National OHS Profile Objective
• Provide a baseline profile on the occupational safety and health
situation of Nepal as of 2020 to monitor progress and development;
• Identify gaps in OSH practices and recommend possible national
action to strengthen national OSH systems.
• Develop national strategic action plan in OSH (National OSH
Programme) based on the recommendations;
• Provide policy-makers, government officials, workers, employers,
OSH practitioners and the public with the most up-to-date
information and overview on the occupational safety and health
development of Nepal;
• Help prepare for the ratification of ILO Promotional Framework for
OSH Convention (No 187, 2006) and Safety and Health Convention
(No 155, 1981).

Constitutional and Legal Arrangements
Constitutional Provisions
Part 3 (Clause 16) on Fundamental rights of the constitution ensures
that everyone enjoys the right to live with dignity  workers have
rights live with dignity at their workplaces.
Clause 17 of the constitution addresses the right to freedom and sub-
clause 17 (d & f) informs that every citizen has the freedom to form
unions and associations, and freedom to practice any profession, carry
on any occupation and establish and operate any industry, trade, and
business in any part of Nepal.
Clause 34 explicitly speaks on the right to labour and identifies that
every labourer shall have the right to practice appropriate labour
• Labour Act 2017: Chapter 12 from clause 68 to clause 83 is related to
OSH
• 15th Strategic development Plan (2019/2020-2023/2024): for setting
up and implementation of occupational safety and health standards
in enterprises to provide dignified employment opportunities to the
workers in the country
• Labour Rule 2018: Chapter 7 encourages for development of an
Occupational Safety and Health Policy for each workplace with the
inclusion of a safety preparedness plan, worker’s health, machine
operation, use of hazardous substances, etc
• OHS standards: Noise and Light published in Nepal Gazette dated
July 9, 2017

Policy
 The Labour act 2017 encompasses OSH legal
provisions (Section 12) mostly related to
manufacturing industries and only a few
special provisions exist for the construction
sector. The Act does not speak on the
agriculture-based industries except for few
directives on the specialized tea plantation
sector.
 The existing labour act does not cover all the
aspects of OSH. For example, the design of
the workplace according to the nature of work
• Lack of Province-level OSH
legislations.
• The existing OSH standards do not
include all major OSH aspects.
Ratification of ILO conventions (155,
187) and approval of
recommendations on Occupational
Health Services Convention (161,
171).
• The Labour Act does not mandatory
require the assessment and reviews
of any project in terms of labour and
working conditions including OSH

• The categorization of most health-hazardous industries is missing.
• Lack of a list of occupational diseases and conditions

• The LEO face several constraints resulting
in weaker inspection systems. The offices
utilize most of their time for the
settlement of labor disputes, child
labour, trade labour registration, foreign
employment, etc.
• Weaker enforcement of existing legal
mechanisms related to OSH. No legal
obligation for the development of OSH
Management system.
• Weak inspection and enforcement
mechanism.
• The workers are primarily engaged
on collective bargaining on issues
relating to remuneration
overshadowing OSH issues.
• All of the enterprises do not have
OSH Committee nor OSH Policy are
formulated attributing to the lack of
enforcement and low level of
awareness.
Priority Areas
Administrative
• Designation of multiple roles at the National
Authority body. For example, the department
of labour and Occupational Safety looks after
the labour relations, work permits for foreign
nationals, trade union registration while similar
responsibilities are mandated to the LEOs.
• The existing national level tripartite Central
Labour Advisory Council has not been able to
prioritize and address OSH issues.
• Lack of robust data on occupational diseases,
injury, and accidents due to poor recording/
reporting systems and mechanisms.
• The OSH focal position is
mostly vacant at the MoLESS.
• Lack of or no allocation of
budget for the OSH activities in
the major ministries.
• A lack of coordinated effort of
the related ministries and
concerned stakeholders. Poor
coordination mechanism at all
levels
• OSH seems to be a low-priority
sector for the Government of

• Implementation of the National Policy on OSH by central
and provincial governments.
• Develop comprehensive framework of OSH laws covering
workers in all sectors of the economy.
• Develop and implement National OSH Programme in line
with ILO Promotional Framework for OSH Convention (No
187) at all levels.
• Categorize and develop sectoral guideline on OSH & OSH
standards related to the most health hazardous industries.
Priority Actions (2/4)
• Develop supervision and monitoring mechanisms at LEOs
and capacity strengthening of the staff.
• Implement national forums on OSH that include
government, employers, and worker representatives to
develop national safety and health policies and legislation.
• Strengthen occupational injury and disease reporting
systems
• Implement worker's compensation as an integral part of a
safety and health program.
Priority Actions (3/4)
• Identify a broad range of OSH training needs through an analysis of
current OSH capacity.
• Establish autonomous public OSH institutions and encouraging OSH
courses at universities, academic institutions, and industry-specific
training centers.
• Ratification of ILO Convention No. 155.
• Adequate resource allocation for human resource including budgetary
provisions for effective functioning of OSH planning and enforcements at
all levels.
• Establish financial incentives (tax) for employers supporting safe working
conditions and penalties for defaulters.
Priority Actions (4/4)
• Establish and maintain Occupational incidents, injuries and
disease data management center at central and province level.
• Encourage and oblige employers to formulate Enterprise level
OSH Policy and establish safety committee.
• Apex ministry needs to play active role for effective
coordination with other ministries and agencies in the area of
OSH (including integrated OSH policies and plans ).

