  1. Welcome to Degra Presentation on Worker Safety Committee and Representatives. Today I will demonstrate to you information on the topic to enable better understanding for you and therefore to be able to use this in your workplace. To better understand why we need to have Safety Worker Committees and reps, we will look at the areas in topic form so we do not get tied down in regulations and Act description and which will make Degra compliant with the required OHS workplace standards
  2. In terms of jurisdiction, Degra operates in the Construction industry covered within the Western Australia Jurisdiction. As such, Degra must follow and be compliable with Regulations and Acts under Western Australia State Regulation. For Degra to ensure they have a process that is in direct alignment to the correct jurisdiction they must follow the Acts and Regulations listed(Health Safety Representative, n.d)
  3. Here is the practical information on the more formal processes for consultation at the workplace, set out in the OSH Act and MSI Act. These are:• Elected safety and health representatives– theseemployees are elected by co-workers to represent them in consultation about safety and health matters with the employer. They must be:- elected according to a process set out in the OSH Act and MSI Act, Follow the functions set out for them to perform at the workplace, such as liaising with employees on safety and health issues and reporting hazards to the employer• Safety and health committees– These are formal safety and health groups that provide regular forum for discussion on safety and health matters. They must be set up according to requirements in the OSH Act and MSI Act. They are required to perform specific functions in the workplace, such as making recommendations on safety and health matters And• Issue resolution procedures– the OSH Act and MSI Act set out a specific processes for dealing with safety and health issues at the workplace in a consultative manner and the need to resolve them as they arise. These both require the development of an agreed issue resolution procedure. If one is not in place, a default procedure must be used, as set out in the Occupational Safety and Health Regulations (the OSH Regulations) or the Mines Safety and Inspection Regulations (the MSI Regulations).The setting up formal processes, involving employers, employees and others at the workplace, to work towards improving safety and health outcomes. (Commission for occupational health safety, 2006)Consideration could also be given to less formal workplace arrangements that may assist in meeting the requirement to consult and cooperate with employees on safety and health. For example:• making safety and health a standing agenda item at workplace meetings, eg on staff, team and/or employee representatives’ committee meetings; • ensuring safety is discussed at toolbox meetings• implementing email safety bulletins or newsletters to encourage discussion and feedback on issues.• Incorporating OH&S responsibility into all employees KPI’s(Commission for occupational health safety, 2006)

There is a five steps framework involved in establishing a committee:, This is quiet lengthy put I will try to give you the relevant information Step one:an employee makes a request, an employer receives a notice or anemployer decides to set up a committeeA safety and health committee must be established when:there is a regulation requiring one be establishedor the employer receives a notice from the WorkSafe Western Australia Commissioner or StateMining Engineer requiring them to establish one.or an employee who works at the workplace requests the employer establish one  Alternatively, an employer may on their own initiative decide to establish a safety and healthcommittee, without there being a legal requirement for them to do soThe safety and health committee must be established in the way agreed between the employer, the employee representatives and any safety and health representatives for the workplace . or, where they could not agree refer the matter the bodies mentioned previouslyThe safety and health committee must be established within three months, except if the WorkSafe Western Australia Commissioner or State Mining Engineer allows a longer period. (Commission for occupational health safety, 2006) Step two: notify employee and safety and health representatives When an employee makes a request to the employer to establish a safety and health committee, the employer must within 21 days: notify the employee and any safety and health representatives that they agree to the requestOrwhere they consider it unnecessary, refer the matter to the WorkSafe Western Australia Commissioner or State Mining Engineer. And notify the employee When the WorkSafe Western Australia Commissioner or State Mining Engineer has made a decision, the employer and employee will be notified.(Commission for occupational health safety, 2006) Step three: Employees appoint ‘employee representatives’ and do so by appointing one or more ‘employee representatives’ from the workplace to take part in consultation with the employer and any safety and health representatives on matters relating to the safety and health committee.(Commission for occupational health safety, 2006) Step four: consult and obtain agreement on the composition of the safety and health committeeThe employer, appointed employee representatives and any elected safety and health representatives needagree on:The make up of the safety and health committee; and how people will become members of it.Membership of the safety and health committee will have at least half made up of representatives of the employees. The consulting parties may agree these members can be either safety and health representatives or other workplace employee representatives, or any combination of these two. There is no restriction on the remaining members of the committee and can be made up of the employer(s) and/or their representative(s).Consideration should be given to including on the committee: •members familiar with the various workplace activities and hazard identification for them and with an understanding of safety and health legislation; •members who are able to facilitate implementation of workplace safety and health policies and procedures once developed; and •and be involved intraining of safety and health where they have completed an appropriatetraining courses Once these matters have been decided, the agreement must be put into writing. If it is proposed the committee cover more than one workplaceThe consulting parties will have to reach agreement on:•whether the safety and health committee covers all the workplaces and, if so, how this will be done;•its composition. •how people become members;•how the arrangements can be changed in the future; and•if considered necessary, how to provide for sub-committees. The agreements in relation to all these matters must be in writing and copies should be kept.Where agreement cannot be reached on the composition and manner in which people become members, the matters may be referred to the WorkSafe Western Australia Commissioner or State Mining Engineer to assess the situation and decide on a solution. Varying or abolishing the committeeSafety and health committees can be varied or abolished if they no longer suit the needs of the workplace. This can occur by written agreement between the employer and members of the safety and health committee. Again if no agreement can be reached the matter can be referred in the usual manner  (Commission for occupational health safety, 2006) Step five: start the safety and health committee Once agreement is reached on the safety and health committee’s composition, how people become members and in some instances its coverage, it can begin to operate.
