Enforcement officers must operate under the purview of the United States Constitution.
There are clear constitutional limitations on police behavior.
The Fourth amendment provides civilians protection against "unreasonable searches and seizures".
Case law has helped define the interpretation of what constitutes unreasonableness and also, what constitutes a search and seizure.
The Fourth amendment is only applicable to governmental actions including local, state, and federal enforcement.
The scope of constitutional protections does not however, impose upon the actions of private individuals or companies.
The Fourth amendment also concerns itself with what is regarded as a reasonable expectation of privacy.
In certain circumstances, an individual would not have a reasonable expectation of privacy and so it may not fall under the purview of the Fourth amendment.
Laws continue to evolve and the Constitution continues to be subjected to evaluation and interpretation.
A warrant must be obtained in order to search or seize.
Officers must also establish probable cause to suggest that they have enough evidence against a suspect to authorize, issuance of a warrant.
In some instances, police officers can conduct warrantless searches and seizures.
One type of warrantless seizure is known as a Terry stop or a stop-and-frisk.
In these unique circumstances, law enforcement only need have "reasonable suspicion" not probable cause, to believe that a person has committed a crime.
The Fifth Amendment contends that no person "shall be compelled in any criminal case to be a witness against himself".
As such, the Fifth Amendment provides defendants the constitutional protection of refusing to testify against themselves.
The Fifth Amendment also requires that a defendant is provided due process at all stages of the the legal process.
Due process ensures fairness in all legal matters.
In Miranda v. Arizona (1966), the Supreme Court ruled that before individuals in police custody are questioned, they must be provided clarity about their constitutional rights.
However, this warning is only necessary when an individual is in police custody and police officers are intending to interrogate or question the individual.
It is further only specific to testimonial statement evidence made by the suspect.
If a suspect is read their Miranda rights and does not respond, police officers can still continue to question the suspect and any information obtained, can be admissible.
There is an additional public safety exception to the Miranda rule as well.
In other words, police do not have to provide a Miranda warning if there is an immediate threat to public safety.
If the suspect provides any statements under this public safety exception, statements can be admissible against that individual at trial.

An Introduction to Misdemeanor and Felony Crimes
Crimes in the United States fall into two categories of severity: misdemeanors and felonies. Misdemeanors remain lesser crimes compared to felonies and carry less severe penalties, though some overlap between the two designations exists.
Violence is a major point of consideration when distinguishing between misdemeanors and felonies. That said, it is not a determining factor. For example, minor assault consists of physical violence that does not yield serious injuries, such as broken bones or lacerations that require stitches; many jurisdictions consider it a misdemeanor. However, many jurisdictions consider assault and battery on a child as a serious felony offense.
Felonies may also involve psychological harm, such as the harm incurred by the victims of kidnapping. Felony crimes, such as tax evasion or copyright infringement, can be much broader. Common examples of misdemeanors, meanwhile, include vandalism and disorderly conduct. Misdemeanors can sometimes lead to felonies, such as when a parolee violates the conditions of their parole.
Nonetheless, states have the authority to categorize crimes as they see fit. Many states maintain various levels of misdemeanor and felony crimes.

Proceedings in Georgia State Court centered around an Atlanta-based trucking accident. The plaintiff alleged the accident resulted from a top-heavy cargo container and other mismanaged loading practices, causing the truck to roll over while taking a freeway exit ramp. The driver incurred injuries during the accident.

However, there are certain situations where courts may decide to "pierce" or "lift" the corporate veil, holding shareholders or members personally liable for the debts or actions of the corporation.
Here are some common scenarios in which courts might lift the corporate veil:
Fraud or Illegality: If shareholders or members use the corporate structure to perpetrate fraud, evade legal obligations, or engage in illegal activities, courts may disregard the corporate entity and hold those individuals personally liable.
Undercapitalization: If a corporation is formed with insufficient capital to conduct its intended business and meet its foreseeable liabilities, and this lack of capitalization results in harm to creditors or other parties, courts may lift the corporate veil to hold shareholders or members liable.

- 3. Almost every legal case involves restrictions on the length of time following an incident in which a claim can be filed and a prosecution can proceed. The statute of limitation takes effect at the moment that a crime is committed or a lawsuit-eligible injury occurs, and varies depending on the type of case.
- 4. One additional consideration is discovery, or the length of time it takes to discover an injury or crime following its occurrence. For example, it can take months for a credit card fraud incident to come to light, and the health impact of medical malpractice may not be apparent for an extended period. In these cases, the statute of limitation starts upon discovery of the causative misdiagnosis or incident.
- 5. Examples of civil statutes of limitations in Texas include 2 years for wrongful death, personal injury, and medical malpractice cases. Product liability cases have a 2 to 15 year time frame, while theft and robbery have a 5-year statute of limitations.
