7. Void agreements are void-ab-intio.It is not enforcable

8. If there is mistake by both the parties then it is
known as bilateral mistake.
Example: There is agreement of selling horse
but horse is dead.
Mistake about the tittle : For example , If you
are not owner and sold something.
Mistake about the quality: For example rice or
oil.
9. Every agreements in restraint of marriage of
any person other then a minor is void. Any
agreement which restricts a person’s freedom
to marry is void and against public policy.
In Lowe vs Peers , The promise , Not to marry
somebody else or any other lady was held
against public policy and void.
10. An agreement which restricts a person to trade
or to do business of his choice is against public
policy and void
In madhav charder vs Rajkumar, A and B were
doing same business in the same locality. B
agreed to pay some amount to A with
condition that A would close his business. A
closed his business and sued B to recover the
amount. In this case court has held that it was
case of restraint of trade which is against public
policy.
11. Everyone is free to use judicial system against
wrong acts of others. An agreement is void if it
is taking away this legal freedom.
