time
 In Packingham v. North Carolina (2017), the law
North Carolina had in placed violated the First
Amendment right to freedom of speech
 The O’Brien Test to help the courts narrow down if
“government regulations were within the
constitutional power of the government,” (Hopkins,
2019).

3. Recent Case Law
 The use of social media to target
 Colgate v. Juul Labs, Inc. (2019)
 Colgate claimed that this is false advertising stating
that companies like Juul should be more transparent
when it comes to the dangers of their product

 Hidy (2019)-social media can be discriminatory and
can display fraud to the viewers who use it,
suppressing speech
 The First Amendment should protect people from
social media fraud and other claims according to
Hidy (2019).
