Health Club Synergy Agrees To Modify Consumer Contract
After Being Held Liable For Deceptive
Marketing Practices: Settlement Expected To Near $60,000
New York, NY—The Attorney General of New York State announced last week
a
settlement with nine of New York’s fitness clubs by the company name Synergy
— the lawsuit revolved around Synergy’s alleged fraudulent practices in regard to
improper billing and a failure to comply with cancellation policies, both served as
violations to the State’s Health Club Services Law.
The lawsuit stated that customers have been consistently charged additional fees
that were not in the membership agreement. Others claimed to have been victims
of harassment by Synergy’s employees during a financial transaction.
Customer complaints have included the following: “I don't understand
their rules and they do not communicate clearly. They want to take yourmoney as
much as they can.”

2. “I sent in my cancellation and they called me saying that I still owe themmoney
for 3 months.”
“They reported me to a debt collector company because nobody explained to me
that this was their policy.”
In lieu of these events, Attorney General Eric T. Schneiderman stated, “Con
sumers join health clubs to get fit, not to spend energy avoiding
improper fees or dealing with harassing collection calls concerning lawfully
cancelled contracts.”
The lawsuit received a recent settlement of $60,000 in penalties and
fines. In addition, Synergy’s has been stated to promise to restructure their
contract so that it is in compliance with Health Club Service Law.
In response to the lawsuit’s success, Attorney Schneiderman stated, “We
won't tolerate companies that employ opaque and illegal practices to line their
pockets at the expense of New Yorkers.”
