Sale Deed of Apartment no. C6/2/3:2, on the third floor of “Satyam
Apartment Owner’s Association”, C-6 type, Building no. 1 to 4,
Condomin no. 3, Sector-5, C.B.D. Belapur, Navi Mumbai - 400614,
Dist. Thane Zilla Parishad limit and within the jurisdiction of Sub-
Registrar of Belapur, Navi Mumbai, Tal. Thane & Dist. Thane for a
price of Rs.48,00,000/- (Rs. Forty Eight Lakh Only).
SALE DEED OF APARTMENT made at CBD Belapur, Navi
Mumbai on this 09th day of June, 2022, BY AND BETWEEN,
Mrs. Archana Ajay Nanaware (PanNo. ADPPN4847G), W/o.Mr.
Ajay Nanaware, Adult, Indian inhabitant and residing at A-001,
Gokul Galaxy CHSL, Thakur Complex, Kandivali (East), Mumbai
400101, Maharashtra (hereinafter referred as “THE APARTMENT
OWNER” whichexpressionshall unless it berepugnant to thecontext
or meaning thereof shall mean and include their respective heirs,
executors, administrators, attorney and assigns) of the ONE PART.
AND
(1.) Mr. Avinash Anant Musale (Pan No. AGNPM9097N), S/o.
Mr. Anant Musale and (2.) Mrs. Pallavi Avinash Musale (Pan No.
ATUPM6503B), W/o. Mr. Avinash Musale, Both Adults and Indian
inhabitants, residing at 601, Janki Raghunath Residency CHSL,
Agarkar Road, Dombivali East, Tilaknagar, Thane 421201,
Maharashtra, (hereinafter referred to as “The PURCHASERS”
which expression shall unless it be repugnant to the context or
meaning thereof shall mean and include their respective heirs,
executors, administrators, attorney and assigns) of the SECOND
PART.
1. AND WHEREAS The City and Industrial Development
Corporation of Maharashtra Ltd. a Government company
within the meaning of the Companies Act 1965,(1 of 1956)
(hereinafter referred to as “THE CORPORATION”having its
registered officeat Nirmal, 2nd Floor, Nariman Point, Bombay
400021, is a new TownDevelopment Authority, under the
provisions of sub-section (3-a) of Section 113 of The
Maharashtra Regional & Town Planning Act of 1966
(hereinafter referred to as “The MRTP Act”) for the New
Towns of New Bombay.
2. AND WHEREAS THE STATE GOVERNMENT In
pursuance ofSection113-A of The Maharashtra Regional &
Town Planning Act of 1966 acquired land and vested in City
and Industrial Development Corporation of Maharashtra Ltd,
(hereinafter known as ‘CIDCO’) fordevelopment and disposal
inter alias a piece or parcel of lands for development and
disposal situated at Sector 5, CBD, Belapur, Navi Mumbai,
Dist. Thane, (hereinafter referred to as “THE SAID LAND”.
3. WHEREAS BY HIS ORDER NO. RB/WS/IV/716/644/A-74
dated 31/7/74 the collector of Thana vested in CIDCO for
development anddisposal inter alias, a piece or parcel of land
situated at Village Shahabaj, Tehsil Thana, Dist. Thana, bearing
Gat or Survey No. 181pt, 191pt, 192pt, admeasuring about
4894.46 Sq. Mtrs or thereabouts being Plot No. - , in Sector- 5,
CBD Belapur, Village Shahabaj, Tehsil Thana, Dist. Thana and
the Corporation obtained possession of the said land and
constructed thereon C-6 type building No. C-6/2/3:2 each of
Ground and Third Floor upper floors such building being
designated as Condominium 3 type building No. C- 6/2/3:2
(Hereinafter referred to as “the said building”) of which the
Corporation is the Owner.
4. WHEREAS CIDCO by declaration dated 30th July 1984 under
the Maharashtra Apartment Ownership act 1970, (hereinafter
referred toas THE SAID LAND ACT) has submitted the said
land and the said building with all Apartment under the
provisions of the said Act which Declaration together with its
Annexure--A {plans}, A1 (Farm of Lease), B (statement of
proportionate shares) and C (‘Bye-Laws’)attached thereto, has
been registered in Office of the Sub-Registrar of Assurance,
Thane on 19th day of June 1984 under Serial No P— 253, in the
Register of Declarations and Deed of Apartment under the said
Act, a true copy whereof has been filed with the Housing
Commissioner on 19th day of June 1984.
