Summary of the en banc ruling In re Tam

On Dec. 22, 2015, the Federal Circuit held en banc in In Re Simon Shiao Tamthat the
disparagement provision of Section 2(a) of the Lanham Act is unconstitutional in
violation of the First Amendment.
Writing for the majority, Judge Moore explained, “The government cannot refuse to
register disparaging marks because it disapproves of the expressive messages
conveyed by the marks. It cannot refuse to register marks because it concludes that
such marks will be disparaging to others.”
After considering the provision under both strict scrutiny and intermediate scrutiny,
the court concluded that, in either case, the disparagement provision fails to pass
constitutional muster.
Judge Lourie’s Dissent In re Tam

Judge Lourie argued that the Lanham Act has dated back 70 years, it has been
continuously applied during that time and it now being found to be unconstitutional
seems bizarre.[Judge Lourie cites to stare decisis as the first reason why the majority
made a mistake.
Additionally, Judge Lourie said that denial of an applicant's trademark does not
deny their right to speak freely.[Contending that the mark holder may still generally
use the mark as it wishes; without federal registration, "it simply lacks access to
certain federal statutory enforcement mechanisms for excusing others from
confusingly similar uses of the mark.“
Judge Lourie also said that there are other ways for the mark holder to have
protections, including common law rights.
Finally, Judge Lourie also determined that trademarks are exclusively commercial
speech and should therefore not be analyzed under strict scrutiny.[

“In affirming a refusal to register a
mark as scandalous under §2(a),
the Court of Customs and Patent
Appeals noted dictionary entries that
defined ‘scandalous’ as, inter alia,
shocking to the sense of propriety,
offensive to the conscience or moral
feelings or calling out for
condemnation. ….
“The statutory language
‘scandalous’ has also been
considered to encompass matter
that is ‘vulgar,’ defined as ‘lacking in
taste, indelicate, morally crude.’
“The meaning imparted by a mark
must be determined in the context of
the current attitudes of the day”

“The term ‘slants’ and the full equivalent ‘slant-eyes’ has long
been a derogatory term directed towards those of Asian
descent. The etymology of the term suggests that its use
became prevalent during the various wars of the 20th century,
starting with World War II and increasing in use in the Vietnam
war as a term to deride and mock the citizens of the countries
at war with the United States and those of Asian
descent in general. See The Color of Words: An Encyclopaedic
Dictionary of Ethnic Bias in the United States.
“Since that time, the research of the Office indicates that the
term ‘slants’ retains it’s [sic] offensive and derogatory
meaning. . . “

More specifically, the band’s name has been found offensive
numerous times. First, a band performance and a speaking
engagement for the lead singer were cancelled because there
had been concerns raised over the name of his band. See The

“Second, articles on the band have noted that the name has
been controversial and that the band chose the name, in part
due to the history of the term. . . .
“Further, several bloggers and commenters to articles on the
band have indicated that they find the term and the applied-
for mark offensive, even after extensive dialogue with the
applicant.”

“As is plainly stated in In re Squaw Valley, the test looks not only
at dictionary definitions, any other elements in the mark, and the
nature of the goods/services, but also at the manner in which
the mark is used in the marketplace in connection with the
goods and/or services. In re Squaw Valley Dev., 80 USPQ2d at
1267 (citing Harjo, 50 USPQ2d at 1740-41); TMEP §1203.03(c).
Thus, a proper consideration of the application is to determine
how the mark would be perceived based upon how it is used in
the marketplace.”

“Here, the evidence is uncontested that applicant is a founding
member of a band (The Slants) that is self described as being
composed of members of Asian descent.
“Thus, the association of the term SLANTS with those of Asian
descent is evidenced by how the applicant uses the mark – as
the name of an all Asian-American band.”

Summary of the en banc ruling In re Tam (C) Ronald Coleman 2014 On Dec. 22, 2015, the Federal Circuit held en banc in In Re Simon Shiao Tamthat the disparagement provision of Section 2(a) of the Lanham Act is unconstitutional in violation of the First Amendment. Writing for the majority, Judge Moore explained, “The government cannot refuse to register disparaging marks because it disapproves of the expressive messages conveyed by the marks. It cannot refuse to register marks because it concludes that such marks will be disparaging to others.” After considering the provision under both strict scrutiny and intermediate scrutiny, the court concluded that, in either case, the disparagement provision fails to pass constitutional muster.
  • 3. Judge Lourie’s Dissent In re Tam (C) Ronald Coleman 2014 Judge Lourie argued that the Lanham Act has dated back 70 years, it has been continuously applied during that time and it now being found to be unconstitutional seems bizarre.[Judge Lourie cites to stare decisis as the first reason why the majority made a mistake. Additionally, Judge Lourie said that denial of an applicant's trademark does not deny their right to speak freely.[Contending that the mark holder may still generally use the mark as it wishes; without federal registration, "it simply lacks access to certain federal statutory enforcement mechanisms for excusing others from confusingly similar uses of the mark.“ Judge Lourie also said that there are other ways for the mark holder to have protections, including common law rights. Finally, Judge Lourie also determined that trademarks are exclusively commercial speech and should therefore not be analyzed under strict scrutiny.[

  • 5. “In affirming a refusal to register a mark as scandalous under §2(a), the Court of Customs and Patent Appeals noted dictionary entries that defined ‘scandalous’ as, inter alia, shocking to the sense of propriety, offensive to the conscience or moral feelings or calling out for condemnation. …. “The statutory language ‘scandalous’ has also been considered to encompass matter that is ‘vulgar,’ defined as ‘lacking in taste, indelicate, morally crude.’ “The meaning imparted by a mark must be determined in the context of the current attitudes of the day” TMEP § 1203.1 Immoral or scandalous matter (C) Ronald Coleman 2014

  • 30. “The term ‘slants’ and the full equivalent ‘slant-eyes’ has long been a derogatory term directed towards those of Asian descent. The etymology of the term suggests that its use became prevalent during the various wars of the 20th century, starting with World War II and increasing in use in the Vietnam war as a term to deride and mock the citizens of the countries at war with the United States and those of Asian descent in general. First, a band performance and a speaking engagement for the lead singer were cancelled because there had been concerns raised over the name of his band.
