Dear Ms. Bose:
This response on behalf of Crown Hydro, LLC (“Crown Hydro”) provides supplementary
information relating to the Crown Hydro’s progress in the development of the hydroelectric
facility pursuant to License No. 11175-024. As reported previously in its June 23, 2011
Response to May 25, 2011 Show Cause Letter, Crown Hydro sought the passage of legislation
during the regular term of the 2011 Minnesota Legislature to provide legislative inducements to
ensure the Minneapolis Park and Recreation Board (“MPRB”) provide authorizations, consents
and approvals necessary to facilitate the development of the hydroelectric facility beneath MPRB
lands consistent with the renewable energy mandates set forth in Minnesota Statutes
Chapter 216B. The Minnesota Legislature concluded its regular session in May of 2011, with a
great deal of unfinished business, including the failure to pass HF 1440 or SF 1191.
A special legislative session this summer was anticipated and Crown Hydro committed to
reporting to FERC regarding its legislation, HF 1440/SF 1191 after the conclusion of that
session. A special legislative session was convened and concluded on July 19, 2011, but was
strictly limited to addressing state budget issues. To address the substantial unfinished
legislative business this year, it is anticipated that Governor Dayton will convene another special
legislative session sometime in October or November of 2011. We have commitments from the
legislative leadership to seek passage of HF 1440 and/or its Senate companion SF 1191 in that
session.
In addition to Crown Hydro’s efforts to secure legislative resolution of its need for site
control, Crown Hydro engineers have been working vigorously on securing pricing for the
construction of the facility consistent with current plans and specifications. Crown Hydro is also
exploring the development of the facility within the licensed area that would allow the
development of the facility without the requirement of MPRB consents and entitlements. This
work is ongoing.
Crown Hydro respectfully requests that the FERC continue to defer action with respect to
any license termination proceedings until such time as the anticipated special session is over and

it is known whether HF 1411/SF 1191 or something substantially similar has been passed into
law. Within 30 days of the end of the special session, Crown Hydro will provide FERC a further
update, at which time FERC will have more information from which to make any decisions
affecting Crown Hydro’s license.
