I Have To Exercise How Many Hours, If I
Eat This Cheeseburger Today.....!
 The Nutritional Labeling and Education Act (NLEA) was passed
in 1990, 65% of consumers said they completely or most likely
agree with the statement. That percentage remained steady
throughout the early 1990s, at 64%, and in 1995 after the labels
began to appear on food packaging. Since then, the percentage
of consumers in agreement has varied, though it reached a low
of 48% in 2013.

Do Consumers Care Anymore?
 The FDA is using data from 2002 – 2008, to
determine the eating habits of the US
consumer.
 Based on Quantity Consumed, the FDA is
proposing changes to the Reference Amount
Customarily Consumed (RACC’s)
 Changes to Macronutrient and Micronutrient
data are being considered too.
The FDA Thinks Consumers Do Not….
Side-by-side: (1)
New serving sizes.
(2) Calorie count
given larger and
bolder typeface. (3)
Calories from fat no
longer listed
separately. (4) Extra
line to spell out
added sugar. (5)
New listing for
vitamin D and
potassium.
Lets look at the proposed changes….
 If the alterations are adopted, drinks
companies, for example, would no longer be
able to treat a 20oz bottle of soda as
containing 2.5 servings of 8oz each for the
purpose of labeling estimated calorie levels.
Instead, both 12oz cans and 20oz bottles
would each have to be treated as a single
serving, and the calorie estimate displayed
prominently on the label will increase by 50%
or 150% accordingly.
And How Does That Affect My
Company Claims….
Based on the
changes the
new label of
20oz soda, will
now read:
1) Calories = 250
(10% of DV)
2) Added Sugars =
67.5g (approx
2.5 oz)
3) Carb = 67.5g
(22.5% of DV)
The Reality of the New Label….
And How Does That Affect My Company Financially….
 The FDA is using the data from the CDC and is using the
National Health and Nutrition Examination Survey
(NHANES) to determine the changes needed.
 The comment period is now over, the FDA is reviewing
the comments.
 Once the rules change, companies will have 2 years to
comply
 There is a small business exemption rule, less than 100
F/T employees & <100k units sold
 Imported foods would be affected as well.
 Restaurants will be affected in a similar manner.
