4. I. PURPOSE, THE TASK OF OS IN BRANCH.
CONNECTION WITH OTHER DISCIPLINES
Occupational safety in branch –
normative discipline that is being studied in
higher education institutions for the purpose of
formation of knowledge about the state and
problems of OS in the relevant fields for future
specialists, components and functioning of the
OS management system, ways, methods and
means of ensuring normative conditions of the
production environment and labor safety in
various technological processes, in accordance
with the current normative legal acts on labor
legislation and labor protection.
5. I. PURPOSE, THE TASK OF OS IN BRANCH.
CONNECTION WITH OTHER DISCIPLINES
Occupational safety in the medical
sector – is mandatory normative discipline
for all institutions of higher and secondary
medical education, which defines and
justifies the system of legal, socio-economic,
organizational-technical, sanitary-hygienic,
therapeutic-prophylactic measures aimed at
saving health and the working capacity of
doctors of different specialties and profiles.

Educational discipline "Occupational
safety in branch" is an applied discipline
that is associated with special disciplines:
- «Basics of labor protection»;

- «Hygiene»;
- «Psychology»;
- «Ergonomics;
- «Technical aesthetics».
Basic components of discipline - legal
framework of OS in branch, hygiene of
labor and safety equipment.
7. I. PURPOSE, THE TASK OF OS IN
BRANCH. CONNECTION WITH
OTHER DISCIPLINES
PURPOSE of discipline - in-depth study of
legal issues of OS, assimilation of a complex
of administrative, engineering-technical,
sanitary-hygienic and medical measures,
aimed at prophylactics of occupational
injuries, occurrence of professional
poisonings, diseases and other adverse
changes in health as a result of exposure to
harmful factors in the production
environment in the field of health care.

CONNECTION WITH OTHER DISCIPLINES
Tasks of discipline – acquiring the
necessary knowledge and skills in
preventing the effects of negative influence
of harmful production factors in basic
medical specialties, investigation of cases
of violations of safety rules and labor
protection, elaboration of preventive
recommendations, etc.
9. ІІ. BASIC TERMS AND DEFINITIONS
Unfavorable factors are divided into
harmful and dangerous.
Harmful – factors whose influence may
lead to the disease, reduction of working
capacity and (or) negative influence on
health of descendants.
Dangerous – factors whose impact leads
to injuries, poisonings, a sudden
deterioration in health or death under
certain conditions.

The effect of adverse productive factors
leads to the occurrence:
1. Occupational injury (violation of the
anatomical integrity of the human body or
its functions);
2. Accident (sudden deterioration in health
or death of the employee during the
performance of labor duties due to the short-
term effects of dangerous or harmful factors);

3. Occupational disease (a pathological
condition of a person which is caused by
excessive tension of an organism or the
effect of a harmful productive factor
during work activity);
4. Professional poisoning (acute or
chronic intoxication caused by the
influence of the harmful chemical factor in
production conditions).

The Constitution of Ukraine guarantees:
1. «Citizens of Ukraine have the right to
work which they freely choose or agree
on»;
2. «Everyone has the right to appropriate
safe and healthy working conditions, the
right to wages and rest».

16. ІV. LAW OF UKRAINE "ON LABOR
PROTECTION“
Low of Ukraine «On labor protection» from
01.01.1992 ye. establishes the principles of state
policy in the field of OS, guarantees of the right
to labor protection, regulates the structure of the
organization of the labor protection system,
describes the rights and obligations of employers
and employees, establishes responsibility for the
absence of appropriate working conditions and
providing industrial safety and compliance with
the requirements of occupational safety at the
design stage, construction and reconstruction of
enterprises, objects and means of production.
17. ІV. LAW OF UKRAINE "ON LABOR
PROTECTION“
The law applies to all legal entities and
individuals who using hired labor and to all
employees.
Article 4 defines the basic principles of state
policy on labor protection:
- the priority of the lives and health of workers;
- raising the level of industrial safety;
- social protection of workers, full damages to
persons who have suffered from work-related
accidents and occupational diseases;

