THE CHARTER CHALLENGES ARE NOT SIMPLY A SPIRIT SINCE ITS A MARATHON
When we realize the Charter right can be won because our right is one then we can make headway,
Rosemary DeCaires said in serving the Canadian Civil Liberties Association with notice of the TRILLIUM 2009
Report.
DeCaires, class of 1999, 2002, has built her reputation by arguing issues of human rights, culture, ethnicity and
race, and public interest. She has run for president of student counsel while in high school and student
political life at University. In due course, she had represented a diverse array of individuals and organizations
who are benefactors of her intelligence, passion and compassion.
I was attracted by advancing the interests of the weakest link rather than the interests of the strongest link. But
later on in University I learned quite the opposite such that might was right and it was then that I reconsidered
this dogma. 'There is a sense of real satisfaction in pursuing cases for those whose voice is often not heard.'
It was her longtime dream to become counsel in the truest sense of the word. DeCaires now argues in both
the superior and higher courts of justice in the right of Ontario. She articled mental health in the administrative
law and constitutional legal contexts.
DeCaires, whose internships across the Ontario Government exceed a decade of commitment to excellence,
is now recognized by a few great associations across Canada, including: The Canadian Civil Liberties
Association, Canadian Mental Health Association, Ontario Trillium Foundation and Gift of Life Foundation.
Individually speaking, she acts for victims of violence against women, and mostly victims targeted by local
police authorities. DeCaires acts in complex disputes alternating between the themes of society vs individual
and vice versa. Her practice is specifically focused on hospitals and universities and in some cases police
authorities.
Rosemary, has also had much work at the inquiry level. She acts for persons incarcerated in mental health
facilities whose sentences were lessened or ultimately transferred within systems. She seeks to represent the
families of victims of violence against women, and seeks to foster an open dialogue to communicate about
public policy issues at the forum level.
2. DeCaires' name is perhaps most recognizable for her work along side the Law Union, and associations across
the local OPS, such as the Ontario Trillium Foundation and Gift Of Life Foundation and most of all the
Canadian Mental Health Association and Canadian Civil Liberties Association.
In the past few years, there was an application for Judicial Review that was launched after a Canadian
University denied her access to accommodation based on some Charter challenge claims. The court's
decision is based on the dogma of duty to accommodate and breach of fiduciary duty in academic life.
The underlying purpose of the Judicial review is to study torts in academic life specific to the betterment of
public policy in education and post secondary institutions in Ontario. As a result of the court's decision, in
future, the tort can be relied upon in the academic misconduct setting
The case involving YORK University defines the rights of an individual to question constitutional law and settle
on a remedy within administrative law. Among the few great accomplishments that this case load unfolds
includes: a major constitutional law charter challenge claim involving disability and human rights law.
In due course over a period of ten years, she has written several academic publications for a few great think
tanks in Ontario. She was a public policy intern for the C.D. Howe Institute and Fraser Institute during
undergraduate study. She later on participated in a number of research opportunity programs including
courses taken at the law school for credit through an advanced seminar held at the University of Toronto Law
School.
In the more recent years, Rosemary has received noteworthy honourable mention by associations across
Canada as well as local government offices in the right of Ontario. She credits her success to having taken an
abundance of research intensive courses at the post secondary level with promotion across various
interdisciplinary fields at the University of Toronto.
In future, she intends to resume her meaningful post-graduate study career in law. She hopes to practice
consent and capacity law that is mostly administrative law and in a few great cases presents constitutional
challenges to law and public policy legislation.
