while

4 weeks and gave a fur-
ther 2 weeks to the peti-
tioner to file a rejoinder in
the PIL against Ultratech
Cement, which was filed
byAdvocate Sunil Kumar
Singh. The matter was
heard by Chief Justice
MM Shrivastava and Jus-
tice Madan Gopal Vyas.

gued that the Ultratech
Cement Plant of Aditya
Birla Group, Shambhu-

torgarh, in connivance
with the Minister of
Mines and Principal Sec-
retary, Ministry of Mines
 Geology Department,
Government of Ra-
jasthan, and Director, De-
partment of Mines  Ge-
ology, Udaipur, was caus-
ing a huge financial loss
to the Government of
Rajasthan.

many limestone mines in
village Mandi ka Ama-
rana, and with the help of
this limestone, the ce-
ment is manufactured in
the aforesaid Ultratech
Cement Plant.The move-
ment of limestone from
the mining area to the
plant is done through the
conveyor belt.
The Government col-
lects tax on limestone
transported to the Ultrat-
ech Cement Plant through
trucks using receipts
called “Ravanna Parchi.”
However, at the Ultratech
Cement Plant, the lime-
stone is transported di-
rectly from company-
owned mines to the plant,
making “Ravanna
Parchi” inapplicable. In-
stead, the tax is collected
based on readings from a
weightometer on the con-
veyor belt. This device
records the weight of
limestone moved from
the mines to the plant
within 24 hours, and the
Government of Rajasthan
uses these readings to cal-
culate the tax revenue.
It is a matter of concern
that the aforesaid weight-
ometerhasnotbeenwork-
ingforalongtime,andthe
Ultratech Cement Plant is
paying less tax on the
weight of the cement. The
weightandquantumofthe
tax are not being checked
by any Government offi-
cial, and in this way, the
Ultratech Cement Plant,
Chittorgarh is causing
nearly Rs 500 crore loss to
the Government of Ra-
jasthan in a year.
The aforesaid bun-
gling is being done with
the connivance of the of-
ficials of the mining de-
partment, and it is a mat-
ter of great concern and
inquiry. It is also argued
that it is surprising that
the Mining Department
collects crores of rupees
in royalty but cannot pro-
vide information about
the weightometer read-
ings or the officers re-
sponsible for taking these
readings.
This suggests possible
collusion within the de-
partment, leading to a
significant loss to the
state exchequer, amount-
ing to hundreds of crores.
The matter will be listed
again after six weeks.

JAIPUR ON AUG 1  2; TO MEET CM ALSO
The 16th Finance Commission will meet in
Jaipur on August 1 and 2 for crucial discus-
sions with CM Bhajan Lal Sharma. Most
members of the Commission are expected to arrive
in Jaipur by tomorrow. Commission Chairman Arvind
Panagariya and other members are also anticipated
to attend. In the meanwhile, Pushpa Devi Gupta,

first session, moderated by
Prem Garg, Senior Vice Presi-
dent of the Bhilwara Textile
Trade Federation, panelists
Pallavi Laddha, Chitwan Vyas,
Ankit Sharma, and Sunil Jag-
etia explored business-related
challenges. Discussions cov-
ered GST impacts, discrepan-
cies in RIICO and DIC work-
ing patterns, export issues, and
the potential of establishing a
Textile Park.
The second session, also
moderated by Garg, shifted fo-
cus to infrastructure concerns.
Panelists Sanjay Pediwal, Anil
Rathi, Mahesh Hurkat, and
Manish Chandak highlighted
critical issues such as power
and energy shortages, water
scarcity, and land availability
for industrial expansion. For-
mer Revenue Minister Ram
Lal Jat emphasized Bhilwara’s
pivotal role in the state’s econ-
omy, stating, “Bhilwara is a
vital player with industrialists
who are deeply committed to
advancing Rajasthan. Their re-
lentless efforts contribute sig-
nificantly to our economic
growth.”
