This pertains to the complaint against Punong Barangay Grace B. Corpus and Pasay City
Government for the alleged inaction on the complaint filed before the Business Permit
and Licensing Office [BPLO) -Pasay. This letter also refers to the related complaint dated
July 2L,2023 which was received by this level on luly 27 ,2023.
This level has coordinated the matter with PB Corpus and City Government of Pasay for
their reply on the above allegations.
Relative to the reply from the City Government of Pasay specifically from the Business
Processing and Licensing Office (BPLOJ- Pasay, the said office replied that tlen OIC Ciry
Administrator Cresalita I. Rey and BPLO OIC Ms. Michelle Talavera-pardo had talked to
the parties separately. Ms. Pardo commented that the complaint was subject for
inspection however the inspection did not push through because upon validation by the
inspection team, the issue was between the sublessor and sublessee. According to Ms.
Pardo, the parties concerned agreed to settle the issue among themselves. please see
attached letter reply of City Administrator Peter M. Manzano detailing the chronology of
events ofthe actions undertaken in response to the issues raised by the complainant.

PB Corpus replied that series of scheduled meeting were conducted before the Lupong
Tagapamayapa and a certificate to file action was issued in favor ofthe complainant (See
attached Annex AJ. PB Corpuz has highlighted that the letter addressed to DILG Secretary
Benjamin C. Abalos, Jr. is a repeated complaint which was previously responded thereto
by PB Corpus to her letter to Mr. Enrique Pascual III [See attached Annex BJ. PB Corpus
also informed this level that criminal and civil cases lvere already filed in courl The case
for grave coercion, Rex Garbo and Florian R. Facundo vs. Wil John Sanchez, Carlos
Campos, and Michael Ong was recommended by the Office of the City Prosecutor for
dismissal for lack of probable cause last December 21,2027 (See attached Annex CJ.
Moreover, there were a notice to vacate and to pay money judgement and a writ of
executicn issued against the complainant by the Metropolitan Trial Court last July 14,
2023 and June 14,2023 respectively [See attached Annex D, D1-D2J.

Dear Mr. Cabuenos:
This is in response to your letter of endorsement dated July 31., 2023, rcgarding the complaint of
Ms. Florian Facundo and Mr. Rex Garbo against PB Grace B. Corpus of Barangay 47,Pasay City
and Pasay City Government for the alleged inaction on the complaint filed before the Business
Permit and Licensing Office (BPLO)-Pasay.
Based on our records, below are the sequence of event and corresponding actions.
1. On March 09,2022, the Office of the City Administrator received a complaint letter from
Ms. Facundo and Mr. Garbo requesting a meeting with the then OIC City Administrator,
Ms. Cresalita Rey; the meeting happened on March 10, 2023. On the same day, the
complaint was endorsed to the office of the BPLO, and the OIC Head of BPLO commented
that the complaint establishment was due for inspection. On March 15,2023, OIC BPLO
Head commented ttnt the inspection did not push thru since, upon validation with the
inspection team, the issue was between the sublessor and sub lessee. Attached is a copy
of the complaint and routing slip for reference as Annexes "A" and " A:1".
2. On March 18, the OIC Head of Pasay City Barangay Bureau forwarded a copy of the
response letter from PB Grace Lucila Corpuz, Btgy M, regarding the same complaint,
referred to as LC :L42-2021,41-14. Accordingly, the Barangay called a meeting for personal
confrontation but failed; thus, a Certificate to File Action dated April 29, 20?3, was
received by Mr. Rex Garbo. Attached is a copy of the letter from PCBB as Annexes "B,"
"84" , and. "B-2" .
3. On July 31,,2023, the Office of the City Administrator received the endorsement from the
DILG regarding the complaint of Mr. Garbo and Ms. Facundo. The office endorsed the
letter endorsement to the concemed offices for comment.
4. On luly 3'1,,2023, BPLO submitted their comment to the Office of the City Administrator,
while on August Z PCBB forwarded the letter explanation of PB Grace Corpus. Attached
are their responses as Annexes "C" arrd"D."

carlos campos & Michael ong and LESSEE Rex B. Garbo. Apparently' the lessor decided to
pdlocked the property being ieased by the lessee due to non-payment of the rental fees in

to rent'a seiohd unit was made on November 15, 2020 to last untilNovember 15, 2021
was subsequently entered into. These rented units were used for the purpose of selling
clothes at their shop called F&R RJ Co. and it doubles as thelr dwelting place, for a

