נפסק כי ההסתדרות חצתה קווים אדומים בניהול הליכי ההתארגנות: הן בנאומי הסתה לאלימות ולפגיעה בחברה; הן בכך שפעלה באופן לא דמוקרטי; הן בכך שפעלה בחוסר שקיפות מול העובדים והן בכך שנתנה חסות לעבירות משמעת חמורות שבצעו פעיליה.
עוד נקבע כי החברה הייתה רשאית להפסיק את המו"מ הקיבוצי שניהלה עם ההסתדרות ברגע שראשי ההסתדרות הסיתו את העובדים לאלימות וקראו להפלת המניה של החברה. עוד נפסק כי מדובר בחציית קו אדום מצד ארגון עובדים שהמעסיק לא מחויב להשלים איתו. חופש ההתארגנות לא מעניק לארגון עובדים זכות לנסות ולפגוע בקנין המעסיק.
בסופו של פסק הדין, בן למעלה מ-110 עמודים, נקבע כי ההסתדרות תישא בהוצאות משפט חריגות. "בבואנו לשקול את פסיקת ההוצאות והגם שהלכה היא שבמסגרת הליך קיבוצי אין פוסקים הוצאות. מצאנו כי המקרה שבפנינו חריג הוא. כפי שציינו בתחילת הדברים, בסופו של יום, התמונה מורכבת מפרטים רבים אך מהתצרף עולה כי המבקשת טענה כנגד המשיבה טענות רבות שלא היה להן בסיס כאשר היא עותרת לחייבה בתשלום פיצוי עונשי ללא הוכחת נזק בשיעור של 15 מיליון שקל בגין הפגיעה בחופש ההתארגנות".