Bhilwara SP Rajan Dushy-
ant added, “Bhilwara has sig-
nificantly expanded its produc-
tion capabilities. We anticipate
that all processes from yarn
production to final products
will be handled here and dis-
tributed nationwide, though we
are also experiencing notable
labour migration.” Bhilwara
MLA Ashoka Kothari noted,
“Despite facing numerous
challenges, the Bhilwara tex-
tile industry continues to
evolve and remain profitable.”
Rakesh Pathak, Chairman of
Bhilwara Nagar Parishad, con-
cluded, “The industry has the
potential to thrive with mini-
mal government interference
and robust governance, with a
particular focus on denim and
ready-made garments.” The
symposium highlighted the
textile sector’s resilience and
the collaborative efforts re-
quired to address ongoing chal-
lenges.

According to the police, the incident took place on Sunday in Kerap village when the victims -- Bhupesh, Shivraj, Vishal and Sahil -- had gone to play near the pond. When the children, aged between 12 to 15 years, did not return till late, their parents started a search for them and spotted their slippers near the pond, they said. Suspecting that the boysmighthavedrowned in the pond, some of the parents jumped into the pond and took out two bodies at around 9 pm on Sunday, the police said. The other two bodies were taken out by a team of SDRF from Nagaur and local divers at around 2 am, they said. When she did not re- turn, the family members started looking for her and came to know about the incident.     A FLIGHT OFDEVELOPMENT Jpr airport acquires land after 14 yrs Dinesh Kasana Jaipur fter over two decades, the Jaipur Airport Administration has fi- nally got the possession of approximately 10.96 acres of land that was ac- quired for Jaipur Airport back in 2010. Two days ago, the Air- port Authority wrote a letter to the District Col- lector Prakash Rajpuro- hit regarding this matter. Today, in the presence of the District Adminis- tration officials, the Air- port Administration was handed over the posses- sion of the land. Under the supervision of Tehsil- dar Sanganer Arvind Kaviya, the encroach- ments were removed from Manoharpura vil- lage, Ram Singh Nagar, near Terminal 1 in the presence of police force. Upon the removal of en- croachments, the Airport Administration promptly took possession of land. Authorities cleared the encroachments near airport as per the expansion plan. Police personnel had to be called on spot to curb the displeasure among locals. Bairwa expressed his inability to resonate with the BJP’s ideol- ogy and confirmed sending a letter to the newly appointed BJP state chief Madan Rathore. “I left BJP today, but did not take a decision regarding joining the Congress. I had to quit Congress because of conspiracies against me. I tried to work for BJP but the ideology did not align,” he said. “As of today, I am neither in BJPnor in Congress,” he said. New fixed charges for electricity in Rajasthan BPL, small consumers affected First India Bureau Jaipur Rajasthan Electricity Regulatory Commission has revised electricity tariff for the year 2024-25 on petition by electricity companies. The Commission has not increased the energy charges in any category except BPL-small con- sumers but the previously decided fixed charge has been increased by more than 10 %. At the same time, 21 paise per unit “extra” will have to be paid for green energy. Fixed charge of BPL, Asha cardholder consum- ers has been increased from Rs 100 to Rs 150.At the same time, the fixed charge of small consum- ers consuming up to 50 units has also been in- creased from Rs 125 to Rs 150. The fixed charge has been increased from Rs 230 to Rs 250 on con- sumption of up to 150 units, from Rs 275 to Rs 300 on consumption of up to 300 units, from Rs 345 to Rs 400 on consump- tion of up to 500 units, from Rs 400 to Rs 450 on consumption of more than 500 units. Aspecial investigation committee can be formed under the leadership of district collector and JDA and corporation officials will be included in the committee. It is believed that action can be taken against coaching centres not meeting the standards or those who operate classes in the basement without fire fighting equipment. Furthermore, action can be taken against coaching centres running without parking, creating traffic chaos and in residential areas. Saraf questions inaction on Ramgarh Dam encroachment First India Bureau Jaipur Raising the issue of Ramgarh dam en- croachment in the as- sembly, MLA Kali- charan Saraf ques- tioned the formation of the committee and not taking action on the 10 identified lo- cations. In his reply, Water Resources Minister Suresh Rawat said that en- croachments will be marked and removed soon. “Besides, the officer concerned will be suspended for presenting wrong facts in the assembly.     