Novim Zakonom o leasingu, predviđa se redefiniranje uloge leasing društava, kako bi im se
olakšalo poslovanje, odnosno uvela bolja regulacija koja treba povećati stabilnosti tog dijela
financijskog tržišta
New law on leasing that should enter into force as of 01 July 2013 states redefinition of

regulation with aim of increasing stability of that part of financial market
edna od najvažnijih izmjena novog zakona je u tomu što će leasing druš-
tva moći davati svoju imovinu (vraćene objekte leasinga) u kratkoročni
najam, a to bi trebalo rezultirati smanjenjem troškova davatelja leasin-
ga, te, indirektno, i primatelja leasinga, od kojih su najveći održavanje i
skladištenje vraćenih predmeta leasinga, dok se ta imovina ne proda, ili
ponovno ne stavi u gospodarsku funkciju s novim primateljem leasinga.
Tim povodom porazgovarali smo s Ivanom Franićem, voditeljem financi-
ranja plovila pri SG Leasingu: Pojednostavljeno, leasing kuća neće trebati
sklopiti ugovor o leasingu s čarterskom agencijom, nego će se plovilo u
povratu moći dati direktno u zakup/najam, dok ne nađe novog primatelja
leasinga ili se ne proda. Prednost novog zakona odražava se u financiranju
investicijskih projekata (izgradnje), što je posebno interesantno tvrtkama
koje se bave izgradnjom brodova i nekretnina, u odnosu na postojeći, koji
jasno definira mogućnost leasing financiranja jedino dovršenih proizvoda
(plovila, objekata, postrojenja itd.). Stari zakon definirao je mogućnost
kupoprodaje leasing kuće od dobavljača isključivo putem fakture, dok se
izmjenom zakona predviđa mogućnost kupoprodaje i s fizičkim osobama,
što će dodatno proširiti djelatnost financiranja plovila s obzirom da je na
Jadranu veliki broj njih u vlasništvu fizičkih osoba.

Možemo se pohvaliti kako unutar grupacije Société Générale postoje spe-

Koji su rezultati vašeg leasinga za ovu godinu i kako ste do njih došli?
SG Leasing, kao dio Société Générale Grupe, prisutan je unutar kuće So-
ciété Générale Splitska banka, a počeo je raditi u kolovozu 2008., dok od
2010. razvija financiranje brodova i nekretnina. U samo četiri godine, kva-
litetnim pristupom na financiranju plovila i unapređenju poslovanja, naš
je rad rezultirao tržišnim udjelom od oko 15% u segmentu financiranja
plovila, s kontinuiranim povećanjem usluga kao što su uvoz, osiguranje

One of the most important law alterations is that leasing houses shall be
able to rent their assets (returned leasing objects) short-term. The result
of such would be decrease of lessor’s expenses, indirectly this applies also
to the lessee, the biggest expenses are maintenance and storage of re-
turned assets until such assets are sold or passed on to the possession of a
new lessee. Therefore, we spoke with Ivan Franić, Head of boat financing at
SG Leasing: To make it simple, leasing house is not forced to enter into leas-
ing contract with charter agency, though the vessel when returned shall be
directly granted for a lease/rent, until new lessee is found or the vessel
is sold. Advantage of the latest law lies in financing investment projects
(construction development), particularly interesting for companies dealing
with ship and property construction, as opposed to the existing law, which
defines leasing as financing option of only completed products (vessels,
structures, plants, etc.). The existing law states that a leasing house can
buy and sell from the contractor exclusively through invoice, while altered
law allows buying and selling with natural persons resulting in wide range
of activities when it comes to financing vessels considering the fact a great
number of such on Adriatic are under ownership of natural persons.

Prestige etc. In Croatia SG Leasing d.o.o. uses international expertise for
business subjects, also due to its global contacts with contractors enables
Croatian users more favourable financing treatments. Now that Croatia
shall become EU member we believe further quality implementation of the
aforesaid financial arrangements on local, regional, European and world
market of vessels will proceed.
What are your leasing results for this year and how did you accomplish
these?
SG Leasing, as a part of Société Générale Group, exists inside Société Géné-
rale Split bank, and started with its operations in August 2008 and as of
2010 it has been developing financing of vessels and properties. In only four
years period due to quality approach to financing vessels and improvement
of business activities our work has resulted with market share of approxi-
mately 15% in the segment of financing vessels with continued service

i izvan granica RH, kao i osiguranje prijevoza plovila iz SAD-a, uz posredstvo
osiguranja Pantaenius.
Recite nam nešto o financiranju stranih pravnih/fizičkih osoba iz EU-a u
Hrvatskoj...
Logičan je slijed da će ulaskom RH u EU rasti interes za investiranje stranih
kompanija u svim segmentima gospodarstva. SG Leasing je stoga pripremio
modele financijske potpore svim tvrtkama koje prihoduju na hrvatskom trži-
štu, uključujući onima u vlasništvu nerezidenta, registriranih u Hrvatskoj, bez
obzira radilo se o pravnim ili fizičkim osobama. Za sve partnere spremni smo
prihvatiti razne modele osiguranja: bankovne garancije, korporativna jamstva,
depozite itd., što nam omogućava SG grupacija, koja sa svojom mrežom spada
u jednu od najvećih bankarskih institucija u svijetu.
Koje su vam glavne grupe klijenata i što im nudite danas i u skoroj bu-
dućnosti?
S obzirom na tešku gospodarsku situaciju, koja je uzrokovala značajan pad
prodaje motornih plovila, profilirale su se čarterske tvrtke koje se prvenstve-
no bave iznajmljivanjem jednotrupni i dvotrupnih jedrilica, kao i vlasnici takvih
plovila koji sklapaju s agencijama za iznajmljivanje ugovor o managementu. U
drugu grupu klijenata, ali nimalo manje važnu, spadaju privatne osobe i čarter-
ske tvrtke, koje nabavljaju manja motorna plovila. Kako su sekundarna vrijed-
nost financiranog objekta i projekcija budućeg poslovanja dvije od tri stavke
koje su bitne za donošenje konačne odluke o financiranju, klasične jedrilice i
katamarani su trenutno kvalitetan portfelj svake leasing kuće. Potražnja za
motornim plovilima duljim od 12 metara, a samim time i njihovo financiranje, u
budućnosti će se povećavati proporcionalno rastu gospodarstva u Hrvatskoj,
čemu se svi nadamo i priželjkujemo ga.

Tell us more about financing foreign legal entities/natural persons
from EU in Croatia…
Naturally as we enter EU interest of foreign investors in all economical
segments shall grow. Therefore SG leasing has prepared financial support
model for all companies with income on Croatian market, including those
under ownership of foreigners registered in Croatia, regardless of the fact it
refers to legal entities or natural persons. We are ready to accept a variety
of insurance models for all our partners: bank guarantees, corporative guar-
antee statements, deposits, etc. All enabled by SG Group, belonging to one
of the greatest bank institutions of the world.
What are your main client groups and what do you offer them today
and in the near future?
Considering harsh economical situation causing decrease in sale of motor
vessels, charter companies mainly dealing with renting sailing boats and
catamarans have survived, as well as owners of such vessels entering into
management contract with agencies. Another group of clients are private
persons and charter companies providing smaller motor vessels. Secondary
value of financed object and projection of future business activities rep-
resent two out of three elements essential for making the final financing
decision, classical sailing boats and catamarans are at the moment quality
portfolio of every leasing house. As Croatia grows economically so shall re-
quest for motor vessels longer than 12 m together with their financing. That
is what we all hope and wish for.
