How does the NHS ensure that it obtains best value when procuring its construction needs? No doubt this will be a question that will increasingly concern the NHS should they be called upon to bear a share of the widely anticipated cuts in public spending.
Over the last 18 months, the NHS has sought to achieve best value through the application of Frameworks Scotland. HFS Frameworks Scotland operates on a design and build basis along with a target cost payment mechanism. Will HFS Frameworks Scotland always be the most appropriate way to procure the construction needs of the
NHS? Can local frameworks be used to procure projects for which Frameworks Scotland is not suitable? Burness, with the assistance of procurement specialists within the NHS and the private sector, will be offering answers to these questions.
Frameworks are no longer the only option for the NHS and a new era of the hub is now dawning. How will hub operate and how will it interact with national and local frameworks? Burness, as legal advisors to the hub South East Territory, is ideally placed to offer views of these important issues.
Lynne and Jen take you through some recent developments in case law affecting commercial contracts and procurement, dealing with:
• whether a written contract can in fact still be varied orally

THE CONFERENCE
The theme for this year’s conference is Change Management and Claims.
Change is an unavoidable part of every construction project. Hundreds if not thousands
of changes can be ordered in a construction project. This conference will explore the
typical contractual mechanisms concerning change, how to manage any such changes
and the consequences of such changes including the valuation of the changes, their
delaying and disruptive effects and their associated costs.
We are delighted to announce that Mr CHAN Ka-kui, SBS, JP, Chairman of the Construction

A review and discussion of the standard provisions and principles for ordering change,
including:
• Typical contractual mechanism for ordering change and comparison with different
standard form contracts;
• Whether the change constitutes a variation – within contract scope, build-ability
obligations, design obligations, ambiguities and discrepancies etc;
• Power to order change – limits on type and timing of change, omission of work, authority
to order change etc; and
• Express and implied duty to order change – impossibility, contractor proposals etc