ithin the next fortnight, subjectto a virtual “roll- call of Dem- ocratic Party delegates”, vice president Kamala Harris will be confirmed as the presumptive Democrat candidate for the US presi- dency and will engage in a full-on battle for the White House with the Republican candidate, Donald Trump. Harris will be crashing through many glass ceil- ings if she makes it to 1600 Pennsylvania Avenue North West – or, as it is better known, the White House. She would be the first woman president, and also a woman of colour with both Indian and Ja- maican heritage. But she would also be the first Democrat to win an elec- tion from a political pow- erbase in California. In the exceptional re- public that is the US of A, California is truly excep- tional – and that grates with much of the rest of the country. It, and the people who hail from it, are too big, too rich, too inventive, too liberal – and altogether just too much, if you are from anywhere else, that is. If California was a na- tion, it would have the world’s fifth largest econ- omy. It contributes around 15% of US GDP, way out of proportion to other states, and is home to tech giants including Apple, Meta and Google, along- side major corporations such as Visa, Chevron and Wells Fargo. And just down from Silicon Valley you’ll find the Hollywood Hills, home to the myth and mystery of the movie business. Hol- lywood has given us such California politicians as former governor Arnold Schwarzenegger, Clint Eastwood – mayor of Car- mel-by-the-Sea – and a one Ronald Wilson Rea- gan, who made the politi- cal journey from Democrat to conservative Republi- can. But more on him later. For the US heartland, California feels like a sep- arate country. Somehow, being far west has turned it – and particularly its Dem- ocrat politicians – far left in the minds of those Mid- westerners, and there is almost no history of sig- nificant runs for the presi- dency for politicians who’ve cut their teeth in its capital, Sacramento. Barring Harris’own halt- ing run in 2020, you have to look back to 1992 for the last serious Californian tilt at the presidency. This was when the then governor, Jerry Brown, made his final run, offering a serious chal- lenge to Bill Clinton before choosing Rev Jesse Jack- son as his vice-presidential pick, something that a small-c conservative coun- try was just not ready for. And before Brown? Pretty much zilch. So where should Harris look to for inspiration and does the stereotype of Cal- ifornia failures actually hold weight? She can look to Diane Feinstein and Barbara Boxer, who smashed the California glass ceiling when they were elected in 1992 as the state’s first women sena- tors. The liberal Boxer was actually succeeded in the Senate by Kamala Harris, who then served alongside Feinstein in Congress. Feinstein, who died last year, made her name as mayor of San Francisco and served in the Senate for more than 30 years. Her decline – and refusal to retire – has more than a few echoes, not with Har- ris, but with Joe Biden. And if Harris needs further inspiration of a successful woman in Washington, she need look no further than Nancy Pelosi as the first female speaker of the House and, until her retire- ment from the speakership, one of the key leaders in legislative government. Across the aisle The reality is, of course that California has pro- duced a raft of successful politicians at the highest level – but to date, they have been men, and they have been Republican. Midwesterners don’t actu- ally mind Californians – as long as they’re conserva- tive Californians. While John Fremont came close in 1856, just six years after California entered the Union, the first Republican president from the state was Herbert Hoo- ver in 1928. He swept the country other than the Dix- ie South and New York, campaigning to maintain US prosperity. The Wall Street crash and the Depression put paid to a Hoover second term and while the Repub- licans won the presidency back under Eisenhower in 1952, the most prominent Californian appointment of the 1950s was Earl War- ren as chief justice of the US Supreme Court. He presided over a reforming Court, most especially around civil rights. Next up to bat for the presidency was former vice-president Richard Nixon, who benefited from the chaos among the Dem- ocrats in 1968 following LBJ’s decision not to run, to beat the incumbent Democratic vice-president