Brief Overview – Act and Bill
Maternity Benefits Act 1961
• Regulates the employment of women during
the period of child birth, and provide
maternity benefits
• Applicable to factories, mines, plantations,
shops and other establishments
Maternity Benefits (Amendments) Bill
2016
• Introduced in and approved by Rajya Sabha in
August 2016
• Seeks to bring about changes with respect to
the duration and applicability of maternity
leave, and other facilities

Maternity Benefits Act 1961
Maternity Leave:
- Provided for 12 weeks of paid leave to expectant
mothers
- Leave to be availed not before 6 weeks prior to
expected date of delivery
Maternity Benefits (Amendments) Bill
2016
Maternity Leave:
- The Amendment increases duration to 26 weeks
- Leave can be availed 8 weeks prior to the expected
date of delivery

Way Forward…
The bill is yet to be approved in Lok Sabha:
• However, the Amendment is a welcome change hailing the way forward for working mothers
• The impact of the bill on the prospective hiring of women by companies who seem reluctant to bear
the cost is yet to be seen - there has been pushback from micro, small and medium sized organizations
• It would benefit the organizations to look at the numerous case studies indicating a direct impact of the
said benefits on employee retention
• On a positive note, large organizations particularly in the IT-BPM sector have welcomed the
Amendment