5. WHEREAS AN INDENTURE of lease dated 18th day of April
1985 made between the Corporation as the ONE PART & (1)
Shri. Halkopkar Prakash Krishnarao, the Apartment Owner,
therein referred to as the lessees of the OTHER PART, the
Corporation demised to the said lessess the said land as tenants
in common in share equal to their respective percentage of the
undivided interest in the common areas and facilities as
expressed in the aforesaid Declaration, flied by the Corporation
under the said Act; and more particularly described in the
schedule to the said indenture lease for a term of 60 years on
the terms and conditions therein mentioned.
6. WHEREAS SHRI. GAJARE VASANT BABURAO (THE
FIRST AND THE ORIGINAL APARTMENT OWNER)
purchased the APARTMENT N0. C-6/2/3:2, Sector-5, CBD,
Belapur from CIDCOLTD., vide Deed of Apartment dated 9th
day of January, 2020, whichcame to be registered before the
Sub Registrar of Assurance, Thane 6, vide Serial No.
TNN6/987/2020 and Receipt No-1041 on 18/01/2020,
admeasuring about 54.03 Sq. Mtrs built up area {hereinafter
referred to as said APARTMENT}.
7. AND WHEREAS SHRI. GAJARE VASANT BABURAO
(THE FIRST AND THE ORIGINAL APARTMENT
OWNER) gifted andtransferred the said apartment to MRS.
ARCHANA AJAY NANAWARE (THE APARTMENT
OWNER) vide Gift Deed dated18th January 2020, which came
to be registered before the Sub Registrar of Assurance, Thane
6, vide Serial No. TNN6/988/2020 and Receipt No-1042 on
18/01/2020 and the Corporation has also transferred the said
Apartment in the name of SECOND APARTMENT OWNER
- MRS. ARCHANA AJAY NANAWARE.
8. WHEREAS THE APARTMENT OWNER is absolutely seized
and possessedof otherwise well and sufficiently entitled to the
Apartment No C-6/2/3:2, on the Third floor in the building No.
C-6/2, situated at Sector-5, CBD Belapur, Navi Mumbai,
District Thane, together with (1.1643)% of undivided interest
appurtenant tothe said Apartment and to the common areas and
facilities of the saidland & building as mentioned above.
9. WHEREAS THE PRESENT APARTMENT OWNER has
agreed tosell the above described Apartment to the Purchasers
together with all her rights, title and interest therein together
with her share of the undivided interest appurtenant to the said
Apartment and to the areasand facilities as specified in the
aforesaid declaration and together with electricity meter for a
price of Rs.48,00,000/- (Rupees Forty Eight Lakh Only).
10.WHEREAS THE CORPORATION has granted permission to
the APARTMENT OWNER to sell the said Apartment to the
PURCHASERS vide its Letter No. CIDCO/ESTATE-
1/2022/8000149893 dated 27/04/2022 on certain terms and
conditions which have been fully complied with by the
Apartment Owner.
11.WHEREAS THE PRESENT APARTMENT OWNER has paid
service charges, property Tax, Maintenance & Repair charges,
water and electricity charges, subscription of ‘C-6’ type to the
Apartment Owner’s Association etc. and to the respective
authorities upto date.
12.WHEREAS THE PRESENT APARTMENT OWNER has
agreed to sell and the Purchasers have agreed to purchase the
Apartment No. C-6/2/3:2 in the building No. C-6/2, Sector 5,
CBD Belapur, Tehsil Thane, Dist. Thane called as ‘THE SAID
APARTMENT’ for a total sale price of Rs.48,00,000/-(Rupees
Forty EightLakh Only) and the Apartment Owner has received
the full and final consideration/sale price of Rs.48,00,000/-
(Rupees Forty Eight Lakh Only) from the Purchasers.
13.WHEREAS THE PRESENT APARTMENT OWNER has given
all the Original Documents of the aforesaid Apartment, i.e. the
Deed of Apartment and all relevant and chain of documents, the
Allotment letter, payment receipts, possession letter and the
Purchasers admits of having inspected and satisfied with the
same.
14.WHEREAS THE PRESENT APARTMENT OWNER has
delivered peaceful, vacant and physical possession of the said
Apartment along with the above said Original relevant
documents to the Purchasers after receiving the full and final
consideration from them.
