「強求的意見統一,只能帶來墓園般的和諧一致」:美國國旗案判決
的省思」
美國的學校沒有升旗典禮,但是西維吉尼亞州政府於 1942 年一月,要求各
級公立學校必須使「向國旗敬禮」的典禮成為常態活動。所有師生都必須參與,
並且對著國旗僵直手臂,宣讀誓詞:「我對美利堅合眾國的國旗及其代表的共和
國宣誓效忠;斯是邦國,無可分裂,自由正義,及於人人」(I pledge allegiance to
the Flag of the United States of America and to the Republic for which it stands; one
Nation, indivisible, with liberty and justice for all. )。
親師總會、童子軍、紅十字會及婦女總會都對此提出抗議,他們認為這樣的
典禮太像希特勒的做法;小眾教派「耶和華見證人」的信眾,也認為除了對神之
外、他們不該也不會對其他「偶像」(包含國旗)行禮。但是,拒絕參與典禮的
代價是被迫離校,而且在願意參與之前不得恢復學籍;此外,由於這是「非法缺
課」,學童的家長更可能面臨罰款甚至拘役的處分。
這個處分無寧是嚴峻的。但大法官的重點並不是處分的嚴峻與否,而是:沒
有任何權威,有權力要求人們參與這種典禮。
判決主筆大法官 Jackson 首先界定這個問題,乃是「強要學生表達一定的信
念」(a compulsion of students to declare a belief )。他討論象徵物及相關動作的意
義:
向國旗敬禮──併同宣誓──無疑是一種意見表達。象徵作為一種溝通的方
式,原始、但是有效。使用圖徽或者旗幟以象徵某些系統、想法、機制
或人格,乃是心靈之間的捷徑(...)常與這些象徵物相關的,則是某些適
當的、表達接受或尊敬的動作:比如敬禮、鞠躬、脫帽、以及屈膝。
There is no doubt that, in connection with the pledges, the flag salute is a form
of utterance. Symbolism is a primitive but effective way of communicating
ideas. The use of an emblem or flag to symbolize some system, idea,
institution, or personality is a short-cut from mind to mind(...) Associated
with many of these symbols are appropriate gestures of acceptance or respect:
a salute, a bowed or bared head, a bended knee.
而既然,對國旗敬禮等動作,是具有象徵意義的,是能夠表達特定意見的;
那麼,以強制為後盾的「效忠典禮」,當然就是對言論自由的威脅,多數意見說:
16. 同時必須注意的是:強制向國旗敬禮和效忠,意味著肯認特定的信念以
及意向。我們並不清楚,這樣的規制是否強迫學生捐棄一切相對的想法,
而不情不願地參與典禮、成為改信之人;又或者,這些學生若是藉著誦
讀他們不相信的文字、比劃無意義的動作而假裝同意,乃是可以接受的。
如今已成共識的是:對言論的事先檢查或者對意見表達的壓迫,只有在
相關的言論表達將導向一個「政府有權預防並處罰的、清楚而立即性的
危險行為」時,方是我們的憲法所容忍的。而與(按:審查與壓迫造成
的)沉默相比,推動非自願的表態,看來只能基於更急迫且緊急的情況。
但現在,當強制的權力被使用之際,卻實無可斷言:不主動參與向國旗
行禮的典禮,究竟是否會造成一個清楚而立即的危險,以致任何(就算
只是)掩蓋意見表達的作為得以正當化。如果對於強迫人們國旗敬禮,
我們竟選擇支持,那我們就不得不以為:保障個人表達自己意見的權利
法案,竟然也容許權威要求個人表達某些想法──雖然他根本不那麼想。
It is also to be noted that the compulsory flag salute and pledge requires
affirmation of a belief and an attitude of mind. It is not clear whether the
regulation contemplates that pupils forego any contrary convictions of their
own and become unwilling converts to the prescribed ceremony, or whether it
will be acceptable if they simulate assent by words without belief, and by a
gesture barren of meaning. It is now a commonplace that censorship or
suppression of expression of opinion is tolerated by our Constitution only
when the expression presents a clear and present danger of action of a kind
the State is empowered to prevent and punish. It would seem that involuntary
affirmation could be commanded only on even more immediate and urgent
grounds than silence. But here, the power of compulsion is invoked without
any allegation that remaining passive during a flag salute ritual creates a
clear and present danger that would justify an effort even to muffle expression.
To sustain the compulsory flag salute, we are required to say that a Bill of
Rights which guards the individual's right to speak his own mind left it open
to public authorities to compel him to utter what is not in his mind.
換句話說,重點不是處罰長什麼樣,也不是「在有強制力的情形下,人們到
底可不可以有口無心」(其實在台灣,許多參與朝會的同學,或許就是如此),而
是:從來沒有任何權威,可以要求人們去參與一個表達特定意念的集會!
