Introduction REGISTRATION UNDER LEGAL

1. Earlier “The Standards of Weights and Measures Act, 1976” and Rules made
thereunder was prevailing which were repealed by The Legal Metrology Act, 2009
2. The Legal Metrology Act, 2009 (Act) was published in 2010 and implemented in
2011.
3. Rules under The Legal Metrology Act, 2009 were promulgated in 2011.
4. An Act was made to protect consumers against fraud of sellers.

Legal Metrology Law consist of following enactments:

Section 18 of The Legal Metrology Act, 2009 says that package should bear such declaration as
may be prescribed in Rules.
Consequently following Declaration should be mentioned on retail package as per Legal Metrology
(Packaged Commodities) Rules, 2011:
Rule-6 Declaration on Retail Package
1. Name & Address of Manufacturer, Packer, Importer
2. Name of Commodity
3. Quantity of commodity in numbers (In case of Helmets)
4. Month & Year of commodity manufactured (either in words or numbers)
5. Retail sale price of commodity
6. Dimension of commodity, if size of product is relevant
7. Name, address, contact number and mail id of person/office who or which can be contracted if
consumer complaints
8. Any other information which manufacturer thinks necessary

Rule 7: Size of Numerals, Letters, Principal display panel

Provided that the width of the letter or numeral shall not be less than one third of its height, except

If Package having a capacity of 10 cubic cm or less, principal display panel may be a card or tape affixed firmly to
the package and shall bear required information.

Rule-24 Mandatory declaration on wholesale package
1. Name & Address of Manufacturer/Packer
2. Identity of Commodity
3. Total No. of retail package contained in whole package or net quantity or No. of commodity
contained in whole package
Rule-8 Quantity declaration
The Area surrounding the quantity declaration shall be free from printed information:-
(a) Above and below by a space equal to at least the height of numerals in the declaration
(b) To the left and right by a space at least twice the height of numerals in the declaration
 Only Hindi or English can be used as a language (Rule 9)
 As quantity will be mentioned in numbers, So Symbols also can be used to denote numbers.
For this purpose N or U can be used as symbol of Number {Rule 13(5)}

 Rule 27 of Legal Metrology (Packaged commodities) Rules, 2011 creates obligation on every
manufacturer/Packager to get themselves registered with office of controller of Legal Metrology of
concerned State.
 Entity has to apply to the office of controller/Director of Legal Metrology for registration. There are two
types of registration. One is state wise another is centralise. In state wise company can not open plant in
another state without registration in that state.

Step wise Registration Procedure:
Step-1: Entity has to submit application form along with following attachments:
a) Company PAN
b) MOA of Company
c) GST RC
d) Address proof of Company
e) List of Directors
f) Resolution of Authorisation
g) Any other Registration certificate
h) 2 ID proof and 2 Photo of applicant
h) Sample of Declaration
i) DD of Rs. 500 in favour of “Dept. of Consumer Affairs” payable at New Delhi
Step-2: After submission of application inspector will visit, inspect the plant and will give report
to controller of Legal Metrology
Step-3: If they are in satisfaction that every thing is OK, then Registration certificate will be
granted.
