1. جلسه ششمدسترسی زنان به پست های بالای مدیریت، رهبری و تصمیم گیری زن در حکومت طبق اسناد بین المللی طبق اسناد بین المللی مشارکت در امور سیاسی از حقوق اولیه هر انسانی می باشد که میبایست بدون هیچ گونه تبعیضی اعمال گردد. ماده ۲۱ اعلامیه جهانی حقوق بشر وماده ۲۵ میثاق بین المللی حقوق مدنی و سیاسی ، این حق را به رسمیت شناخته اند.
3. سوال؟ طبق قانون اساسی در کدام یک از پستهای حکومتی شرط مرد بودن به صراحت ذکر شده؟ آیا زنان نیز میتوانند بعنوان روحانی در برخی پستها قرار گیرند؟ کدام یک از دو منبع قانون اساسی و فقه بیشترمانع زنان در احراز مقام بالای حکومتی میباشد؟
4. رهبری اصل ۵ قانون اساسی مقام رهبری را به رسمیت شناخته و اصل ۱۰۹ شرایط رهبری را ذکر میکند. طبق منابع فقهی درجه اجتهاد برای مقام رهبری لازم است. در خصوص احراز مقام اجتهاد از سوی زنان، نظرات متفاوتی میان فقها وجود دارد. در عمل تا به حال هیچ زنی در مقام اجتهاد نتوانسته به حکومت راه یابد چه رسد به عالیترین مقام در نظام جمهوری اسلامی.

6. ریاست قوه قضاییه (طی اصل ۱۵۷) هر چند شرط قضاوت برای این مقام در قانون اساسی ذکر نگردیده اما با توجه به محدودیتهای موجود برای ورود زنان به مقام قضاوت، میتوان تصور نمود که زنان از مقام ریاست نیز در عمل محروم شده اند.
7. قضاوت پس از انقلاب زنان به طور کامل از این مقام محروم شدند. از سال ۱۳۶۳ به بعد قانون گذار انعطاف به خرج داد تا زنان بتوانند به عنوان مشاور در دادگاههای خانواده راه پیدا کنند. در سالهای اخیر زنان به عنوان مستشار دادگاه تجدیدنظر، دادیار در دیوان عالی کشور و معاون رئیس دادگستری نیز میتوانند فعالیت کنند.

9. شورای نگهبان طبق اصل ۹۱ قانون اساسی، شورای نگهبان متشکل است از ۶ نفر فقیه و ۶ نفر حقوقدان. تا کنون زنان هیچ گونه جایگاهی چه به عنوان فقیه و چه به عنوان حقوقدان در شورای نگهبان نداشته.
10. مجلس خبرگان رهبری قانون اساسی، بصراحت، شرایط نمایندگان مجلس خبرگان را بیان نکرده و تعیین آن را مطابق اصل ۱۰۸، برای نخستین دوره، به فقهای اولین شورای نگهبان و پس از آن، به خود مجلس خبرگان واگذار کردهاست. در قوانین عادی مربوط به شرایط خبرگان، مرد بودن به صراحت نیامده ولیزنان مجتهد در عمل و در صحنه سیاسی اجتماعی چندان مورد توجه نبوده.

12. امامت جمعه شهر ها امامان جمعه نقش مهمی را در سیاست گذاریهای نظام جمهوری اسلامی بازی می کنند . تا به حال زنی به این مقام منصوب نشده و این نیز خود گویای عدم مقبولیت زنان در این منصب میان روحانیون می باشد.
13. سوال؟ آیا از نظر قانون اساسی، مرد بودن از جمله شرایط صلاحیت برای احراز مقام ریاست جمهوری است؟ قانون اساسی چه نوع موضعیدر این خصوص به طور روشن دارد؟
14. ریاست جمهوری در اصل ۱۱۵ قانون اساسی راجع به شرایط رئیس جمهور، از کلمه "رجال مذهبی و سیاسی" استفاده شده. این کلمه ابهام داشته و میبایست از سوی شورای نگهبان تفسیر شود. امری که تا الان محقق نگردیده.
