The propertyinquestionisa large museumexhibitconsistingof 16reconstructedpropertiesranging
fromTudor buildingstonewerVictorianones.The exhibitappearsinsafe conditionwithno
immediate dangersnoted.
The exhibitisservicedbyareconstructedcobbledstreetwithpavementseitherside.The exhibitis
shelteredfromthe elementsandisrelativelydarkinside.
Nature of Survey
It ismy understandingthatthe nature of thissurveyisto determinethe age of the propertieswithin
the exhibitandcalculate agoldenage date approximately10yearsafter the constructionof the
newestone.Iconsiderthisdate tobe 1905.
In additiontothe surveyIwill alsoadvise youof yourdutiesunderthe Control of Asbestos
regulations 2012 and will advise youof yourdutiesunderthe equalityact2010. I will alsoadvise you
on CDMregulations2015 and howthiswill affectthe project.
Limitations
Due to the nature of the exhibitnaturallytherewillbe some limitationstothe survey.
 Surveyconductedfromthe street levelonly.
 Internal surveyonlyconsistof whatcanbe seenthroughdoorsandwindows.
 Unable to accessany firstfloorareasor roof spaces.
 Surveywasundertakeninthe dimlightof the exhibit
I intendtooperate an additional colourcodingsystem sothatyoucan identifythe exhibitsthat

 As the buildingisover200 yearsoldit can be expectedthatthe windowsare coveredin
manylayersof paint.I recommendthatthe windowsare strippedtoremove any leadpaint
and thenrepainted manytimestoachieve the same finish.

for improvement.

 Some damage to the arch opposite the main entrance.Irecommendthatthisdamage is
repaired.
 The freestandingstreetlightneeds repaintingasitis inpoor condition.
 All streetlightsshouldbe runningflickeringbulbs.
 All streetlightbulbsshouldbe replacedwithflickeringbulbstomake the exhibit realistic.
 A smoke machine shouldbe addedtothe exhibittorepresentthe smogandsmoke that
wouldrepresentVictoriantimes.
Asbestos
As of the 6th
April 2012 the Control of Asbestosregulations2012 state that the 1 “Duty holder”

(Yourself) hasthe dutyto “manage asbestosin non-domesticproperties”.Thismeansthatyouare
legallyobligedtoassess,record andkeepupdated plansof asbestos whereaboutswithinyour
propertyinan asbestosregister thatmustbe made accessible.
AlthoughIdidnot notice anypotential ACM’sinthe exhibitIsuspectthat there maybe manyACM’s
inthe museum.
As the dutyholderyoumust regularlymonitorthe conditionof anyACM’sor suspectedACM’s
(Asbestos ContainingMaterial) thisisparticularlyimportantif decisionsare made toleave the
asbestos inplace or encapsulate itinaprotective material.
Under section8 of the act a licence mustbe attainedif anyworkto ACM’s isto be undertaken,a
licence canbe obtainedfromthe HealthandSafetyExecutive.HSEretainsthe rightstoadd anyextra
conditionstoandremoval worksandhas the powerto cancel licencesatany time.
Under section10 of the act the employerischarged withgivingemployees adequate information
regardingworksthatare to be carries outon the property.The employermustalsokeeparecordof
any personsthatmay have beenexposedtoanypotential ACM’s.Thisistoact as proof inany legal
actionin the future.Failure todoso maybe consideredabreachof the act.
Under section11 of the act the employerassumesresponsibilitythatall employeesworkingwithany
ACM’s are equippedwiththe appropriatepersonalprotectionandthatadequate ventilationisin
place to mitigate anyrisks.
As the exhibitislikelytocontainasbestosdue tothe fact that itwas takendowninthe 1950s I must
insistthata full asbestossurveyisundertakenonthe exhibitbefore anyworkisundertakenthiswill

thengive usa clearideaof where asbestosmay be inthe exhibit once the whereaboutsisidentified
a plancan thenbe put inplace to deal withanyrisks. Worksmay include controlledremoval,
encapsulatingof asbestosorleavingthe asbestosinsituwithclose monitoring.Isuggestthatany
worksthat are done shouldbe carriedoutby an “ARCR (AsbestosRemoval Contractorsassociation)”

approvedcontractorsto ensure thatworksare done to a satisfactorylevel.
I muststressthe importance of the Control of Asbestosact2012 and the implications thatithas on
youas a dutyholder.Above Ihave listedsome of the more importantpartsof the act that you will

AuditthatI undertookonthe Museum.Duringthe audit I noticedthatthere are several access
issuesthatmay cause problemsforpeople withmobilitydisabilitiesandvisual disabilities.
Recommendations.
1. Removal of currentwheelchairrampas itdoesnot conformto regulations.Rampwill need
to be replacedwith aregulationscompliantramp. Rampshouldbe constructedin
accordance withBS8300 and part M & L.
2. The main entrance tothe buildings shouldbe advertisedmore topreventconfusionwiththe
identical entrance tothe leftof the building.
3. Internallyrampsforwheelchairsandlessabledpeopleshouldbe installedinthe exhibitso
the curb can be easilyaccessedoff the road.
4. A anti slipcoveringshouldbe addedtothe stairsthat service the mainentrance of the
building.
5. Car park pot holesarounddisabledaccessroute shouldbe filledintoreduce anyinjury’son
the car park.
6. Stairliftsor an elevatorshouldbe addedinside of the property.
7. More spacesmay needtobe addedor current spacesadapted,anychangesshouldbe in
accordance withBS8300.7
I recommendthatsome additional measuresare introduced tomake the exhibitmore enjoyablefor
everyone.
 Pre-recorded voiceovertoursare made available forpeople whomaybe visuallyimpairedand
cannot readthe informationonthe exhibit.
 Additional lightingwithinthe exhibitshouldbe installedtoaidpeople withvisual disabilities,
Lightingshouldbe able tobe turnedon uponrequest.Signsshouldbe erectedtoinformpeople
of thisoption.

