- 3. California Law Protects Employees’ Rights to Social Media Privacy Beginning on January 1, 2013, California employers experienced new legal mandates. One significant change states that employers cannot require employees to provide access to private social media content. California represents the third state to institute "password protection" laws, behind Illinois and Maryland.

California Law Protects Employees’ Rights to Social Media Privacy Under the new "Employer Use of Social Media" law, employers cannot ask applicants or employees to disclose their social media account names and passwords or "shoulder surf" by requiring employees to access social media in their presence. In addition, the law prevents an employer from disciplining any employee who refuses to divulge personal social media information. However, the law does allow employers to request an employee provide content relevant to an investigation if there is reason to suspect employee misconduct or a legal violation.
