33. WHAT ARE YOU?
What are those working for you?
Are YOU an Independent Contractor?
Are YOU an Employee?
Are YOU Self –Employed?
34. Who Is An
Independent Contractor?
The general rule is that the payer, has
the right to control or direct only the
result of the work done by an
independent contractor
and not the means and methods of
accomplishing the result.
35. WHO IS AN EMPLOYEE?
Employee has their taxes paid by employer
paying 50% (7.65).
The other 50% (7.65) of every dollar is taken
from employee’s wages.
36. Type of Relationship
Type of Relationship – Facts that show the
type of relationship include:
Written contracts describing the relationship
the parties intended to create
Whether the worker is provided with
employee-type benefits
37. Contractor AGREEMENT
You Should Have an Written
Independent Contractor Agreement to
Protect All Parties Involved.

If you incorrectly classify an employee as an
independent contractor, you can be held
liable for employment taxes for that worker,
plus penalties and interest.
PLUS BOTH IRS and Dept of Labor, (if I/C is
reassessed as employee) can make you pay back due
FUTA, SS & Medicare Taxes and Worker’s
Compensation if applicable.
42. TAXES and YOUR RIGHTS!
“Anyone may arrange his affairs so that his taxes shall be as
low as possible; he is not bound to choose that pattern
which best pays the treasury. There is not even a patriotic
duty to increase one's taxes.
Over and over again the Courts have said that there is
nothing sinister in so arranging affairs as to keep taxes as
low as possible. Everyone does it, rich and poor alike and all
do right, for nobody owes any public duty to pay more than
the law demands.“
~Judge Learned Hand-U.S. Supreme Court Justice
44. “To Avoid is Legal,
to Evade is Illegal”
So plan to avoid paying taxes
by early planning and preparation.
45. What Can I Deduct?
To be deductible, a business expense
must be both ordinary and necessary.
An ordinary expense is one that is common and
accepted in your trade or business. A necessary

trade or business. An expense does not have to be
indispensable to be considered necessary.
