3. STATUE LAW
• Plaintiff tobacco manufactures and sellers appealed the out-come
decision of the U.S. District Court of Western District of Kentucky
claiming that certain provisions of the Family Smoking prevention and
Tobacco Control Act.
• They claimed it violated their First Amenment
• The requirement that tobacco packaging and advertising had to use
only white and black color, the banning of free sample tobacco
products, the banning of all sport event sponsorship, and finally the
banning of continuity programs were the four new regulations that
came about.
4. LAW REVIEW
• Georgetown University - E-cigarettes mimic smoking but in a less
harmful method… other pointing out that use of nicotine is still at use
and the chance of addiction are still present.
• University of the Pacific - cannabis sellers in the now legalized market
of advertisement, are following in the foot-steps of tobacco and alcohol.
5. CONCLUSION
• The development of new technologies along with new products now
being legal for consumption will lead to an update of old laws and the
creation of new ones.
• Only focused on the Regulation of Advertisement of Legal Smokable
Products.