Hubert Humphrey – surely a lesson for Harris. For a generation it defi- nitely was “Morning again in America”, as his campaign slogan ran. If Harris can capture that same sense of hope, of empathy and of positiv- ity, she may regain the ground lost by Joe Biden to his challenger. Perhaps she can break the Demo- crats’ Californian curse. And in the end, is Califor- nia really too different? Is it any more “exceptional” than, for instance, New York – the birth place and long-time home to one Donald J Trump? But she would also be the first Democrat to win an election from a political powerbase in California IN-DEPTH SC CONFIRMS BAIL TO SOREN IN RARE SETBACK FOR ED CJI EMPHASISES ON BAIL AS A RULE he Supreme Court’s refusal to interfere in Jharkhand High Court’s order granting bail to former Chief Minister Hemant Soren in a money laundering and land scam case must be counted as a rare setback to the Enforcement Direc- torate. The arrest took place before the Lok Sabha elections and was expected to boost the BJP’s chances of victory in the state. Instead, it became a rallying point and the party ended up losing all seats in the tribal belt. The high court allowed bail as it did not find any direct involvement of Soren in the case. The Supreme Court found the order “well reasoned”. Soren’s case being different from that of Aam Aadmi Party leaders languishing in jail for the liquor policy scam and therefore they continue to be denied bail. With the ED filing a charge-sheet against Arvind Kejriwal he is unlikely to come out of the jail any time soon. His deputy Manish Sisodia faces the same fate. T hief Justice of India DY Chandrachud’s re- cent remarks on trial courts’ reluctance to grant bail not only in significant or serious crimes but also simple cases highlight a critical issue in the judicial system. The Supreme Court has con- sistently emphasised that bail should be the norm and jail the exception. However, this principle is frequently overlooked by lower courts, resulting in a high volume of bail pleas reaching the apex court. The CJI’s concern is rooted in the belief that rou- tine denial of bail by trial courts and high courts not only infringes on individual rights but also places an undue burden on the Supreme Court. When lower courts “play it safe” by de- nying bail, they con- tribute to the back- log of cases pending before the highest court. The judicial reluc- tance to grant bail is often driven by the fear of public back- lash or the percep- tion of being lenient towards serious of- fenders. However, this cautious ap- proach undermines the foundational legal principle that every individual is presumed innocent until proven guilty. Denying bail without sufficient cause can lead to prolonged and unjustified incarceration, eroding public trust in the judicial process. To address this issue, there needs to be a con- certed effort to reinforce the guidelines established by the Supreme Court regarding bail. Training and sensitizing judicial officers about the importance of upholding these principles is essential. Moreover, there should be a mechanism to review and rectify instances where bail is unjustly denied. Upholding the right to bail is crucial not just for individual liberty but for the overall efficiency and credibility of the judicial system. The govt is pre- paring to accept the black money caught in income tax raids and survey ac- tion with changes in the income tax law and close these cases after paying a lump sum income tax on it. A proposal has been giveninthisregard,which will be effective from 1st September. It is believed that the govt’s intention behind this exercise is to reduce the number of casesbetweenthetaxpay- ers and the department along with raising maxi- mum revenue, increasing complianceofincometax rules and also giving an opportunitytothetaxpay- ers who evade income tax to correct their mistake. The current process of settlement of income tax raids and surveys is not only very long and pain- ful, but the department also has to wait for years to recover the revenue. There has always been a disputebetweentheoffic- ers taking action and the taxpayers regarding the so-called black money caught or calculated. For this dispute, taxpayers have generally been pleading for justice from income tax appeal to ap- pellate tribunal, high courtandSupremeCourt, which takes years to be resolved. The current sit- uation is also that even if taxpayers get relief at any level,notonlythetaxpay- ers but even their tax ad- visors have to work hard to get it, whereas on the contrary, if any liability arises on the taxpayer, then