3. Vehicle Code 23152(a) makes it unlawful for any driver to
operate a motor vehicle while either under the influence of
alcohol.
Vehicle Code 23152(b) makes it a crime to drive with a
blood alcohol concentration (BAC) level of 0.08% or higher.
