Enacted by Congress in 1980, CERCLA established a
tax on businesses operating in the petroleum and
chemical sectors. In its first five years, CERCLA
generated $1.6 billion in tax revenue, which supported
the creation of a trust fund for remediating hazardous
waste sites.
3. In addition to the tax, CERCLA authorized the
federal government to respond directly to
releases of hazardous substances. The law
enables federal agencies to take immediate
action in these dangerous situations. Under the
provisions of CERCLA, the federal government
can also create long-term remedial efforts to
reduce the danger of serious, but not
immediately life-threatening, hazardous
substance releases.