the officers, barring exceptions, do not delay even a day for recovery, whethertherecoverypro- cess is legally correct or not. In such a situation, the option of paying 60% income tax on the black money caught in income tax raids and surveys can also encourage taxpayers to pay the correct income tax and a significant de- crease in litigation can also be expected from this.Thespecialthingthat is being told is that if the taxpayer is ready to pay incometaxonanyamount other than the black in- come mentioned by the department, then he will have to pay income tax at the rate of only 50%. Chief Income Tax Ad- visor CA O.P. Agarwal says that the Union Budg- et indicates plans to sim- plify the Income Tax Act and reduce disputes be- tween taxpayers and the department. The govern- ment aims to amend the Act to resolve long-pend- ing cases promptly.Addi- tionally,thereintroduction of the Vivaad se Vishwas scheme aims to settle pending cases with the In- come Tax Department. The decision to close cas- eswitha60%taxpayment on black money caught in tax raids is a positive step, though further clarifica- tion is needed. Income tax consultant and former general sec- retary of the Federation of Rajasthan Trade and Industries, CA Vijay Goyal, supports this move towards simplify- ing income tax laws and reducing disputes. If the department accepts black money discovered in raids and allows set- tlement with a 60% tax payment, cases that usu- ally drag on for years could be resolved swift- ly. This would expedite departmental work and reduce taxpayer harass- ment. The Vivaad se Vishwas scheme appears beneficial, but its details are awaited. Simplifica- tions in income tax law within the next six months could improve revenue collection and streamline processes, boosting govt revenue. M/s Aditya Cement Works owns 760.692 hectares of land and has many limestone mines in village Mandi ka Ama- rana, and with the help of this limestone, the ce- ment is manufactured in the aforesaid Ultratech Cement Plant.The move- ment of limestone from the mining area to the plant is done through the conveyor belt. The Government col- lects tax on limestone transported to the Ultrat- ech Cement Plant through trucks using receipts called “Ravanna Parchi.” However, at the Ultratech Cement Plant, the lime- stone is transported di- rectly from company- owned mines to the plant, making “Ravanna Parchi” inapplicable. In- stead, the tax is collected based on readings from a weightometer on the con- veyor belt. This device records the weight of limestone moved from the mines to the plant within 24 hours, and the Government of Rajasthan uses these readings to cal- culate the tax revenue. It is a matter of concern that the aforesaid weight- ometerhasnotbeenwork- ingforalongtime,andthe Ultratech Cement Plant is paying less tax on the weight of the cement. The weightandquantumofthe tax are not being checked by any Government offi- cial, and in this way, the Ultratech Cement Plant, Chittorgarh is causing nearly Rs 500 crore loss to the Government of Ra- jasthan in a year. The aforesaid bun- gling is being done with the connivance of the of- ficials of the mining de- partment, and it is a mat- ter of great concern and inquiry. It is also argued that it is surprising that the Mining Department collects crores of rupees in royalty but cannot pro- vide information about the weightometer read- ings or the officers re- sponsible for taking these readings. This suggests possible collusion within the de- partment, leading to a significant loss to the state exchequer, amount- ing to hundreds of crores. The matter will be listed again after six weeks. He took charge of this large and impor- tant institution in July 2024 and played a suc- cessful inning for ex- actly three years. The importance of Rajeshwar Singh's three-year-long innings increases with the background that in the last two decades, there have been 18 Chairman on the Board, but the tenure of even one of them was not even close to that of Singh's. Chairman Mukesh Sharma, who served in the year 2018-20, is in the second position with the longest tenure. But his tenure was also only 19 months com- pared to 3 years. In such a situation, leaving the glory of state bureaucracy in Jaipur and staying in Ajmer for three years gives credit to Rajesh- war Singh. Guidelines were given to Revenue Costs by issuing regular circulars by the Chairman. z A total of 4 lakh cases were disposed of in Revenue Courts from top to bottom in three years. z By implementing the e-filing system completely and effec- tively, till now 30,000 files have been made online.
