Nepal’sSituation:
Nepal hasbeen dealingwiththis cybercrime speciallyrelatedtosocial mediaandfraud underthe
ElectronicTransactionAct2006. There isno specificlaw orsectionthat definesthe nature of online
abuse or exploitationof WomenorViolence againstof Women.
There has beenadefinite rise incybercrime casesinNepal inabsence of properpoliciesand
mechanism. There hasbeenarise inthe report of such crimes,andpolice statisticsshow thattheyhad
increasedbyas muchas 105 percent inthe last fiscal year,2014-15. Figuresshow thata total of 39

2. cyber-crime relatedcaseswerereportedtothe police lastyearwhilesuchcrimesnumbered19before
that year.Moreover,these casesare on the rise inthe recentyear withasmany as 35 such cases
reportedtothe police aftermid-Julyinthe beginningof thiscurrentfiscal year.The majorcybercrimes
that take place are,among others,E-mail theft,datahacks,online fraudandimpersonatingprofiles.
Current Law Practice in Nepal
The ElectronicTransactions Act, 2063 (2008)
Article 47
Publicationof illegal materialsinelectronicform: (1) If any personpublishesordisplaysanymaterial in
the electronicmediaincludingcomputer,internetwhichare prohibitedtopublishordisplaybythe
prevailinglaworwhichmaybe contrary to the publicmoralityordecentbehaviororanytypesof
materialswhichmayspreadhate or jealousyagainstanyone orwhichmayjeopardizethe harmonious
relationssubsistingamongthe peoplesof variouscastes,tribesandcommunitiesshallbe liable tothe
punishmentwiththe finenotexceedingOne HundredThousandRupeesorwiththe imprisonmentnot
exceedingfive yearsorwithboth.
(2) If any personcommitan offence referredtoinSub-section(1) time totime he/she shallbe liable to
the punishmentforeachtime withone andone half percentof the punishmentof the previous
punishment.
Future Plans
In termsof cyber policyandpropermechanismtomonitorthe cybercrime,the Nepal Government
recentlyhasshowncommitmenttowardsestablishingaNational CyberSecurityStrategytodeal with
such threatsandattacks. The government iscommittedtomake cyberspace safe inNepal andbring
ChildOnline Protection(COP) andalsoanew law for cybersecurity.
