What is Will
• "will" means the legal declaration of the
intention of a testator with respect to his
property which he desires to be carried into
effect after his death.
Indian Succession Act, 1925 (ISA) 2(h)

REQUIREMENTS OF A VALID WILL
• 59. Person capable of making wills. -Every person of sound mind not
being a minor may dispose of his property by will.
• Explanation 1.--A married woman may dispose by will of any property
which she could alienate by her own act during her life.
• Explanation 2.--Persons who are deaf or dumb or blind are not
thereby incapacitated for making a will if they are able to know what
they do by it.
• Explanation 3.--A person who is ordinarily insane may make a will
during interval in which he is of sound mind.

• Explanation 4.--No person can make a will while he is in such a state of mind,
whether arising from intoxication or from illness or from any other cause that he
does not know what he is doing.
• Illustrations
• A can perceive what is going on in his immediate neighborhood, and can answer
familiar questions, but has not a competent understanding as to the nature of his
property, or the persons who are of kindred to him, or in whose favour it would be
proper that he should make his will. A cannot make a valid will.
• A executes an instrument purporting to be his will, but he does not understand
the nature of the instrument, nor the effect of its provisions. This instrument is
not a valid will.
• A, being very feeble and debilitated, but capable of exercising a judgment as to
the proper mode of disposing of his property, makes a will. This is a valid will.
PROPERTY WHICH MAY BE DISPOSED OFF
UNDER WILL
A Hindu may dispose of by will or other testamentary disposition any
property (including his share in undivided coparcenary property), which
is capable of being disposed of by him.
Registration of Will
18. Documents of which registration is optional
Any of the following documents may be registered under this Act, namely:-
(a) instruments (other than instruments of gift and wills) which purport or operate to create, declare, assign, limit or extinguish,
whether in present or in future, any right, title or interest, whether vested or contingent, of a value less than one hundred rupees, to
or in immovable property;
(b) instruments acknowledging the receipt or payment of any consideration on account of the creation, declaration, assignment,
limitation or extinction of any such right, title or interest;
(c) leases of immovable property for any term not exceeding one year, and leases exempted under section 17;
(cc) instruments transferring or assigning any decree or order of a court or any award when such decree or order or award purports or
operates to create, declare, assign, limit or extinguish, whether in present or in future, any right, title or interest, whether vested or
contingent, of a value less than one hundred rupees, to or in immovable property;
(d) instruments (other than wills) which purport or operate to create, declare, assign, limit or extinguish any right, title or interest to
or in movable property;
(e) wills; and
(f) all other documents not required by section 17 to be registered.
Revocation
• Will may be revoked or altered. -A will is liable to be
revoked or altered by the maker of it at any time
when he is competent to dispose of his property by
will.

Revocation
70. Revocation of unprivileged will or codicil. -No unprivileged will or codicil,
nor any part thereof, shall be revoked otherwise than by marriage, or by
another will or codicil, or by some writing declaring an intention to revoke
the same and executed in the manner in which an unprivileged will is
hereinbefore required to be executed, or by the burning, tearing, or otherwise
destroying the same by the testator or by some person in his presence and by
his direction with the intention of revoking the same.

• A has made an unprivileged will. Afterwards, A makes another unprivileged
will which purports to revoke the first. This is a revocation.
• A has made an unprivileged will. Afterwards, A, being entitled to make a
privileged will, makes a privileged will, which purports to revoke his
unprivileged will. This is a revocation.