15.NOW IT IS HEREBY AGREED BY AND BETWEEN THE
PARTIES HERETO AS FOLLOWS:
THAT the Purchasers has paid to the Apartment Owner the full
and final consideration amount of Rs.48,00,000/-(Rupees Forty
Eight Lakh Only) being the total price payable by the
Purchasers to the Apartment Owner and RECEIPT whereof the
Apartment Owner doth hereby admit and acknowledge of and
from the same and every part thereof, does forever require,
release and discharge the Purchasers. And the Apartment Owner
doth hereby grant convey, assign and assure unto the Purchasers
for residential purpose Apartment no. C6/2/3:2, on the Third
floor of “Satyam Apartment Owner’s Association”, C-6 type,
Building no. 1to 4, Condomin no. 3, Sector-5, C.B.D. Belapur,
Navi Mumbai - 400614, Tehsil and Dist. Thane, (hereinafter
referred as THE SAID APARTMENT) and which is more
particularly described in the Second Schedule hereunder written
and the land, (hereinafter called said land) and more particularly
described in the first schedule hereinafter written, together with
certain percentage of undivided interest appurtenant to the said
APARTMENT and the common areas and facilities of the said
land and the said building as specified in the aforesaid
Declaration of the said APARTMENT and the percentage
collectively referred to as the said premises, TO HOLD the said
premises hereby granted, conveyed and assigned unto the
Purchasers as heritable & transferable immovable property
within the meaning of any law for the time being in forcesubject
to the provisions of the Maharashtra Apartment Ownership Act
1970 and said Declaration and bye-law attached thereto and also
subject to the terms and conditions of lease, covenants contained
in the aforesaid Indenture oflease in respectofthe said land. The
Apartment owner has in themselves good right, full power, and
absolute authority to grant convey assure and assign all the said
premises hereinabove expressed to be hereby granted, conveyed,
assured and assigned unto and to the use of the Purchasers their
successors, executors, administrators and assigns and it shall be
lawful for the Purchasers at all times, hereafter, peaceably and
quietly to enter into and hold, posses and enjoy the said premises
and receive rents and profits thereof and every part thereof
subject as aforesaid without any interruption or hindrance by the
APARTMENT OWNER their heirs, executors, administrators
and assigns or any person claiming under the Apartment Owner
or in trust for them and that free and clear and freely clearly and
absolutely release and forever discharge, well and sufficiently
saved, defended and kept harmless and indemnified of, from and
against all estates, titles, charges, encumbrances, claims and
demands created, occasioned made by the Apartment Owner or
any person or persons lawfully or equitably claiming by from
through under or in trust for them and that the Apartment Owner
will at all times hereafter at the request of the Purchasers or any
other persons authorised by the Purchasers in that behalf to do or
cause to be done, execute orcause to be executed all such further
lawful and reasonable acts, deeds, things, conveyances and the
assurances in the law whatsoever for the better and further
granting, conveying assigning and assuring the said premises and
every part thereof unto the cause of the Purchasers as shall or
may reasonably required by the Purchasers, AND THE
PURCHASERS covenants with the Vendor that the Purchasers
as one of the Lessee at all times hereinafter during the said term
of lease granted by the aforesaid Indenture of lease, pay service
charges to the CIDCO and observe and perform all terms and
conditions and covenants contained therein and also admits to
observe the reserve right of Preemptions or the right to share
50% of the incremental value at the option of the CIDCO which
is reserved by the CIDCO and will at all times hereafter keep
indemnified the APARTMENT OWNER, their heirs, executors,
administrators and assigns their estates and effect of and from
and against the payment of such service charges and observance
and performance of the terms and conditions and covenants
contained in the said INDENTURE OF LEASE.
16. IT IS FURTHER AGREED that the Purchasers shall not sell,
assign, mortgage, underlet or otherwise transfer wholly or partly
the said premises save and except with the previous written
permission of the CITY & INDUSTRIAL DEVELOPMENT
CORPORATION Which Permission shall not be refused if the
Purchasers performs or is willing to perform the following
conditions.
THAT IS TO SAY:
1) The Purchasers pays to the corporation, the necessary transfer
charges.