- adaptation of labor processes to the employee's
capabilities, taking into account his health and
psychological state;
- informing the population, conducting training,
professional training and professional
development of workers on labor protection
issues;
- use of world experience in improving conditions
and improving labor safety on the basis of
international cooperation.
19. ІV. LAW OF UKRAINE "ON LABOR
PROTECTION“
Low of Ukraine «On labor protection»
determines socio-economic, organizational-
technical, sanitary-hygienic, therapeutic-
prophylactic measures to occupational safety.
Socio-economic measures provide for the
following economic management methods for
occupational safety:
- obligatory social insurance of employees from
accidents (art. 5);
- saving of earnings in the period of idle time, if
the production situation is dangerous for the life
or health of the worker and others (art. 6);

- the payment of an allowance at the
discontinuance of the contract at will, if the
employer does not comply with the requirements
of the law or the conditions of a collective
agreement on labor protection (art. 6);
- free provision of medical-prophylactic food and
other benefits and compensations for workers who
are engaged in work with difficult and harmful
conditions (art. 7);
- free delivery of special clothing, special
footwear and other means of personal protection
in work with both harmful and dangerous
conditions (art. 8);
21. ІV. LAW OF UKRAINE "ON LABOR
PROTECTION“
- compensation by the owner of damage due to
injury and other damage to the health of the
worker (his family in case of death) connected
with performance of labor duties, as well as
moral damage (art. 9).
In order to comply with the requirements of
the law and ensuring comprehensive
management of labor protection at the state level
the National council on issues of safe life of the
population was formed under the Cabinet of
Ministers of Ukraine and State Committee of
Ukraine for Industrial Safety.
22. V. INTERNATIONAL TREATIES AND
AGREEMENTS IN UKRAINE
Law of Ukraine “On labor protection“ provides: if an
international treaty establishes norms other than those
provided for by the legislation of Ukraine on labor
protection, then the rules of an international treaty will
be applied.
International treaties and agreements on labor
protection in which Ukraine participates:
1. Conventions, Recommendations and other
documents of the International Labor Organization;
2. European Union directives;
3. Treaties and agreements signed within the
framework of the Commonwealth of Independent
States;
4. Bilateral treaties and agreements.
23. V. INTERNATIONAL TREATIES AND
AGREEMENTS IN UKRAINE
The basis of international treaties regulating labor
relations are conventions of the International Labor
Organization (ILO) which consist of International
Labor Conference, Administrative Board and
International Labor Office. ILO includes 173 states.
International Labor Conference – the highest body of
the ILO – the conference is held in June each year with
the participation of all representatives of member
countries.
International Labor Office – elaborates Codes of
practical measures, carries out monitoring of financial
affairs, draws up an agenda for International Labor
Conferences.
24. V. INTERNATIONAL TREATIES AND
AGREEMENTS IN
The Administrative Council includes 28
government representatives, 14 representatives of
employers and 14 representatives of workers. It
controls the activities of the International Labor
Office.
In ILO all decisions are made on the principle of
tripartism, that is equal representation of the
three parties – government, employers and
workers.
The main forms of ILO activity – elaboration of
standards, studying, collecting and distributing
information, technical assistance.
25. INTERNATIONAL COOPERATION IN THE
FIELD OF OCCUPATIONAL SAFETY
Ukraine is not a member of the European Union
(EU), but it has repeatedly stated its desire to
join the EU. One of the conditions for the
adoption of new countries in the EU is the
compliance of their legislation with the EU
legislation. Therefore, in our country there is an
active work on harmonizing the requirements of
laws and regulations with the EU directives.
Each State member of the ILO is required to
submit reports on the application of its ratified
conventions in its territory, as well as
information on the state of health and safety
legislation and practice.
26. VІ. STRUCTURE OF OS MANAGEMENT IN
THE MEDICAL SECTOR
According to Article 37 of the Law of Ukraine
“On Labor Protection” the state management of
labor protection in Ukraine carry out:
- Cabinet of Ministers of Ukraine;
- State Committee of Ukraine for Supervision of
Labor Protection;
- ministries and other central bodies of state
executive power;
- local state administration, local councils of
people's deputies.
28. CONCLUSIONS
The adoption of the Law “On Labor
Protection” has given this direction the status of
national policy, has become a powerful impetus
for reforming the system of public administration
of labor protection.
Labor protection, safety equipment and
improvement of working conditions, reduction of
occupational disease are obligatory components
of social and economic development of society.
Creating a safe and supportive environment
for employees should be an indispensable
condition for increasing the work capacity and
productivity of a person, extending his labor
longevity.
