• Lemon v. Kurtzman (1971)
– Government action must have secular purpose
– Its primary purpose must not be to inhibit or advance religion
– There must be no excessive entanglement between government and religion
• Fall more under Establishment Clause or Free Exercise Clause?
• Violating the Lemon Test?