2)In the Instrument bywhich the Purchasers shall transfer the said
premises, the Purchasers binds the subsequent purchaser not to
sell, assign, mortgage underlet to otherwise transfer wholly or
partly the said premises save and except upon the observance and
performance of the conditions herein written.
17.It is agreed by the Apartment Owner that the share money and
entrances fee and deposits paid by the Apartment Owner and
service connection charges if any paid to the M.S.E.B. which is
attached to the Apartment stand transferred to the Purchasers
consequent uponthe execution of these presents and no claim for
refund of these amounts will be entertained.
FIRST SCHEDULE ABOVE REFERREDTO:
All that piece of land containing by admeasurement about
4894.46 Sq.Mtrs or thereabout being Plot No. - in Sector - 5, of
the Layout of the land bearing Gat No. 181pt, 191pt, 192pt and
other land situate, laying and being at Village Shahabaj, Tehsil
Thane, District Thane andbounded as follows:-

ON THE EAST BY : 8.00 MTRS ROAD
ON THE SOUTH BY : 30.00 MTRS ROAD
ON THE WEST BY : 15.00 MTRS ROAD
THE SECOND SCHEDULE ABOVE REFERRED TO:
The Apartment No. C-6/2/3:2, Sector-5, C.B.D. Belapur, Navi
Mumbaiadmeasuring 54.03 Sq. Mtrs build up area on the Third
floor of building no C-6/2 and other land (more particularly
described in the First Schedule herein above written) and which
the said Apartment is bounded as follows THAT IS TO SAY:-

AND WHEREAS The City and Industrial Development Corporation of Maharashtra Ltd. a Government company within the meaning of the Companies Act 1965,(1 of 1956) (hereinafter referred to as “THE CORPORATION”having its registered officeat Nirmal, 2nd Floor, Nariman Point, Bombay 400021, is a new TownDevelopment Authority, under the provisions of sub-section (3-a) of Section 113 of The Maharashtra Regional & Town Planning Act of 1966 (hereinafter referred to as “The MRTP Act”) for the New Towns of New Bombay. 2. AND WHEREAS THE STATE GOVERNMENT In pursuance ofSection113-A of The Maharashtra Regional & Town Planning Act of 1966 acquired land and vested in City and Industrial Development Corporation of Maharashtra Ltd, (hereinafter known as ‘CIDCO’) fordevelopment and disposal inter alias a piece or parcel of lands for development and disposal situated at Sector 5, CBD, Belapur, Navi Mumbai, Dist. Thane, (hereinafter referred to as “THE SAID LAND”. 3. WHEREAS BY HIS ORDER NO. RB/WS/IV/716/644/A-74 dated 31/7/74 the collector of Thana vested in CIDCO for development anddisposal inter alias, a piece or parcel of land situated at Village Shahabaj, Tehsil Thana, Dist. Thana, bearing Gat or Survey No. 181pt, 191pt, 192pt, admeasuring about 4894.46 Sq. Mtrs or thereabouts being Plot No. - , in Sector- 5, CBD Belapur, Village Shahabaj, Tehsil Thana, Dist. Thana and the Corporation obtained possession of the said land and constructed thereon C-6 type building No. C-6/2/3:2 each of

Ground and Third Floor upper floors such building being designated as Condominium 3 type building No. C- 6/2/3:2 (Hereinafter referred to as “the said building”) of which the Corporation is the Owner. 4. WHEREAS CIDCO by declaration dated 30th July 1984 under the Maharashtra Apartment Ownership act 1970, (hereinafter referred toas THE SAID LAND ACT) has submitted the said land and the said building with all Apartment under the provisions of the said Act which Declaration together with its Annexure--A {plans}, A1 (Farm of Lease), B (statement of proportionate shares) and C (‘Bye-Laws’)attached thereto, has been registered in Office of the Sub-Registrar of Assurance, Thane on 19th day of June 1984 under Serial No P— 253, in the Register of Declarations and Deed of Apartment under the said Act, a true copy whereof has been filed with the Housing Commissioner on 19th day of June 1984. 5. WHEREAS AN INDENTURE of lease dated 18th day of April 1985 made between the Corporation as the ONE PART & (1) Shri. Halkopkar Prakash Krishnarao, the Apartment Owner, therein referred to as the lessees of the OTHER PART, the Corporation demised to the said lessess the said land as tenants in common in share equal to their respective percentage of the undivided interest in the common areas and facilities as expressed in the aforesaid Declaration, flied by the Corporation under the said Act; and more particularly described in the schedule to the said indenture lease for a term of 60 years on the terms and conditions therein mentioned. 6. WHEREAS SHRI. GAJARE VASANT BABURAO (THE FIRST AND THE ORIGINAL APARTMENT OWNER) purchased the APARTMENT N0. C-6/2/3:2, Sector-5, CBD, Belapur from CIDCOLTD., vide Deed of Apartment dated 9th