Probable cause, for the purpose of filing a crirninal information, has been
defined as such facts as are sufficient to engender a well-founded belief that a crime
has been committed and that respondent is probably guilty thereof. The term does
not mean "actual and positive cause" nor does it import absolute certainty, It is merely
based on opinion and reasonable bellef. Probable cause does not require an inquiry
into whether there is sufficient evidence to procure a conviction. It is enough that it is
believed that the act or omission complained of constrtutes the offense charged.3
Parenhetically, part of the public prosecutor's duty to determine if there exists
a well-founded belief that a crime has been committed, and that the suspect is
probably guilty of the same, is the corollary findings that the elements of the crime
charged should, ln all reasonable likelihood, be present. Thls ls based on the principle
that every crime is defined by lts elements, wlthout whlch there should be, at most,

al.5,,the complaint fur grave coercion was dismissed fur slmilarly. failing to allege ihat
the fact of padlocking and cutting off of facilities to prevent the petitioners from
entering the subject unit were effected by violence, threat or intimidation. While the
intimidation due to the presence of.the guards was belatedly alleged by the petitioner,
the Supreme Court nevertheless ruled that under the obtaining circumstances there
was still no intimidation that took place which would warrant the indictment of the
respondents for grave coercion.

to the respondenls' claim that they iannot be said to have been prevented from doing
something not prohibited by the law or has allegedly compelled them to do something
against their will considering that they are still occupying the lsesed premises and
operating their business up to the present.
More importantly, it must be emphasized that the affidavit of the complainant,
or any of his witnesses, shall allege facts within thelr (afiianE) personal holvledge.
In this case, the assertion of the complainants that they were allegedly told by Wel
lohn Sanchez that he padlocked the units based on the orders of Carlos Campos,
whom they later on called only to be told that he only followed the lnsEuctions of
Michael Ong ls certainly hearsay. Notably, these allegations werc vehemently denled
by the alleged source of the information or no less than Wel John Sanchez and Carlos
Campos, respectlvely, in their Jolnt Gounter-Affidavit. It ls an elementary prindpte that
. mere allegation ls not.evidence and is'not equlvalent to proof, thuswe cannot glve
credence to the complainants'claims and proceed with indicting the respondents on
the strength alone of this allegation lest rve would be faced vyith the risible scenarh
where the complainanty would have to call as wltnesses the respondents to prove

In fact, after series of scheduled hearings before the Office of the Lupong TagaPamayaPa
and after mediation failed, a Ccrtificate to File Action was issued in favor of them. Said
certificate is a condition precedcnt before filing any complaint before the court and/or
government offices and is hereto attached as " Annex A".
Thirdly, the undersigned stresses that her office's action on the complaint is to mediate
the parties' conflicting interests pursuant to the Katarungang Pambarangay Law, as
amended by Republic Act No. 7160 otherwise known as the Local Govemment Code of
1991,.
Fourthly, the allegations in the letter of Mr. Garbo and Ms. Facundo dated fuly 3, 2023
addressed to Hon. Benjamin C. Abalos, Jr. is a mere rehash of their allegations contained
in their letter to the Presidential Complaint Center dated Feb'ruary 1,6, 2021,, which the
undersigned already responded on March L8,2022- A copy of the said response is hereto
attached as "Arnex 8".
Fifthly, it is the opinion of the undersigned that her office no longer has jurisdiction over
the complaint as Mr. Garbo and Ms. Facundo already filed a complaint before the Office
of the City Prosecutor of Pasay City where the same was already resolved by the said
office on December 27, 2021,. A copy of the resolution of the Office of the City Prosecutor
of Pasay City is hereto attached as "Annex C".
Finally, the case between Markeman Game Ventures, Inc. represented by its Attorney-in-
Fact, Carlos R. Campos versus Sps. Florian Facundo and Rex Garbo and all persons
claiming rights and interest under them has become final and executory. A copy of the
Notice to Vacate and Pay Money |udgment dated July 1,4,2023, Writ of Execution dated
]une 14, 2023 and Order dated June L4, 2023 was furnished to this office by the
Metropolitan Trial Court Branch 1.67,Pasay City and are hereto attached as "Annex D, D-
1 and D-2", respectively.

for Execution.
NOWTHEREFORE, you are hereby commanded to cause the execution of
the aforesaid Decision; to levy the goods and chattels of the defendants SpS,
FLORIAN FACUNDO and REX GARBO and ALL PERSONS CLAIM|NG
RIGHTS AND INTEREST UNDER THEM of one Buendia Food place tocated
at No. 301 Sen, Gil Puyat (Buendia) corner Taft Avenuee, pasay City except
those which are exempt from execution; and to make the same thereof in
accordance with the procedure laid down in Rule 39 of the Revised Rules of court,
and in such cases made and provided, together with all your lawful fees for the
service of this writ.
In case sufiicient personal property of the defendant cannot be found to
satisfy the amount of said Decision, you are hereby directed to levy the real
property of the said defendants and to sell the same or so much thereof in the
manner provided for by law for the satisfaction of the said Decision.
You are directed to make a retum of your proceedings pursuant to Section
14, Rule 39 of the 201 9 Amendments to the 1 997 Rules of Civil procedure.

