Service of Process Federal & State
The Due Process clauses in the United States Constitution prohibit courts from exercising personal jurisdiction
over a defendant unless the defendant has proper notice of the court's proceedings. To meet this rule, courts
require plaintiffs to arrange for defendants to be served with a court summons and a copy of the plaintiffs'
complaint.
The summons and complaint must be either given directly to defendants or left with a suitable person at their
home or place of business. Service may usually be performed by any adult who is not a party to the lawsuit.
Plaintiffs may hire professional process servers to serve defendants. See Rule 4 of the Federal Rules of Civil
Procedure.
Due Process of Law
Since service of process constitutes a fundamental element of the constitutional right to due process of law, its
requirements, established in Rule 4 of Civil Procedure, must be strictly adhered to in accordance with State
Laws Process And Service Of Process.

States; nor shall any state deprive any person of life, liberty, or property, without due process of law; nor deny to
any person within its jurisdiction the equal protection of the laws.
2. Article II, Sec. 7 of the Constitution of Puerto Rico, guarantees that no person shall be deprived of his freedom or
property without due process of law.
The right to life, freedom, and enjoyment of property is recognized as the fundamental right of the human being.
There will be no death penalty. No person shall be deprived of his freedom or property without due process of
law, nor shall any person in Puerto Rico be denied equal protection of the laws. Laws that undermine contractual
obligations will not be passed. Laws will determine a minimum of property and belongings not subject to
embargo.
