Huraikan secara ringkas isu kekuatan sesebuah keterangan qarinah dari
perspektif prinsip kerelevanan dan kebolehterimaan dalam sesuatu perbicaraan
kes syariah.
2.0 Answer
Qarinah in literal meaning is connection. In legal perspective, qarinah is
inference drawn from circumstances.
Qarinah can be ruled as relevant and admissible if it is adduced in strongest
form. The strength is determined by looking at every piece of evidence
individually and by gauging its corroborative value collectively. A strong qarinah
enables the syariah court to convict the accused for offences which warrant hudud
and qisas punishments.
The application can be seen in in DNA evidence, where it will become
relevant and admissible in court once its corroboration is established.
Uncorroborated DNA evidence has no evidential value at all. DNA evidence as
qarinah can show the crime commission, suspect’s involvement and guilt. To
maintain its strength, every stage of the DNA sample must be carefully recorded
and established during trial. And at the end of trial, the accused will be convicted
upon proof of a firm corroboration between forensic evidence and other available

crime. This illustrates how qarinah can be admissible and relevant when it is
adduced in strongest form, that is by being corroborated and handled carefully at
all stages.
In conclusion, qarinah is legitimate evidence and a strong qarinah is
important tool to convict an accused with hudud or qisas offence if the standard
of yaqin is fulfilled. However if such qarinah fails to meet either standard of
proofs, an accused may be acquitted without any punishment at all. The hadith of
Prophet Muhammad S.A.W stated, “Avoid punishments so long as there is room
for avoiding them,” and “Keep the Muslims away from punishments wherever
possible and If there is any way out for an offender to escape punishment, acquit
him.”