Foftunato cajucom,l the supreme court held that once the judgment becomes
final, the prevailing party is entifled as a matter of right to a writ 6t execution. lts
issuance is, in fact, the trial. court's ministerial duty, ihe only rimitation being that
the writ must conform substantially to every essential particular of the judf,meni
promulgated, more particularly, the orders or decrees in the dispositive portlon ot
the decision. Furthermore, the court held that even the holding in abeyance of the
issuance of a writ of execution of a final and executoryiudgmeit can be considered
abuse of discretion on the part of the trial court.
Taking into account that the appealed Decision has become final and
executory the issuance of a Writ of Execution is proper.
WHEREFORE, plaintiffs Motion for Execution is hereby GRANTED. Let a
writ of Execution be issued based on the appealed Decision dated 29 November
2021 . The Sheriff of this court is DIRECTED to implement this Order.
The Philippine National Police and/or the concerned law enforcers are
requested and directed to extend and provide the necessary assistance in the
implementation of the Writ in accordance with law.

Corpus and Pasay City Government for the alleged inaction on the complaint filed before the Business Permit and Licensing Office [BPLO) -Pasay. This letter also refers to the related complaint dated July 2L,2023 which was received by this level on luly 27 ,2023. This level has coordinated the matter with PB Corpus and City Government of Pasay for their reply on the above allegations. Relative to the reply from the City Government of Pasay specifically from the Business Processing and Licensing Office (BPLOJ- Pasay, the said office replied that tlen OIC Ciry Administrator Cresalita I. Rey and BPLO OIC Ms. Michelle Talavera-pardo had talked to the parties separately. Ms. Pardo commented that the complaint was subject for inspection however the inspection did not push through because upon validation by the inspection team, the issue was between the sublessor and sublessee. According to Ms. Pardo, the parties concerned agreed to settle the issue among themselves. please see attached letter reply of City Administrator Peter M. PB Corpuz has highlighted that the letter addressed to DILG Secretary Benjamin C. Abalos, Jr. is a repeated complaint which was previously responded thereto by PB Corpus to her letter to Mr. Enrique Pascual III [See attached Annex BJ. PB Corpus also informed this level that criminal and civil cases lvere already filed in courl The case for grave coercion, Rex Garbo and Florian R. Facundo vs. Wil John Sanchez, Carlos Campos, and Michael Ong was recommended by the Office of the City Prosecutor for dismissal for lack of probable cause last December 21,2027 (See attached Annex CJ. Moreover, there were a notice to vacate and to pay money judgement and a writ of executicn issued against the complainant by the Metropolitan Trial Court last July 14, 2023 and June 14,2023 respectively [See attached Annex D, D1-D2J.

CABUENOS,IR City Director Deparhnent of the Interior Local Government Dear Mr. Cabuenos: This is in response to your letter of endorsement dated July 31., 2023, rcgarding the complaint of Ms. Florian Facundo and Mr. Rex Garbo against PB Grace B. Corpus of Barangay 47,Pasay City and Pasay City Government for the alleged inaction on the complaint filed before the Business Permit and Licensing Office (BPLO)-Pasay. Based on our records, below are the sequence of event and corresponding actions. 1. On March 09,2022, the Office of the City Administrator received a complaint letter from Ms. Facundo and Mr. Garbo requesting a meeting with the then OIC City Administrator, Ms. Cresalita Rey; the meeting happened on March 10, 2023. On the same day, the complaint was endorsed to the office of the BPLO, and the OIC Head of BPLO commented that the complaint establishment was due for inspection. On March 15,2023, OIC BPLO Head commented ttnt the inspection did not push thru since, upon validation with the inspection team, the issue was between the sublessor and sub lessee. Attached is a copy of the complaint and routing slip for reference as Annexes "A" and " A:1". 2. On March 18, the OIC Head of Pasay City Barangay Bureau forwarded a copy of the response letter from PB Grace Lucila Corpuz, Btgy M, regarding the same complaint, referred to as LC :L42-2021,41-14. Accordingly, the Barangay called a meeting for personal confrontation but failed; thus, a Certificate to File Action dated April 29, 20?3, was received by Mr. Rex Garbo. Attached is a copy of the letter from PCBB as Annexes "B," "84" , and. "B-2" . 3. On July 31,,2023, the Office of the City Administrator received the endorsement from the DILG regarding the complaint of Mr. Garbo and Ms. Facundo. The office endorsed the letter endorsement to the concemed offices for comment. 4. On luly 3'1,,2023, BPLO submitted their comment to the Office of the City Administrator, while on August Z PCBB forwarded the letter explanation of PB Grace Corpus. Furthermore, the court held that even the holding in abeyance of the issuance of a writ of execution of a final and executoryiudgmeit can be considered abuse of discretion on the part of the trial court.
