US federal prosecutions; the new food safety
enforcement tool?
Beginning in 2014 with the sentencing of two
Colorado cantaloupe growers and continuing
with guilty pleas from one of the US’ biggest
egg producers, as well as the historic jury trial of
the officers and executives of a former peanut-
processing corporation, federal criminal law was put
through its paces throughout the course of 2014,
and all in the name of food safety. Food safety
agencies, including the USDA and FDA, received
unprecedented backing by the US Department of
Justice, which resulted in a multitude of criminal
prosecutions of food industry executives across
multiple states.
Long since tipped as the way forward by the United
States Food and Drug Administration (FDA) and the
food industry as a food safety enforcement tool, the
defense bar began warning food industry executives
that they, too, could be charged with ‘no fault’ federal
criminal misdemeanours if businesses shipped
contaminated food with or without the executive’s
personal knowledge or consent. Subsequently, the
Colorado cantaloupe defendants each received
six months of home confinement after pleading
guilty to six of the ‘strict liability’ federal criminal
misdemeanours solely on account of their product
being distributed with the deadly pathogen, Listeria
monocytogenes. The same fate awaits the egg
producers who are still awaiting sentencing for
‘strict liability’ misdemeanours after the defendants
salmonella-contaminated eggs were introduced into
interstate commerce.
Similarly, all five defendants from the peanut-
processing corporation that produced salmonella-
laced peanut butter and peanut paste in 2008,
which resulted in the nation’s biggest recall of such
products in history, an estimated US$1 billion, and
which tragically resulted in the deaths of nine of
the more than 700 hundred victims, are likely to be
sentenced in 2015. Two of the defendants pleaded
guilty before trial under agreements that saw them
testify for the government and criminal prosecutions
against the remaining three executives, which
concluded in September 2014, resulting in 97 federal
felony counts between them, including conspiracy,
wire fraud, obstruction of justice and falsification of
lab results. As each felony carries a maximum of 5
to 10 years, there are enough convictions between
the three to send each to federal prison for the
rest of their lives. However, none is known to have
any previous convictions and federal sentencing
guidelines will come into play after a federal
sentencing report is completed for each of the three.
Other sectors within the US have also not avoided
the court’s attentions in 2014. Fourteen people
were arrested in mid-December in connection
with a deadly 2012 outbreak of fungal meningitis
linked to steroid injections from a Massachusetts
compounding pharmacy. Two of the 14 arrested
were the owners of the company, each of whom
has been charged with second-degree murder and
racketeering in connection with the 64 deaths that
resulted from the outbreak. The 131-count indictment
alleges that the employees were aware that they
were producing medication in an unsafe and
unsanitary manner, yet distributed it anyway. Attorney
General Eric Holder said, ‘American consumers have
a right to know that their medications are safe to use.’
Although the requisite knowledge standard of those
involved with the meningitis outbreak differs from the
‘strict liability’ standard for those involved in a food-

borne outbreak, the message is the same; regardless
of industry, proactive measures with regard to
quality control, safety and sanitisation should be
implemented to ensure consumer health.
Legal experts note that, not only are we seeing an
escalation in criminal prosecutions of food-industry
executives because of product safety failings, but
that there is an increase in the resources that the
government is devoting to prosecution and how
aggressively it prosecutes a case. In the case of
the peanut-processing corporation, the prosecution
called 45 witnesses and the government indicted
these individuals on 76 federal felony counts and
went to trial on 71 of them. The charges carry prison
sentences of up to 20 years apiece. Moreover, the
government aggressively sought information from
several law firms that formerly represented the
corporation by issuing subpoenas and demanded
that these attorneys be available for testimony at
trial despite the attorneys claiming attorney-client
privileges.
The Department of Justice and the FDA have made
US food safety a priority and both believe that one of
the best ways to protect food safety is to criminally
punish those who violate food safety laws and
regulations, even if unknowingly doing so. Stuart
Delery, Acting Associate Attorney General, said,
‘When those responsible for producing or supplying
our food lie and cut corners ... they put all of us at
risk. The Department of Justice will not hesitate to
pursue any person whose criminal conduct risks
the safety of Americans who have done nothing
more than eat a peanut butter and jelly sandwich.’
Following the successful, high-profile prosecution of
those involved in the contaminated cantaloupe and
peanut butter cases, the food industry should be
aware of this new means of regulation; regulation not
by litigation but by criminal prosecution.

