Contaminated Land Registers
Removing land from Queensland’s contaminated land registers can lift
associated restrictions on potential land use and positively impact land values
and future development opportunities.
There are two contaminated land registers. The Contaminated Land Registry
(CLR) lists contaminated sites that need remediationor management because
they present a significant danger to the environmental and/or human health.
Such contaminationcanresult from a past accident such as a chemicalspillage,
malpractice or poor waste management. When land is listed on the CLR, the
landowner is usually requiredto declare the contaminationto apotentialbuyer.
This could cause difficulties when selling or developing the site which could
negatively impact its commercialvalue.
The Environmental Management Registry (EMR) lists land where activities
involving dangerous substances have occurred or are occurring (a notifiable
activity).Landcanalso belistedontheEMRif thereis evidenceofcontamination
or future contamination. If a site is listed on the EMR, it indicates a high
probabilitythatthe land is contaminated,however,itdoes notnecessarilymean
that remediationis required. The actual contaminationstatus of a site listed on
the EMR should be determinedby a qualified environmentalconsultant.
To remove land from either the CLR or EMR, a landowner must prove that the
contaminationhas been remediatedor that the land can be made suitable for
any use. This is achieved througha site investigationreport or validation report
which incorporates asite suitability statement that is certified by an accredited
auditor.
Under theEnvironmentalProtectionAct1994,thesedocumentsarecalledCLIDs
(Contaminated Land Investigation Document) and must be prepared by a
“suitably qualifiedprofessional” (SQP).The auditor’s role is to confirm or refute

2. the site suitability statement and if suitable. This sign off is mandatory when
seekingto have a site removedfrom one ofthe registers.
