See it…

Prevent it…
Presented By
Tiana Victoria Hercules, Esq.
Counsel and Vice President at Hercules Helping Hands
Elder Abuse:
—Any form of mistreatment, even by a family
member, that results in harm or loss to an older
person.
Troubling Statistics
Types of Elder Abuse:
• Physical Abuse: use of physical force that may result in bodily injury, pain
or impairment.
• Financial Abuse: illegal or improper use of an adult’s resources through
deceit, theft, coercion, fraud, undue influence or other means.
• Emotional Abuse: infliction of anguish distress or intimidation through
verbal or non-verbal acts or threats.
• Sexual Abuse: Non-consensual sexual contact, harassment,
inappropriate comments or threats. Consider nonconsensual if the person
does not make, or is incapable of making an informed choice.
• Neglect (Intentional and Unintentional): Failure to provide the basic
necessary care or services when such failure may lead to harm or risk of
serious harm.
A Case of Elder Abuse?
Types of Elder Abuse:• Abandonment: Caregiver’s desertion places the adult in serious risk of harm.
• Social Abuse: Confinement, restriction or isolation of an adult for the convenience of a caregiver or to
discipline the adult.
• Wrongful restraint: The use of a chemical restraint to limit the movement of an adult for the
convenience of the caregiver or to discipline the adult.
• Abduction: Removal from this state and the restraint from returning to this state, of an elder or
dependent adult who does not have the capacity to consent.
• Domestic Violence in Later Life: abusive use of power and control by a spouse/partner or other
person known to the victim.
• Healthcare Fraud & Abuse: carried out by unethical doctors, nurses, hospital personnel and other
professional care providers…It may include…
• Not providing healthcare, but charging for it
• Over-charging or double billing for medical services
• Over medicating or under medicating
• Recommending fraudulent remedies for illnesses or other medical conditions
Why Elder Abuse?
• As elders become more physically frail, they are less able
to stand up to bullying or fight back if attacked.
• Elders are often dependent upon the abuser
• Elders may be socially isolated
• Hesitant to use the social service system
• Elders may not see or hear as well, or think as clearly as
they once did
Fact or Fiction
Women are more likely to be abused
than men…
Adult sons and daughters are the single
biggest category of abusers…