  • 4. day of January, 2020, whichcame to be registered before the Sub Registrar of Assurance, Thane 6, vide Serial No. TNN6/987/2020 and Receipt No-1041 on 18/01/2020, admeasuring about 54.03 Sq. Mtrs built up area {hereinafter referred to as said APARTMENT}. 7. AND WHEREAS SHRI. GAJARE VASANT BABURAO (THE FIRST AND THE ORIGINAL APARTMENT OWNER) gifted andtransferred the said apartment to MRS. ARCHANA AJAY NANAWARE (THE APARTMENT OWNER) vide Gift Deed dated18th January 2020, which came to be registered before the Sub Registrar of Assurance, Thane 6, vide Serial No. TNN6/988/2020 and Receipt No-1042 on 18/01/2020 and the Corporation has also transferred the said Apartment in the name of SECOND APARTMENT OWNER - MRS. ARCHANA AJAY NANAWARE. 8. WHEREAS THE APARTMENT OWNER is absolutely seized and possessedof otherwise well and sufficiently entitled to the Apartment No C-6/2/3:2, on the Third floor in the building No. C-6/2, situated at Sector-5, CBD Belapur, Navi Mumbai, District Thane, together with (1.1643)% of undivided interest appurtenant tothe said Apartment and to the common areas and facilities of the saidland & building as mentioned above. 9. WHEREAS THE PRESENT APARTMENT OWNER has agreed tosell the above described Apartment to the Purchasers together with all her rights, title and interest therein together with her share of the undivided interest appurtenant to the said Apartment and to the areasand facilities as specified in the aforesaid declaration and together with electricity meter for a price of Rs.48,00,000/- (Rupees Forty Eight Lakh Only). 10.WHEREAS THE CORPORATION has granted permission to the APARTMENT OWNER to sell the said Apartment to the

PURCHASERS vide its Letter No. CIDCO/ESTATE- 1/2022/8000149893 dated 27/04/2022 on certain terms and conditions which have been fully complied with by the Apartment Owner. 11.WHEREAS THE PRESENT APARTMENT OWNER has paid service charges, property Tax, Maintenance & Repair charges, water and electricity charges, subscription of ‘C-6’ type to the Apartment Owner’s Association etc. and to the respective authorities upto date. 12.WHEREAS THE PRESENT APARTMENT OWNER has agreed to sell and the Purchasers have agreed to purchase the Apartment No. C-6/2/3:2 in the building No. C-6/2, Sector 5, CBD Belapur, Tehsil Thane, Dist. Thane called as ‘THE SAID APARTMENT’ for a total sale price of Rs.48,00,000/-(Rupees Forty EightLakh Only) and the Apartment Owner has received the full and final consideration/sale price of Rs.48,00,000/- (Rupees Forty Eight Lakh Only) from the Purchasers. 13.WHEREAS THE PRESENT APARTMENT OWNER has given all the Original Documents of the aforesaid Apartment, i.e. the Deed of Apartment and all relevant and chain of documents, the Allotment letter, payment receipts, possession letter and the Purchasers admits of having inspected and satisfied with the same. 14.WHEREAS THE PRESENT APARTMENT OWNER has delivered peaceful, vacant and physical possession of the said Apartment along with the above said Original relevant documents to the Purchasers after receiving the full and final consideration from them. 15.NOW IT IS HEREBY AGREED BY AND BETWEEN THE PARTIES HERETO AS FOLLOWS:

THAT the Purchasers has paid to the Apartment Owner the full and final consideration amount of Rs.48,00,000/-(Rupees Forty Eight Lakh Only) being the total price payable by the Purchasers to the Apartment Owner and RECEIPT whereof the Apartment Owner doth hereby admit and acknowledge of and from the same and every part thereof, does forever require, release and discharge the Purchasers. And the Apartment Owner doth hereby grant convey, assign and assure unto the Purchasers for residential purpose Apartment no.