Accord, Honda CR-V, Honda Civic and Honda Jazz
vehicles, as there is a potential concern with the
propellant wafers contained within the passenger
side front airbag inflator.
Australia - 22 December 2014 – Volkswagen Group
Australia Pty Ltd recalled a specific model year
of Volkswagen Crafter vehicles as the earth ring of
the damper weight on the propshaft can loosen on
Crafter vehicles of a limited production period.
United States - 19 December 2014 – Bethel
Nutritional Consulting, Inc. recalled one lot
of SLIM-K Capsules, as the firm was informed
by the US Food and Drug Administration (FDA)
that a sample of SLIM-K collected and tested

desmethylsibutramine, and Phenolphthalein.
Sibutramine is an appetite suppressant that
was withdrawn from the US market in October
2010 (due to increased risk of seizures, heart
attacks, arrhythmia and strokes). Phenolphthalein
is an ingredient previously used in over the
counter laxatives, although due to concerns of
carcinogenicity, it is not currently approved for
marketing in the United States. These undeclared
ingredients make this product an unapproved new
drug, for which safety and efficacy have not been
established.

B-Lipo Capsules, as the firm was informed by the US
Food and Drug Administration (FDA) that a sample of
B-Lipo collected and tested by the FDA was found to
contain Lorcaserin, a controlled substance used for

pipe delivering brake fluid from the Hydraulic Brake

specific model year of Dodge Ram 3500 and Dodge
Ram 2500 vehicles, as some of the diesel fuel heater
electrical connectors in the above vehicles may
overheat and cause a fuel leak.
Australia - 12 December 2014 – Chrysler Australia
Pty Ltd trading as Fiat Chrysler Group recalled
a specific model year of Jeep Grand Cherokee
vehicles, as the Occupant Resistant Control (ORC)
module of the vehicles may develop an internal
fault. A coating on the ORC module printed circuit
boards may have been improperly applied during the
manufacturing process. If the coating was applied
incorrectly, lead salts may form and cause a resistive
short across the ORC module printed circuit board.
United States - 11 December 2014 – Baxter recalled
a specific expiration date of 0.9% Sodium Chloride
Injection USP 100mL due to the presence of
particulate matter.

Australia Pty Ltd recalled a specific model year
of Volkswagen Polo vehicles as, on all affected
vehicles, faulty signals can be generated in the
airbag control unit due to a fault in the production of
an internal acceleration sensor.

Company Australia Pty Ltd recalled specific VIN
ranges of Hyundai i30 (FD) vehicles, as the universal
joint bolt on the steering column had been incorrectly
tightened.

model years of Ford 1.0L EcoSport vehicles, as the
fuel tube and fuel vapour tube do not have adequate
corrosion-resistant protective coating.

Ltd recalled specific part numbers of Recaro Pole
Position SPG (FIA) and Recaro Furious SPG (FIA)
Racing Seats as, during internal crash tests of the
seat systems, it was found that set-up cracks can
occur in the seat shell in the area of the front fixation
to the steel adapter connecting the seat with the
vehicle floor. These are after-market seats intended
for use in motorsports cars used on race tracks.

could lead to brake drag and possibly cause brake
overheating.

Class, Sprinter and GLK Class vehicles due to a
possible defect on the timing chain tensioner gasket.

vaccine suspension for injection – single dose
syringe, due to the potential for particulate
contamination.

Ltd Pty as Fiat Chrysler Group recalled specific
date models of Jeep Wrangler vehicles, as water may
travel along the heated power mirror wiring harness
and into the heated power mirror electrical connector.
This can cause corrosion inside the heated mirror
connector and the formation of a resistive bridge
between the power and ground electrical terminals.

Company of Australia Limited recalled specific
build date ranges of Ford Ecosport vehicles, as
the curtain airbag, seat belt pre-tensioner and
side impact sensor circuits have been incorrectly
orientated in the main wiring harness.

(Australia) Pty Ltd recalled specific VIN ranges
of Nissan C12 Pulsar, Y62 Patrol, F15 Juke and
T32 X-Trail vehicles. The fuel pressure sensor of
some vehicles may be insufficiently tightened to the
fuel rail, and may loosen gradually due to heat and
vibration of the engine. In some cases, fuel leakage
may occur between the fuel pressure sensor and the
fuel rail.