Constitutional and Legal Arrangements Constitutional Provisions Part 3 (Clause 16) on Fundamental rights of the constitution ensures that everyone enjoys the right to live with dignity  workers have rights live with dignity at their workplaces. Clause 17 of the constitution addresses the right to freedom and sub- clause 17 (d & f) informs that every citizen has the freedom to form unions and associations, and freedom to practice any profession, carry on any occupation and establish and operate any industry, trade, and business in any part of Nepal. Clause 34 explicitly speaks on the right to labour and identifies that every labourer shall have the right to practice appropriate labour
  • 9. • Labour Act 2017: Chapter 12 from clause 68 to clause 83 is related to OSH • 15th Strategic development Plan (2019/2020-2023/2024): for setting up and implementation of occupational safety and health standards in enterprises to provide dignified employment opportunities to the workers in the country • Labour Rule 2018: Chapter 7 encourages for development of an Occupational Safety and Health Policy for each workplace with the inclusion of a safety preparedness plan, worker’s health, machine operation, use of hazardous substances, etc • OHS standards: Noise and Light published in Nepal Gazette dated July 9, 2017

Priority Areas Policy  The Labour act 2017 encompasses OSH legal provisions (Section 12) mostly related to manufacturing industries and only a few special provisions exist for the construction sector. The Act does not speak on the agriculture-based industries except for few directives on the specialized tea plantation sector.  The existing labour act does not cover all the aspects of OSH. For example, the design of the workplace according to the nature of work • Lack of Province-level OSH legislations. • The existing OSH standards do not include all major OSH aspects. Ratification of ILO conventions (155, 187) and approval of recommendations on Occupational Health Services Convention (161, 171). • The Labour Act does not mandatory require the assessment and reviews of any project in terms of labour and working conditions including OSH
  • 16. Policy Contd… • The categorization of most health-hazardous industries is missing. • Lack of a list of occupational diseases and conditions • The Labour Act does not require development projects to prepare a Labor Management Plans/ Procedure or OSH Plan
  • 17. Priority Areas Implementation • The LEO face several constraints resulting in weaker inspection systems. The offices utilize most of their time for the settlement of labor disputes, child labour, trade labour registration, foreign employment, etc. • Weaker enforcement of existing legal mechanisms related to OSH. No legal obligation for the development of OSH Management system. • Weak inspection and enforcement mechanism. • The workers are primarily engaged on collective bargaining on issues relating to remuneration overshadowing OSH issues. • All of the enterprises do not have OSH Committee nor OSH Policy are formulated attributing to the lack of enforcement and low level of awareness.
  • 18. Priority Areas Administrative • Designation of multiple roles at the National Authority body. For example, the department of labour and Occupational Safety looks after the labour relations, work permits for foreign nationals, trade union registration while similar responsibilities are mandated to the LEOs. • The existing national level tripartite Central Labour Advisory Council has not been able to prioritize and address OSH issues. • Lack of robust data on occupational diseases, injury, and accidents due to poor recording/ reporting systems and mechanisms. • The OSH focal position is mostly vacant at the MoLESS. • Lack of or no allocation of budget for the OSH activities in the major ministries. • A lack of coordinated effort of the related ministries and concerned stakeholders. Priority Actions (2/4) • Develop supervision and monitoring mechanisms at LEOs and capacity strengthening of the staff. • Implement national forums on OSH that include government, employers, and worker representatives to develop national safety and health policies and legislation. • Strengthen occupational injury and disease reporting systems • Implement worker's compensation as an integral part of a safety and health program.

Priority Actions (3/4) • Identify a broad range of OSH training needs through an analysis of current OSH capacity. • Establish autonomous public OSH institutions and encouraging OSH courses at universities, academic institutions, and industry-specific training centers. • Ratification of ILO Convention No. 155. • Adequate resource allocation for human resource including budgetary provisions for effective functioning of OSH planning and enforcements at all levels. • Establish financial incentives (tax) for employers supporting safe working conditions and penalties for defaulters.

Priority Actions (4/4) • Establish and maintain Occupational incidents, injuries and disease data management center at central and province level. • Encourage and oblige employers to formulate Enterprise level OSH Policy and establish safety committee. • Apex ministry needs to play active role for effective coordination with other ministries and agencies in the area of OSH (including integrated OSH policies and plans ).
