3. Non-Annexation Agreement
• A guarantee that the City will not annex the property
for a period of ten years unless the terms of the
agreement are violated
• A promise by the owner(s) to use the property in a way
that is consistent with the City’s A-O (Agricultural
Open) zoning district
• A promise by the owner that no person will file a plat
or related development document for the property
• A provision that a violation of the agreement by the
will constitute a petition for voluntary annexation

4. Request for Delayed Annexation
Background
• Property is subject to the terms of a ten year
non-annexation agreement (November 2007)
• Development has started on the property in
violation of the non-annexation agreement
• City could immediately move forward with
annexation, however, we received a request to
delay annexation until expiration of the
agreement (November 2017)

6. Staff Recommendation
Approve request to delay annexation but do not
specify the date of annexation