US federal prosecutions; the new food safety enforcement tool? Beginning in 2014 with the sentencing of two Colorado cantaloupe growers and continuing with guilty pleas from one of the US’ biggest egg producers, as well as the historic jury trial of the officers and executives of a former peanut- processing corporation, federal criminal law was put through its paces throughout the course of 2014, and all in the name of food safety. Food safety agencies, including the USDA and FDA, received unprecedented backing by the US Department of Justice, which resulted in a multitude of criminal prosecutions of food industry executives across multiple states. Long since tipped as the way forward by the United States Food and Drug Administration (FDA) and the food industry as a food safety enforcement tool, the defense bar began warning food industry executives that they, too, could be charged with ‘no fault’ federal criminal misdemeanours if businesses shipped contaminated food with or without the executive’s personal knowledge or consent. Subsequently, the Colorado cantaloupe defendants each received six months of home confinement after pleading guilty to six of the ‘strict liability’ federal criminal misdemeanours solely on account of their product being distributed with the deadly pathogen, Listeria monocytogenes. The same fate awaits the egg producers who are still awaiting sentencing for ‘strict liability’ misdemeanours after the defendants salmonella-contaminated eggs were introduced into interstate commerce. Similarly, all five defendants from the peanut- processing corporation that produced salmonella- laced peanut butter and peanut paste in 2008, which resulted in the nation’s biggest recall of such products in history, an estimated US$1 billion, and which tragically resulted in the deaths of nine of the more than 700 hundred victims, are likely to be sentenced in 2015. Two of the defendants pleaded guilty before trial under agreements that saw them testify for the government and criminal prosecutions against the remaining three executives, which concluded in September 2014, resulting in 97 federal felony counts between them, including conspiracy, wire fraud, obstruction of justice and falsification of lab results. As each felony carries a maximum of 5 to 10 years, there are enough convictions between the three to send each to federal prison for the rest of their lives. However, none is known to have any previous convictions and federal sentencing guidelines will come into play after a federal sentencing report is completed for each of the three. Other sectors within the US have also not avoided the court’s attentions in 2014. Fourteen people were arrested in mid-December in connection with a deadly 2012 outbreak of fungal meningitis linked to steroid injections from a Massachusetts compounding pharmacy. Two of the 14 arrested were the owners of the company, each of whom has been charged with second-degree murder and racketeering in connection with the 64 deaths that resulted from the outbreak. The 131-count indictment alleges that the employees were aware that they were producing medication in an unsafe and unsanitary manner, yet distributed it anyway. Attorney General Eric Holder said, ‘American consumers have a right to know that their medications are safe to use.’ Although the requisite knowledge standard of those involved with the meningitis outbreak differs from the ‘strict liability’ standard for those involved in a food-

Advice - Support - Response 2 borne outbreak, the message is the same; regardless of industry, proactive measures with regard to quality control, safety and sanitisation should be implemented to ensure consumer health. Legal experts note that, not only are we seeing an escalation in criminal prosecutions of food-industry executives because of product safety failings, but that there is an increase in the resources that the government is devoting to prosecution and how aggressively it prosecutes a case. In the case of the peanut-processing corporation, the prosecution called 45 witnesses and the government indicted these individuals on 76 federal felony counts and went to trial on 71 of them. The charges carry prison sentences of up to 20 years apiece. Moreover, the government aggressively sought information from several law firms that formerly represented the corporation by issuing subpoenas and demanded that these attorneys be available for testimony at trial despite the attorneys claiming attorney-client privileges. The Department of Justice and the FDA have made US food safety a priority and both believe that one of the best ways to protect food safety is to criminally punish those who violate food safety laws and regulations, even if unknowingly doing so. Stuart Delery, Acting Associate Attorney General, said, ‘When those responsible for producing or supplying our food lie and cut corners ... they put all of us at risk. The Department of Justice will not hesitate to pursue any person whose criminal conduct risks the safety of Americans who have done nothing more than eat a peanut butter and jelly sandwich.’ Following the successful, high-profile prosecution of those involved in the contaminated cantaloupe and peanut butter cases, the food industry should be aware of this new means of regulation; regulation not by litigation but by criminal prosecution. United States - 31 December 2014 – Campos Foods LLC recalled a specific production date of Rockin’ Roasted Roasted Chicken Drum & Thigh (With Back) Smoke Flavor Added and Rockin’ Roasted Roasted Chicken Quarters Smoke Flavor Added due to the undeclared presence of a peanut allergen. United States - 30 December 2014 – Pink’s Ice Cream LLC recalled specific production dates of Black Sesame, Durian, Green Tea, Mango, Red Bean, Spicy Ginger, Taro and Thai Tea ice cream flavours due to possible Listeria monocytogenes contamination. Phenolphthalein is an ingredient previously used in over the counter laxatives, although due to concerns of carcinogenicity, it is not currently approved for marketing in the United States.
