Designs have been referred to as the aesthetic features of an article which thereby include within its ambit the shape, configuration, pattern, lines of composition or any colours applied to the article. The article consists of all the two-dimensional or three-dimensional features of an articles. These are the designs which are judged solely by the eye and does not include any representation of functionality or any mode or principle of construction.

1. Design Registration in India

an articles. These are the designs which are judged solely by the eye and does not include any
representation of functionality or any mode or principle of construction.
The pre-requisites required for the design registration are:
• The design must be new and novel.
• The design should not be disclosed to the public prior to its publication.
• Any kind of mechanical and technical mode of construction should not be included in
the product.
• The design must be devoid of scandalous or obscene matter
• The design must not be against any public order or morality.
The documents which are required for the registration of design are:
• Form – I accompanied with the prescribed fees.
• Representations of the design to be made along with the top, bottom, front, back,
isometric angles.
• Form – 21, which means the Power of Attorney
• Form-24, in case the Applicant is a small entity, which must be accompanied with the
MSME certificate.
Thus, it is pertinent to mention here that the designs if registered provide the registered
proprietors with the exclusive rights of protecting their designs and also take necessary actions
if there are any other designs being published in the market and also applied for registration
thereof.
