Good afternoon, my name is Rob Simpson and I serve as Assistant Chief of Staff to Superintendent Carter for the Indiana
State Police. The Indiana State Police serves as the CJIS System Agency (CSA) and is responsible for administering and
safeguarding criminal justice information and its technology services throughout the CSA's user community. I serve as
the CJIS System Officer, and I am responsible for the administration of the CJIS network for the CSA.
CJIS Policy violations have been brought to my attention that are occurring within the Constables of Marion County
which has caused me to review access provided to these agencies. In reviewing this access, I have observed your agency
having an issued ORI to run both IDACS and CJIS data. This is a violation of CJIS Security Policy.
The Constables for Marion County are found under Title 33: Courts and Court Officers. Contained within Title 33 is the
definition and responsibilities of Constables and deputy constables.
IC 33-34-6-4 - Constable; election; deputies; compensation
Sec. 4. (a) The voters of each township having a small claims court shall elect a constable for the small claims court at
the general election every four (4) years for a term of office of four (4) years, beginning January 1 after the election and
continuing until a successor is elected and qualified. As stated in the above Indiana statute, Constables are elected for the
small claims court to carry out the orders of the court.
CJIS Security Policy and Code of Federal Regulations (CFR), 28 CFR Part 20 defines a Criminal Justice Agency (CJA) as
a governmental agency which performs the administration of criminal justice pursuant to a statute and which allocates a
substantial part of its annual budget to the administration of criminal justice. CJIS security policy further defines the
administration of Criminal Justice as: “The detection, apprehension, detention, pretrial release, post-trial release,
prosecution, adjudication, correctional supervision, or rehabilitation of accused persons or criminal offenders.”
In conclusion, the constables in Marion County receive their authority from Title 33 which provides their primary
function to carry out the orders of the court and the office of constable does not meet the definition of a Criminal Justice
Agency as defined by CJIS Security Policy and 28 CFR part 20. Therefore, it is the determination of this office to disable
your ORI and inform your terminal agency that you are no longer eligible to receive Criminal Justice Information from
