Dear Readers:
Last week David Nachman, Esq., one of the Managing Attorneys at
Nachman Phulwani Zimovcak (NPZ) Law Group, P.C., attended
the AILA National Day of Action (NDA) in Washington
DC. Along with other delegates from the State of NJ, he met with
House and Senate Representatives on Capitol Hill to discuss such
issues as: (1) the need for Comprehensive Immigration Reform
(CIR); and (2) the value that legal immigration brings to the US;
and (3) the need to increase the H-1B cap. We outlined the
historical timeline of our current business immigration practice with
respect to H-1Bs, its current state and the projected continued
negative impact on our Nation's businesses if the H-1B cap is not
increased.
We also explained the unintended consequences on our universities
and colleges resulting from our broken business immigration
process. We also discussed the Fair Day in Court Act, CIR with
respect to family unity and "DREAMERS" (and their parents) and
family detention. For the past two decades, members of the NPZ
Law Group have attended AILA's NDA. In the past we had often
encountered "resistance" from Congressional staff. This year, rather
than resistance, we encountered "frustration". It seemed like some
Representatives were looking for ways to get things done
immigration-wise but they did not know how to do it.
Other notable developments in the U.S. immigration and nationality
law arena during the past several weeks include: (1) an
announcement about a new N-400 Naturalization Application
which will be effective on August 10th, 2016; and (2) The

FY 2017 H-1B CAP REACHED: NOW IS THE TIME TO
THINK ABOUT YOUR H-1B BACK-UP PLAN.
On April 7th, 2016, U.S. Citizenship and Immigration Services
(USCIS) announced that it has reached the congressionally
mandated H-1B cap for fiscal year (FY) 2017. USCIS also received
more than the limit of 20,000 H-1B petitions filed under the U.S.
advanced degree exemption.
USCIS received over 236,000 H-1B petitions during the filing
period, which began April 1st, including petitions filed for the
advanced degree exemption. On April 9th, USCIS used a computer-
generated random selection process, or lottery, to select enough
petitions to meet the 65,000 general-category cap and the 20,000
cap under the advanced degree exemption. With uncertainty
looming large as to who may or may not get selected in the H-1B
lottery, it is time that H-1B visa hopefuls (and their prospective H-
1B employers) start to explore other nonimmigrant work visa
options to allow them to work and live in the United States on a
temporary basis.
This article is timely in nature and it seeks to capture and present
some of the possible nonimmigrant work visa options that may be
available to prospective H-1B visa beneficiaries who may not get
selected in the H-1B visa lottery this fiscal year.

On April 7th, 2016, USCIS announced that it has received enough
H-1B petitions to reach the statutory cap of 65,000 visas for fiscal
year (FY) 2017. USCIS has also received more than the limit of
20,000 H-1B petitions filed under the advanced degree exemption,
also known as the master's cap.
USCIS received over 236,000 H-1B petitions during the filing
period, which began April 1, including petitions filed for the
advanced degree exemption. On April 9, USCIS used a computer-
generated random selection process, or lottery, to select enough
petitions to meet the 65,000 general-category cap and the 20,000
cap under the advanced degree exemption. USCIS will reject and
return all unselected petitions with their filing fees, unless the
petition is found to be a duplicate filing.
USCIS will continue to accept and process petitions that are
otherwise exempt from the cap. Petitions filed on behalf of current
H-1B workers who have been counted previously against the cap
will also not be counted towards the congressional mandated FY
2017 H-1B cap.

much-needed overhaul of the nation's immigration system.

system. We visited both House and Senate offices to educate and
inform Members of Congress and their staff about what the costs of
inaction really mean for communities in the State of New Jersey
and throughout the United States. I was glad to take part in this
unique opportunity to join with colleagues, clients, coalition
partners, and other AILA members, to ask Congress to advance
concrete proposals that will bring our dysfunctional immigration
system into the 21st Century," David Nachman said.

Naturalization. The revised version is available at

AS THE DEADLINE TO APPLY FOR CITIZENSHIP
AND INTEGRATION GRANTS.
USCIS recently announced that all the applicants for Citizenship
and Integration Grant Program for fiscal year 2016 are due by
11:59 p.m.
Eastern time on April 22nd, 2016
. On March 2nd
, the
USCIS began accepting applications for two competitive grant
opportunities for organizations that prepare permanent residents for
naturalization and promote civic integration through increased
knowledge of English, U.S. history and civics.
The first opportunity, Citizenship Instruction and Naturalization
Application Services -DHS-16-CIS-010-002, is for public or
nonprofit organizations that prepare permanent residents for
citizenship by offering both citizenship instruction and
naturalization application services. The second
opportunity, Citizenship Instruction - DHS-16-CIS-010-001, is
limited to citizenship instruction only. It is intended to help
nonprofit organizations in their efforts to establish new citizenship
instruction programs or to expand the quality and reach of existing
ones.

CHINA F4: The level of applicant demand being received has
begun to increase. Should this pattern continue, it will be necessary
to either hold or retrogress this final action date in late summer.
That action would be necessary to hold number use within the
overall China Family-sponsored annual limit.
INDIA F4: The amount of demand being reported for applicants
with priority dates which are significantly earlier than the
established cut-off date has increased dramatically in recent
months. As a result, it is likely that this final action date will be
retrogressed, possibly as early as June. This action would be
necessary to hold number use within the overall India Family-
sponsored annual limit.
