On February 20, 2019, Missouri State Representative Chrissy Sommer (R-St. Charles, MO) knowingly, willfully, intentionally, and maliciously lied to the House Agriculture Policy Committee when she testified that HUD drafted the amendments to House Bill 107 (2019) and gave its' blessing - later identifying Don Baston, in her email, as the named source from HUD. However, on March 13, 2019, The U.S. Department of HUD, issued its investigative response denying that HUD took any part in drafting nor in reviewing House Bill 107 (2019).

Dear Mr. Cross:
Thank you for your inquiries to the U.S. Department of Housing and Urban
Development related to Missouri House Bill No. 107 (HB 107) on February 20 and 21,
2019. The Department has reviewed the matter and confirmed that HUD staff did not
approve or draft language for the proposed state legislation as purported. The
Department has notified Missouri House Representative Chrissy Sommer that HUD has
not approved or conducted a review of HB 107 and HUD will not be providing an
opinion on HB 107.
As a federal agency, HUD generally does not approve or disapprove of pending
local or state legislation except in narrow circumstances related to certification of a law
as substantially equivalent to the Fair Housing Act. Where a state or locality has sought
to have their ordinance or statute certified as substantially equivalent to the Fair Housing
Act, HUD follows the procedures set out in HUD’s regulations. See 42 U.S.C. 3610(f);
24 C.F.R. Part 115 Subpart B. The State of Missouri’s Human Rights Act is not currently
certified by HUD as substantially equivalent to the Fair Housing Act.
