Reporting EnforcementResearch
Unless we actively
have a strategy to
enforce our reporting
and research we will
never solve the
“Problem”
We have to “Know
What We Don’t
Know”- Basically we
need to dive deeper
into the unknown
We have to first
identify the “where”
and “what” details of
the problem that is
afflicting our property

Lorne Lipkus – Founding Partner & Lawyer - Kestenberg Siegal and Lipkus
David
As everyone might be aware of, I am a student of The Art of War.
I usually quote a time or two on each webinar, however today, lets start off with the very first words in the translation -
Who can help us in this matter?
What remedies do we have or What can I do?
Where do I go for Assistance?
When does this apply to me?
Why should I do this at all?
The Government - Canada Border Services Agency (CBSA)
An Agent – Kestenberg Siegla Lipkus – Lorne!
And as always, - I am here to help anyone get the correct information to move forward.
How does the new Combating Counterfeit Products program work?
ANSWER: The Agency has established a process that allows intellectual property rights (IPR) holders to file a request asking for the CBSA to temporarily detain suspected counterfeit goods encountered at the border while rights holders seek legal redress.
Where do I get started? What is the first step in this process?
Of course that is an easy answer for me – Call Lorne!! ;-)
But since we have Lorne with us today, Lets take sometime here and dive into the process!
Lorne…
When can we get started with this program?
If I am not mistaken Lorne, as of today we can start immediately. Correct?
Why, well in my world as it is, why is a very easy question to answer. Having seen in person facilities such as this one and the sheer volume of counterfeit products being shipped from Asia, One needs to protect not only their consumers but an obligation to protect the brand itself.
Counterfeit every year is on the rise, and not one industry is left un touched. I have seen just about everything counterfeited – Lorne, anything recently that is shocking that stands out? (Ref Contacts)
How does the process work. Well lets cut right to the number one question, COST?
Once we get past that, We can drive into the heart of the process and the steps to proceed.
The paperwork. Keeping it Simple!
