Clean Water Act
• Originally enacted in 1948 to control water pollution
primarily based on state and local efforts
• In 1969 Ohio’s Cuyahoga River was so fouled by
industrial pollution that the river caught on fire
• Public outcry over dirty rivers spurred Congress to pass
the landmark Clean Water Act in 1972
• The Act embodied a new federal-state partnership,
where federal guidelines, objectives and limits were to
be set under the authority of the U.S. EPA
• Purpose is to prevent oil and oil-related materials from
reaching navigable waters and adjoining shorelines

Purpose of SPCC Rule
• SPCC stands for Spill Prevention Control and Countermeasures
• Part of the Clean Water Act found in 40 CFR part 112 and is
regulated by the EPA
• The purpose is to prevent oil discharges from reaching
navigable waters of the U.S. or adjoining shorelines
• To ensure that preventive measures are taken to avoid oil
discharges
• To ensure that effective/proactive measures are used in
response to an oil discharge

What types of oil are covered?
• Oil of any type and in any form is covered, including,
but not limited to: petroleum; fuel oil; sludge; oil
refuse; oil mixed with wastes other than dredged spoil;
fats, oils or greases of animal, fish, or marine mammal
origin; vegetable oils, including oil from seeds, nuts,
fruits, or kernels; and other oils and greases, including
synthetic oils and mineral oils.

Any site that stores, processes, refines, uses or
consumes oil and is a non-transportation-related
operation is subject to the SPCC rule
Three criteria for a facility to be subject to SPCC Rules:
1. Must be non-transportation-related.
2. Aggregate aboveground storage capacity greater than 1,320 gallons.
3. Reasonable expectation of a discharge into or upon navigable waters of
the US or adjoining shorelines.

containment

•A facility that meets the criteria described must comply with the
SPCC rule by preventing oil spills and developing and
implementing an SPCC Plan.

is 7.48 gallons/ft^3
• What is the tank volume?(remember to add
10%)
• What footprint can you work with?
• Make sure you qualify the application for
potential chemical exposure

• Customer has a 5,000 gallon tank. What size berm will they need?
• Step 1: Add 10% freeboard volume
• 110%(5,000) = 5,500 gallons
• Step 2: Convert gallons to ft3
• 5,500 gallons/(7.48 gal/ft3) = 735.29 ft3
• Step 3: Divide out your wall height
• 735.29 ft3/(1 ft) = 735.29 ft2
• Step 4: Determine what physical area your berm can occupy
• 735.29 ft2/12 ft wide = 61.3 ft Long

• Customer has a 200 gallon tank on a utility vehicle that has a 5ft x 8ft
footprint. What size berm will they need?
• Step 1: Add 10% freeboard volume
• 110%(200) = 220 gallons
• Step 2: Convert gallons to ft3
• 220 gallons/(7.48 gal/ft3) = 29.5 ft3
• Step 3: Divide out your wall height
• 29.5 ft3/(2/3 ft) = 44.25 ft2
• Step 4: Determine what physical area your berm can occupy
• 44.25 ft2/ 6 ft wide = 7.5ft Long
• Answer 6’x8’x8” = 6’x8’x(8/12)ft x7.48 = 239 Gallons
• Or for a stock size 6’x8’x1’ Rigid Lock QuickBerm
= 6’x8’x1’x7.48 = 359 gallons