所以,什麼人、基於什麼樣的信念(比如耶和華見證人)而拒絕參加,那是
不重要的。愛國主義、國家的統一到底好不好,也不需討論。重要的是,沒有任
何人可以「決定在政治、國族、宗教或其他方面的意見之中孰為正統」,也沒有
任何權威,可以要求人們去從事特定的表態。
17. 判決書中有其他精彩的批判,筆者於此便不再贅述,值得注意的是,在前述
的脈絡下,主筆大法官寫下了一段後世廣為引用的話:
許多的人,或善或惡,都曾為著在他們那時候、在他們國家被認為不可
或缺的目標,而致力於強求某些意見的統一(...)或許,在所有的倡議
之中,會在我們的人民中造成最大歧見的,莫過於以為找出以下這個問
題的答案是必要的:教育界的有權者,應當選擇哪些教條或誰的規劃,
強使年輕人全部團結一致,以為「吾黨之所宗」(...)開始強力消除異議
的人,很快的就將發現自己正在屏除異議者。強求的意見統一,只能帶
來墓園般的和諧一致。
Struggles to coerce uniformity of sentiment in support of some end thought
essential to their time and country have been waged by many good, as well as
by evil, men. (...) Probably no deeper division of our people could proceed
from any provocation than from finding it necessary to choose what doctrine
and whose program public educational officials shall compel youth to unite in
embracing. (...)Those who begin coercive elimination of dissent soon find
themselves exterminating dissenters. Compulsory unification of opinion
achieves only the unanimity of the graveyard.
言論自由是必須捍衛的,也是有益的;而保障言論自由,意味著容許出格、
容許不從眾。就此而言,捍衛言論自由是有其「代價」的,有的時候,我們必須
不惜代價──但是我們根本還不需要講這麼多,畢竟,「不舉辦有強制性的愛國的
典禮」,代價又能有多高?
也因此,美國最高法院在 1943 年就指出:愛國好不好,不重要。有多少人、
憑著什麼理由,不願參加「愛國的」儀典,不重要。不參加愛國典禮的處罰是什
麼,也不重要。重要的是:奉言論自由之名,我們不容許任何的權威,要求我們
參與任何一個表達特定意念的典禮!
「國家對一切宗教或信念應保持中立」:德國十字架判決的省思
而德國聯邦憲法法院的判決,提供了更多思考的切面,比如:灌輸信念跟教
育有什麼不同?「自願」與決定的意義是什麼?以及或許更基礎的:象徵物的意
義是什麼?
巴伐利亞邦國民學校法第十三條第一項規定「每個教室皆應懸掛十字架」(In
jedem Klassenzimmer ist ein Kreuz anzubringen.);1991 年,一對養育三個學童的
「史坦耐教派」的信徒,以自己及其子女為原告,訴請邦政府撤除其子女所就讀
18. 的學校的教室中所有十字架,並在假處分聲請被駁回之後提出憲法訴願。
德國聯邦憲法法院於 1995 年做出判決,宣告系爭法規違反德國基本法第四
條第一項「信仰與良心之自由及宗教與世界觀表達之自由不可侵犯」(Die Freiheit
des Glaubens, des Gewissens und die Freiheit des religiösen und weltanschaulichen
Bekenntnisses sind unverletzlich.)。
多數意見首先處理宗教(以及良心、信仰、世界觀)自由的意涵,不僅在於
政府不干預個人信仰,也包含了中立義務:
基本法第四條第一項,並不僅止於拘束國家不得干預個人或宗教社群對
於宗教的信念、行為以及呈現。實則,其進一步導出了國家保障人們「就
世界觀以及宗教發展自己人格」的空間的義務(參照 BVerfGE 41, 29 [49]),
以及保護人們免於受其他宗教信仰或相競爭的宗教團體的信徒的攻擊或
阻礙。原則上,基本法第四條第一項,並未使個人或者宗教團體得以主
張,其得藉由國家的支援宣揚其信念。相對的,從基本法第四條第一項
的思想自由條款可以導出國家對各種宗教與信念的中立性。只有在國家
對於信念維持中立時,這個有不同信仰與世界觀的人們共同生活的國家,
才可能保證是和平、共生的。
Art. 4 Abs. 1 GG beschränkt sich allerdings nicht darauf, dem Staat eine
Einmischung in die Glaubensüberzeugungen, -handlungen und
-darstellungen Einzelner oder religiöser Gemeinschaften zu verwehren. Er
erlegt ihm vielmehr auch die Pflicht auf, ihnen einen Betätigungsraum zu
sichern, in dem sich die Persönlichkeit auf weltanschaulich-religiösem Gebiet
entfalten kann (vgl. BVerfGE 41, 29 [49]), und sie vor Angriffen oder
Behinderungen von Anhängern anderer Glaubensrichtungen oder
konkurrierender Religionsgruppen zu schützen. Art. 4 Abs. 1 GG verleiht dem
Einzelnen und den religiösen Gemeinschaften aber grundsätzlich keinen
Anspruch darauf, ihrer Glaubensüberzeugung mit staatlicher Unterstützung
Ausdruck zu verleihen. Aus der Glaubensfreiheit des Art. 4 Abs. 1 GG folgt
im Gegenteil der Grundsatz staatlicher Neutralität gegenüber den
unterschiedlichen Religionen und Bekenntnissen. Der Staat, in dem Anhänger
unterschiedlicher oder gar gegensätzlicher religiöser und weltanschaulicher
Überzeugungen zusammenleben, kann die friedliche Koexistenz nur
gewährleisten, wenn er selber in Glaubensfragen Neutralität bewahrt.
