2. INDIAN JUDICIAL SYSTEM
India has vast judicial system at every level
We have defined laws to be followed for almost every
crime
But let us see statistics
Only in supreme court there are over 67964 pending cases(as
of august 2013)
By solving 40 cases a day supreme court takes nearly 10 years
to solve this pending cases and what about the cases that adds
daily to this number
And imagine the total number of pending cases in every court
and time to solve them
Let us find out the reason for this and try to solve it
3. Problem 1(time for justice)
Example: consider the bofors case we are not able to
solve it even after 23 years
And we have invested more amount than the scandle but
we cannot solve it
And now the main accused katrochi is no more to solve
this case.
4. Problem 2(lack of coordination b/w various
departments)
Example: in india many cases are unsolved because there
is no coordination between various departments
If a case needs ny information from the cbi or any other
investigating or government organistion it should wait for
these to respond
This is making several crucial cases to delay
5. Problem 3(modernization)
In courts we are using stil using clipped file system
The world is moving so fast and we are not ready to
change
This is making a case to take lot of time than the case
required
6. Problem 4(outside pressures)
Example: we have seen many cases which are influenced
by outside pressures
For example the case of maharastrian girl abuse case
which is suspended by the court as she is a tribal.
And we have seen that the supreme court’s judgement on
the election procedure that a person in jail can’t
participate in elections is changed by the parliment
7. Solutions
There should be a specific time for the authorities to
solve the case
We have seen in cases where we have released the
prisoners during ic 814 hijack were responsible for attack
on parliament and other for training professionals for
attack on world trade center
So the justice but be instantaneous but fair
This require the coordination between various
departments
This can be possible by integrating all the organizations to
judiciary
8. solutions
A recent study states that if we intigrate all the courts by
any means we can solve all pending cases in india in just 3
years
And we are spending crores of rupees on investigation
but we are not leaving the traditional clipped file system
Courts should be the supreme power and no one should
change the courts judgement