Under the Equalityact20108
providersof goodsandservices “duty holders”mustcaterforaccess up
to the deliveryof the goods/service. Thisappliesforall commercial premises andwill applytothe
museum. Asthe museumisrelativelylarge andisranby SalfordCouncil Itwouldlikelybe deemedin
court that itis necessarytomake provisions foraccesstothe buildingasthe recommendations
wouldbe considered “reasonable”,todoso.
Nowthat a DAA hasbeencarriesout anyworksthat are not undertakenwouldbe frowneduponin
court if actionwere taken againstthe SalfordMuseum.Suggestedworksthatwere notcarriedout
whichthenresultedinfailuresunderthe equalityact andwouldresultinanaward to the victimat
the museumsexpense.
I muststress that these recommendationsare actedupontopreventany Potential legallitigation
againstthe museumandto improve the overall experience of visitorstothe museum.Irecommend
that these remedialworksstatedabove are completedwhenthe renovationstothe exhibitare done
to minimise disruptiontothe museuminthe longterm.

CDM regulations2015
The newCDM regulationsof 2015 have made the client more liable foranyproblemsthatmay occur
on site duringandafterworksas the clientmustappointaPrinciple designeranda principle

setbudgetsandtimescales. UnderCDM2015 your responsibilitiescontinue thoughtthe
projectand afterwardsinthe formhealthandsafetyand maintenance.Yourresponsibilitiesonly
endonce the propertyhasbeen disposedof.
As the clientyouare responsibleformakingsure thatdesignersandcontractorsthatare appointed
have the relevantskills,experience andknowledgerequiredforthe job andare competentinhealth
and safety.Asthe clientitmaybe a goodideato getreferencesfrompreviousjobsthe contractors
may have done.
As the clientyouare responsibleformakingsure thatreasonable amountsof time andresourcesare
allocatedforeachpart of the project, thiswill preventanymistakesbeingmade andworksrushed.
You are alsoresponsible forsupervisingthe ContractorsandDesignersresponsibilitiesandmaking
sure themtheyare complete.Itmaybe a good ideatoappointa contract administratortomake

Standard termsof engagement
1 The service –the surveyorprovidesonlythe standard RICS BuildingSurveyService(‘the service’)
describedhere,unless youandthe surveyoragree inwritingbefore the inspection thatthe
surveyorwill provide extraservices. The surveyorhasagreedtoperforma DisabilityAccessAudit
and will be providingadvice onissuesrelatingtothe project. Anyextraservice will require separate
termsof engagement tobe enteredinto withthe surveyor.Examplesof extraservices include:
• plandrawing;
• schedulesof works;
• re-inspection;
• detailedspecificissuereports;
• marketvaluationandre-instatementcostand

Outdoor staging areas for contractors will be
a big concernfor CDM needs, I have noted2
locations.
Location 1 is relativelylarge but suffers from
being ona bankwith poor vehicular access.
Location 2 is relativelysmall although it
does have goodaccess.
I recommendthat location2 is usedfor
parking/ plant for the works and location1
is usedas a storage area + site offices for
the durationof the works.

2 The surveyor – the service istobe providedbyanAssocRICS, MRICS or FRICS memberof the
Royal Institutionof Chartered Surveyors,whohasthe skills, knowledge andexperience tosurveyand
reporton the property.
3 Before the inspection –thisperiodformsan importantpart of the relationshipbetweenyouand
the surveyor.The surveyorwill use reasonableendeavourstocontact youregardingyourparticular
concernsabout the propertyand explain(wherenecessary) the extentand/orlimitationsof the
inspectionand report. The surveyoralsocarriesout a desk-topstudyto understandtheproperty
better.
4 Termsof payment–youagreeto pay the surveyor’sfee andanyothercharges agreed inwriting.
5 Cancellingthiscontract– you are entitledtocancel thiscontractby givingnotice tothe surveyor’s
office atany time before the dayof the inspection.The surveyordoesnotprovide the service (and
reports thisto youas soonas possible) if,after arrivingat the property,the surveyordecides that:
(a) He or she lacks enoughspecialistknowledge of the methodof constructionusedtobuild

The exhibitisservicedbyareconstructedcobbledstreetwithpavementseitherside.The exhibitis shelteredfromthe elementsandisrelativelydarkinside. Nature of Survey It ismy understandingthatthe nature of thissurveyisto determinethe age of the propertieswithin the exhibitandcalculate agoldenage date approximately10yearsafter the constructionof the newestone.Iconsiderthisdate tobe 1905. In additiontothe surveyIwill alsoadvise youof yourdutiesunderthe Control of Asbestos regulations 2012 and will advise youof yourdutiesunderthe equalityact2010.