• Above 18 years of age and mentally competent but not blind
• Ideal witnesses
• Expect witness to outlive you
• Signing without pressure
• Testator have the mental capacity and intent to make a will
• Avoid conflict of interest

• Must specify that his intent should be carried out after the testator’s death
• Where one of the natural heirs is to be disinherited, reasons be stated

Will and Testament

  • 2. What is Will • "will" means the legal declaration of the intention of a testator with respect to his property which he desires to be carried into effect after his death. Indian Succession Act, 1925 (ISA) 2(h)
  • 3. Types of WILL Simple or Comprehensive Joint ConcurrentMirror Privileged or UnprivilegedHologrpah Mutual Conditional or Contingent
  • 4. REQUIREMENTS OF A VALID WILL • 59. Person capable of making wills. -Every person of sound mind not being a minor may dispose of his property by will. • Explanation 1.--A married woman may dispose by will of any property which she could alienate by her own act during her life. • Explanation 2.--Persons who are deaf or dumb or blind are not thereby incapacitated for making a will if they are able to know what they do by it. • Explanation 3.--A person who is ordinarily insane may make a will during interval in which he is of sound mind.

Conti… • Explanation 4.--No person can make a will while he is in such a state of mind, whether arising from intoxication or from illness or from any other cause that he does not know what he is doing. • Illustrations • A can perceive what is going on in his immediate neighborhood, and can answer familiar questions, but has not a competent understanding as to the nature of his property, or the persons who are of kindred to him, or in whose favour it would be proper that he should make his will. A cannot make a valid will. • A executes an instrument purporting to be his will, but he does not understand the nature of the instrument, nor the effect of its provisions. This instrument is not a valid will. • A, being very feeble and debilitated, but capable of exercising a judgment as to the proper mode of disposing of his property, makes a will. This is a valid will.
  • 6. PROPERTY WHICH MAY BE DISPOSED OFF UNDER WILL A Hindu may dispose of by will or other testamentary disposition any property (including his share in undivided coparcenary property), which is capable of being disposed of by him.
  • 7. Registration of Will 18. Documents of which registration is optional Any of the following documents may be registered under this Act, namely:- (a) instruments (other than instruments of gift and wills) which purport or operate to create, declare, assign, limit or extinguish, whether in present or in future, any right, title or interest, whether vested or contingent, of a value less than one hundred rupees, to or in immovable property; (b) instruments acknowledging the receipt or payment of any consideration on account of the creation, declaration, assignment, limitation or extinction of any such right, title or interest; (c) leases of immovable property for any term not exceeding one year, and leases exempted under section 17; (cc) instruments transferring or assigning any decree or order of a court or any award when such decree or order or award purports or operates to create, declare, assign, limit or extinguish, whether in present or in future, any right, title or interest, whether vested or contingent, of a value less than one hundred rupees, to or in immovable property; (d) instruments (other than wills) which purport or operate to create, declare, assign, limit or extinguish any right, title or interest to or in movable property; (e) wills; and (f) all other documents not required by section 17 to be registered.
  • 8. Revocation • Will may be revoked or altered. -A will is liable to be revoked or altered by the maker of it at any time when he is competent to dispose of his property by will. Indian Succession Act, 1925 (Section 62)
  • 9. Revocation 70. Revocation of unprivileged will or codicil. -No unprivileged will or codicil, nor any part thereof, shall be revoked otherwise than by marriage, or by another will or codicil, or by some writing declaring an intention to revoke the same and executed in the manner in which an unprivileged will is hereinbefore required to be executed, or by the burning, tearing, or otherwise destroying the same by the testator or by some person in his presence and by his direction with the intention of revoking the same. • Illustrations • A has made an unprivileged will. Afterwards, A makes another unprivileged will which purports to revoke the first. This is a revocation. • A has made an unprivileged will. Afterwards, A, being entitled to make a privileged will, makes a privileged will, which purports to revoke his unprivileged will. This is a revocation.
  • 10. Witness • Above 18 years of age and mentally competent but not blind • Ideal witnesses • Expect witness to outlive you • Signing without pressure • Testator have the mental capacity and intent to make a will • Avoid conflict of interest
  • 11. FORMALITIES FOR A WILL • Writing • Major • Sound Mind • Free Consent • Dated • Signed • Attestation • Declaration of intent of the testator with respect to his property • Must specify that his intent should be carried out after the testator’s death • Where one of the natural heirs is to be disinherited, reasons be stated
