It is defined as a wrong under common law for which damages can be claimed, excluding breaches of contract. The word tort comes from the Latin word "tortum" meaning twisted. It was introduced to the Indian legal system through British rule. For a case of nervous shock, the plaintiff must prove proximity to the incident, shock from seeing or hearing it, and that it caused a recognized psychiatric illness. The defendant is only liable for foreseeable harms to those in the danger zone, not mere bystanders outside it.
Criminal Attempts
Criminal attempts involve liability for trying to commit a crime without completing all elements of the offense. There are two elements: 1) the intention to commit the offense; and 2) conduct that goes beyond mere preparation and shows an actual attempt was made. However, determining when an act has crossed the line from preparation to attempt can be difficult and depends on the specific facts of the case. One can be guilty of an attempt even if unbeknownst to them, completing the crime was impossible. The session objectives are to understand and apply the law of attempts to case studies and evaluate legal arguments regarding attempts.
Medical negligence and consumer protection law
Negligence involves the breach of a legal duty of care which results in injury. The elements of negligence include a duty to meet a standard of care, breach of that duty through failure to exercise reasonable care, causation between the breach and the injury, and damages. Medical professionals are considered to provide a service and can be held liable for negligence under consumer protection laws in India if their actions or lack thereof breach the duty of care owed to patients. However, the burden of proof lies with the complainant to prove negligence through a higher standard of evidence.
Load balancing is impossible
Load balancing is something most of us assume is a solved problem. But the idea that load balancing is “solved” could not be further from the truth. If you use multiple load balancers, the problem is even worse. Most of us use “random” or “round-robin” techniques, which have certain advantages but are highly inefficient. Others use more complex algorithms like “least-conns,” which can be more efficient but have horrific edge cases. “Consistent hashing” is a very useful technique but only applies to certain problems.
There are several factors that exist both in theory and practice that make efficient load balancing an exceptionally hard problem, including Poisson request arrival times, exponentially distributed response latency, and oscillations when sharing data between multiple load balancers. Luckily, there are techniques and algorithms that have been developed that can make life better. Tyler McMullen explains some of the ways that we can do better than “random,” “round-robin,” and naive “least-conns,” even with distributed load balancers.
