of adoption have been pursued for decades. For administering adoption of all religions,
there is no peculiar rule in land of several religions. Other non-hindu religions like
muslims,christians,jews and parsis do not have their own particular rule guiding adoption.
Under Guardians and Wards Act 1890, they could solitaryturn out to be guardian of infant.
Hindu Adoption and Maintenance Act, is pursued by hindus, buddhists, sikhs and
jains.There was a decline forthe government of india to compose uniform law foradoption.
This paper elaborates on adoption law.
1. Introduction
To appease the sentimental and forbearing intuition of adopters, now adoption is generally
compassed but commonly, a child was adopted for transitive and devotional ambition. For
the effectiveness of the adoption observance, it was decisive to appeal to relatives as
essential witnesses of adoption during the ancient period. Even if a boy is born after his
adoption, the adopted child was still designated to the property as he would be ascendancy
of heir of whole property inherited if a person takes a child as his own. To be lone
representative of man for a natural born child and acknowledgement of consequent son by
adoption was expressed comprehensively amiss affirming to ancient cases.To be begotten
by a man, consequently previous texts not in the least legitimized any son other natural
born. To implement burial rites of a man, wife or daughter was not permitted to do so as
noticeable from the previous texts. To reclaim the departed from hell or recover from
adversity from hereafter, female child could not do it as supposed.

3. Adoption in India
The prospective of country builds upon children. Children are considered to be round up
of joy.All requirements are given by parents for all round enhancement for children born
in India. On the other side 60,000 children being abandoned per year in India. To an
adoption agency in many healthy situations children are taken while getting adopted hoping
for better life. Children also are becoming victims of human trafficking and sexual violence
and it is very sad state. From one person to another, permanent legal transfer of all parental
rights known as adoption. Dating back to ancient times, practice and custom of adoption
has been prevailing. As a sacramental act, adoption was considered predominantly.
Whether adoption having secular motive predominating or religion motive still remains
controversy. By child welfare committeeas per guidelines ofGOI, any orphan, surrendered
or abandoned legally declared free for adoption. Child considered to be abandoned when
deserted or unaccompanied by parents or guardian. If police fails finding true parent of
child at level best then child considered to be legally free. Financial stability is required for
adoptive parents. Not only this but metal, emotional and physical stability also required.
Any suffering of life-threatening disease must also not be there. Couples with 3+ kids not
allowed for adoption. Fifty five years is maximum age limit of single parents. With and
authorized agency where social workers explain process and take through legal formalities,
paperwork and general preparation required for registration, adoptive parents required to
get registered. In order to do home study, visiting the home of adoptive parents done by
social worker of registration agency. Signing of certaindocuments pertaining to acceptance
of child provided that parents are comfortable with child. Preparation of petition done by
lawyer which is presented to court when necessary documents submitted. Then in front of
court officer,the petitionis signed by adoptive parents when visiting court after completion
of petition. Understanding habits of child before taking home done when child taken to
pre-adoption fostercare centerafter petitionsigned in court. Once the receiptof investment
made presented in front of judge, passing of adoption rules done by judge.
