4. The most important factor when making a decision
about who will be granted parental responsibility over
a child is the child’s safety and
wellbeing.
The Family Court recently decided that a 9 year old girl
who was living with her grandparents after her
mother’s death 18 months earlier would remain in her
grandparents care rather than her father’s.
5. This was despite having regular contact and a good
relationship with her father. If the Court had granted
the father parental responsibility then the child would
have to relocate school, home, live away from her best
friend and the community that had supported her and
be subjected to her father’s ongoing treatment for
mental health issues.
6. The Court decided that it was in the child’s best
interests to remain in her grandparent’s care for
the foreseeable future.
